A RESOLUTION OF THE TOWN COUNCIL
OF THE TOWN OF LOS GATOS
AUTHORIZING THE TOWN MANAGER TO EXECUTE AN AGREEMENT
WITH LAW OFFICES OF MAYER AND REEVES TO REVIEW
THE POLICE DEPARTMENT'S CIVIL LIABILITY EXPOSURE
WHEREAS, in January 1991, the Loss Control Committee of the Association of Bay
Area Government's Pooled Liability Assurance Network (ABAG -PLAN) initiated an effort
to explore and where feasible, reduce the incidence of police liability among its 26 member
cities, and
WHEREAS, as a result of that effort, a request for proposal (RFP) was issued by
the ABAG -PLAN for a review and analysis of existing departmental policy and procedures
manuals of each of the participating agencies from the perspective of current legal
requirements, and
WHEREAS, five risk management consultants and legal firms responded to the RFP,
and
WHEREAS, following extensive interviews with all candidates, it was the consensus
of the Loss Control Committee to select the law firm of Mayer and Reeves;
NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of Los
Gatos that the Town Manager is authorized to execute the agreement attached as Exhibit
A with law offices of Mayer and Reeves to review the Police Department's civil liability
exposure.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos, California, held on the 7th day of December, 1992, by the following vote:
