RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
AUTHORIZING THE TOWN ATTORNEY TO ALLOW COMPROMISE
OR SETTLE TORT CLAIMS AND REPEALING RESOLUTION NO. 1994 -9
WHEREAS, the Town of Los Gatos is a member of the Association of Bay Area
Governments (ABAG) liability pool known as ABAG Plan Corporation;
WHEREAS, ABAG Plan Corporation is the claims administrators for all claims
filed with the Town and in their capacity as claims administrators recommends the
handling of all claims to the Town Attorney;
WHEREAS, pursuant to Government Code § 935.4, the Town Council wishes to
delegate authority to the Town Attorney to deny, allow, compromise, or settle tort claims
against the Town in an amount not to exceed $5,000.
NOW THEREFORE, BE IT RESOLVED, that the Los Gatos Town Council
hereby repeals Resolution No. 1994 -9 entitled 'Resolution Authorizing the Town
Attorney and the ABAG Plan Corporation to Settle Tort Claims not Exceeding the sum
of $5,000 and repeal Resolution No. 1991 -31 ".
RESOLVED, that the Town Council of the Town of Los Gatos does hereby
delegate authority to the Town Attorney to deny, allow, compromise or settle tort claims
against the Town in an amount not to exceed $5,000.
PASSED AND ADOPTED at a regular meeting of the Town Council of the
Town of Los Gatos, California, held on the 27th day of June, 1994 by the following vote.
