RESOLUTION OF THE TOWN COUNCIL
OF THE TOWN OF LOS GATOS
ORDERING THE VACATION OF EXCESS PUBLIC STREET RIGHT -OF -WAY
AT 142 S. SANTA CRUZ AVENUE
WHEREAS, the Town Council of the Town of Los Gatos has proceeded under the
provisions of Division 9, Chapter 4, Section 8334, et seq., of the Streets and Highways Code,
concerning the vacation of portions of excess public street right -of -way located in the Town
of Los Gatos, County of Santa Clara, State of California, consisting of an area of
approximately 1,218 square feet, and located near the southerly property line of 142 S.
Santa Cruz Avenue, more particularly described on Exhibit "A" (Abandonment of Land to
Robert B. and Darlene A. Rauh by the Town of Los Gatos), attached hereto, and depicted
on Exhibit "B ", attached hereto; and
WHEREAS, pursuant to the provisions of the Streets and Highways Code, Section
8334(x), the Town Council of the Town of Los Gatos declares that the right -of -way is excess
and is not needed for public street purposes.
RESOLVED, the Town Council of the Town of Los Gatos finds from all of the
evidence submitted that the right -of -way is unnecessary for present or prospective public
purposes, and hereby vacates the right -of -way.

FURTHER RESOLVED, the Town Clerk shall cause a certified copy of this Order,
attested by her under the Seal of the Town, to be recorded in the Office of the County
Recorder of the County of Santa Clara. From and after the date this resolution is recorded,
the right -of -way shall no longer constitute a public street right -of -way.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos, California, held on the 16th day of November, 1992, by the following vote:

All of that certain parcel of land situated in the Town of Los Gatos, County of
Santa Clara, State of California, and being a portion of Rancho Rinconada de Los
Gatos and more particularly described as follows:
Beginning at a 6 -inch square concrete monument with pin, standard
California Highway monument, and said monument being set at the most
southerly corner of lands of Robert B. and Darlene A. Rauh of Los Gatos as
described in that deed recorded in Book F650 at Page 427, Official Records of Santa
Clara County, California, and said monument being also the point of intersection
of the northwesterly line of Santa Cruz Avenue with the northeasterly line of Wood
Road as said monument, Avenue and Road are shown on that certain Record of
Survey map filed in Book 609 of Maps at Page 14, Records of Santa Clara County,
California; thence northwesterly along the said northeasterly line of Wood Road
N 56°58'59 "W 10.71 feet to the TRUE POINT OF BEGINNING; thence N 56°58'59 "W
107.21 feet to the most westerly corner of that said parcel; thence southwesterly
along the southwesterly prolongation of the northwesterly line of that said parcel
S 33'01'01" W 18.62 feet to a line that is northeasterly to the monument line of said
Wood Road; thence S 58°28'32" E 61.02 feet; thence S 8733'48" E 10.45 feet to the
point of beginning of a curve; thence easterly and northeasterly from a tangent that
bears S 55 028'35" E along said curve concave northerly with a radius of 60.00 feet
through a central angle of 3756'39" and an arc length of 39.74 feet to a point of
cusp with the said southwesterly line of that said parcel and to the TRUE POINT
OF BEGINNING.
Containing 1520 square feet of land, more or less.
