RESOLUTION OF THE TOWN COUNCIL
OF THE TOWN OF LOS GATOS
AUTHORIZING THE TOWN MANAGER TO EXECUTE AN AGREEMENT
WITH SAN JOSE WATER COMPANY FOR WATER SERVICE
AND A HYDRANT AT 4 NEW YORK AVENUE
BE IT RESOLVED: by the Town Council of the Town of Los Gatos, County of
Santa Clara, State of California, that the Town of Los Gatos approve an agreement with
San Jose Water Company for water service and a fire hydrant at 4 New York Avenue and
that the Town Manager is authorized, and is hereby directed to execute the contract
attached as Exhibit A in the name and on behalf of the Town of Los Gatos.
PASSED AND ADOPTED at a regular meeting of the Town Council held on the
15th day of March, 1993, by the following vote:

NEW YORK AVENUE
As requested, we are providing final plans and an estimated
cost to install 1 - 6" hydrant next to the proposed parking stalls
off New York Avenue and 1 - 1 1/2" service on New York Avenue.
Based on the loading information for the domestic service supplied
by you, we are proposing a 1 1/2" service which means your line
size at the service connection should be at least a 1 1/211.
The total estimated cost is $8,946. Our design drawing is
enclosed for your information and the following table represents
the breakdown of costs for our proposal.
1 - 6" Hydrant $5,420
1 - 1 1/2" Service 1,362
Tax Gross -up 2.164
TOTAL $8,946
The total amount of $8,946 must be deposited at our office,
located at 1221 South Bascom Avenue, before we can process this job
further. our estimate is subject to review after 30 days.
The actual cost of the work outlined above will be determined
upon completion of the job. If the actual cost exceeds the
estimated cost (amount deposited), you will be invoiced for the
difference which must be paid within 30 days. If the actual cost
is less than the amount deposited, the difference will be refunded
to you.

As noted on the drawing, it will be your responsibility
to install an approved reduced pressure principle backf low
prevention assembly (RPP) on the domestic /irrigation
service. This assembly must be installed, above ground, as
near as possible to our service connection, that is to say,
immediately following the meter. Any deviation from this
location must be approved in advance by our Backflow
Prevention Department. We have enclosed a list of approved
models for your information.
The RPP assembly must be installed before we will allow
water use through the service. Arrangements for initiating
water service should be made with our Backflow Prevention
Department at (408) 279 -7946. Please allow 24 notice. A
field inspection will be made by this company prior to
commencement of service.
A very important item regarding our installation is the
need for an easement to accommodate the proposed hydrant.
It will be your responsibility to provide, clear and stake
the easement. Please prepare a legal description and plat,
and submit them to us for approval and preparation of the
easement document. You will also need to hire the services
of a title company to close the easement transaction. We
will need to contact them for a title report and they will
need to issue a joint protective policy of title insurance
for the easement in the amount of $10, 000 in the names of
San Jose Water Company and Bank of America, as trustee. A
conformed recorded copy of the right -of -way must be received
by us before we can schedule this job for construction. As
noted on the drawing, minor encroachments, (i.e. meter
boxes) can be handled by way of a letter from the property
owner granting such permission.
Finally, please submit one set of the APPROVED
IMPROVEMENT PLANS when available. Since our plans and
estimate are based on unapproved improvement plans, any
changes made to these items due to approval requirements may
result in the need for us to re- engineer our installation.
You will be responsible for the cost of additional
engineering, if so required, and the associated time delay.
Construction normally begins 6 -10 weeks after we have
received the aforementioned items, depending upon
availability of labor and materials and permit approvals.
