1994-060-Adopting Amendments To The Downtown Specific PlanRESOLUTION 1994 -60 RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS ADOPTING AMENDMENTS TO THE DOWNTOWN SPECIFIC PLAN TO ESTABLISH A PRIORITY FOR CONSTRUCTION OF FUTURE PARKING FACILITIES IN THE DOWNTOWN AREA WHEREAS, the Town has completed Phase I of the construction of downtown parking facilities; and WHEREAS, the Parl<ing Commission has reviewed the priority list for the second phase of construction and has recommended a change in priority for future construction based on the changing parking needs of the downtown; and WHEREAS, the Planning Commission considered the recommendation of the Parking Commission at public bearings on September 8, 1993 and January 26, and February 23, 1994 receiving testimony from representatives of the Parking Commission; and WHEREAS, the Planning Commission concurred with the Parking Commission that Lot 13 could be decked, it did not accept the recommendation to allow decking over Lot 13 to be more than four feet above grade or to encroach into Victory Lane; and WHEREAS, the Planning Commission deleted Lot 6 from the priority list unless it can be developed in conjunction with the development of the Old Town parking lot; and WHEREAS, on March 9, 1994 the Planning Commission adopted Resolution 1994 -4 recommending amendments to the Downtown Specific Plan establishing priority for construction of future parking facilities in the Downtown; and WHEREAS, on April 18, 1994 the To<vm Council held a public hearing finding the proposed amendment internally consistent with the Downtown Specific Plan, General Plan SM06 \RESOS \DSP -93 -1. RES and Downtown Redevelopment Project Plan pursuant to the provisions of Government Code Section 65353. NOW, THEREFORE, IT IS RESOLVED, the proposed Downtown Specific Plan Amendment DSP -93 -1 will not have a significant effect on the environment and recommends a Negative Declaration pursuant to Section 15070(a) of the California Environmental Quality Act. FURTHER RESOLVED, the priority list for future parking lot construction under Phase III on page IVA of the Downtown Specific Plan reads as follows: The revenues collected in Phase 11 shall be used to pay for the constntction of the following parking facilities in order of priority: 1. Parking Lot No. 2 - Royce Street to Bachman Avenue 2. Parking Lot No. 1 - Bachman Avenue to Saratoga Ave. 3. Parking Lot No. 13 - Behind Nit. Charley's 4. Parking Lot No. S - Park Avenue 5. Parking Lot No. 11/12 - College Avemte to Villa Ave. Notwithstanding the above priority order, Lot 6 shall be considered for development at such time as the Old Town parking lot is proposed for development in order to ensure common circulation between the two. Otherwise, Lot 6 is not to be developed. SM06 \RESOSVDSP- 98 -1.RES 2 FURTHER RESOLVED, the Planning Commission recommends that section B.g.(3) on page IV -4 of Section IV of the Downtown Specific Plan be amended to delete Policy 10 that prohibits decking Lot 13.
