RESOLUTION OF THE TOWN OF LOS GATOS APPROVING A
DECISION OF THE PLANNING COMMISSION DENYING A REQUEST
FOR APPROVAL TO CONVERT 54 APARTMENT UNITS TO
CONDOMINIUMS ON PROPERTY IN THE RM:5-12 ZONE,
CONDITIONAL USE PERMIT APPLICATION U -75 -3A AND ZONE
CHANGE APPLICATION Z -92 -5
(PROPERTY LOCATED AT 615 BLOSSOM HILL ROAD /OWNER
STEVE DILBECK)
WHEREAS:
A. Property owner and applicant, Steve Dilbeck, applied to convert 54 apartment
units into condominium dwellings for the purpose of selling each unit individually,
Conditional Use Permit Application U -75 -3A and Zone Change Application Z -92 -5;
B. The Development Review Committee reviewed the application on October
8, 1992, recommending denial of the application citing the desire to preserve rental housing
and discourage condominium conversion;
C. The Planning Commission considered the application on October 14, 1992,
and denied the application;
D. The applicant appealed the Planning Commission decision; and
E. The Town Council held a public bearing on November 16, 1992.
RESOLVED:
The Town Council finds that the Planning Commission did not err in its denial of
Conditional Use Permit Application U -75 -3A and Zone Change Application Z -92 -5. The
Town Council upholds the Planning Commission's finding that there is no compelling
reason to violate the General Plan policy which discourages conversion of rental housing
to condominiums because of the Town's commitment to protecting the limited stock of
rental housing.
Pursuant to Los Gatos Town Code Section 1.10.085, the time for seeking judicial
review for the Town Council decision is governed by California Code of Civil Procedure
Section 1094.6.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos, California, held on the 7th day of December, 1992 by the following vote.
