RESOLUTION OF THE TOWN COUNCIL
OF THE TOWN OF LOS GATOS
AUTHORIZING THE TOWN MANAGER TO EXECUTE AGREEMENTS
FOR RECYCLING AND RESIDENTIAL YARD WASTE SERVICES
WHEREAS, pursuant to Public Resources Code 40057, the Town of Los Gatos shall
provide for source reduction, recycling, and composting activities; and
WHEREAS, the State of California has found and declared, in the enactment
of the Integrated Waste Management Act of 1989 (Public Resources Code 40050 et seq.),
that the rapidly increasing volume of solid waste resulting from population growth, industrial
expansion, and other factors requires an organized and comprehensive approach to solid
waste management; and
WHEREAS, the Town's source reduction and recycling element establishes the
need to expand recycling services and yard waste collection in order to meet State landfill
diversion requirements; and
WHEREAS, the Town's Franchise Agreement for solid waste collection
provides for the Town to retain the right to contract with another business entity to provide
recycling services for its inhabitants, and the Town of Los Gatos desires to implement
Recycling and Residential Yard Waste Services Programs; and
WHEREAS, a mitigated Negative Declaration was prepared for this project
and approved by Resolution 1992 -90, and said Negative Declaration became final on
October 5, 1992;

NOW, THEREFORE, THE TOWN COUNCIL OF THE TOWN OF LOS
GATOS DOES HEREBY RESOLVE AS FOLLOWS: that the Town Manager be authorized
to execute those agreements entitled Agreement Between the Town of Los Gatos and
Green Valley Disposal Company. Inc.,. for Recycling Services and Residential Yard Waste
Services, on file in the Office of the Town Clerk, and incorporated herein by reference, for
the purpose of securing the aforementioned Recycling and Residential Yard Waste Services.
PASSED AND ADOPTED at a regular meeting of the Town Council of the
Town of Los Gatos, California, held on the 1st day of August, 1994, by the following vote:
