RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS
GATOS DENYING AN APPEAL OF A PLANNING COMMISSION
DECISION TO DENY A REQUEST FOR PERMISSION TO MAINTAIN
ROOF MOUNTED EQUIPMENT VENTS ON THE SKILLED NURSING
BUILDING WITHOUT ARCHITECTURAL SCREENING FROM BELOW
ON PROPERTY IN THE RM:5 -20 -PD ZONE, ARCHITECTURE AND
SITE APPLICATION S- 89 -50B
(PROPERTY LOCATED AT 800 BLOSSOM HILL ROAD /OWNER,
AMERICAN BAPTIST HOMES OF THE WEST, THE TERRACES OF
LOS GATOS)
WHEREAS:
A. The applicant /appellant has requested modification of an approved
Architecture and Site Application for the construction of a senior housing and convalescent
facility to allow additional roof mounted equipment without benefit of architectural
screening;
B. Staff reviewed the application and determined that review of roof mounted
equipment is part of the Architecture and Site Review process, and had this equipment
been shown on the original plans, screening would have been required; therefore, staff
recommended denial of the application;
C. On April 4, 1993 the Planning Commission reviewed this application and
found that the public review process for the Terraces was a long and detailed process to
ensure an architecturally pleasing building and that the applicant should have raised the
issue before constructing the equipment; therefore, the application was denied;
D. On April 20, 1993, the applicant appealed the Planning Commission's
decision; and
E. The Town Council held a public hearing on May 17, 1993.
RESOLVED:
The Town Council hereby finds that the Planning Commission did not err in its
denial of modification to Architecture and Site Application S- 89 -50B.
Pursuant to Los Gatos Town Code Section 1.10.085, the time for seeking judicial
review for the Town Council decision is governed by California Code of Civil Procedure
Section 1094.6.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos, California, held on the 7th day of June, 1993 by the following vote.
