RESOLUTION OF THE TOWN OF LOS GATOS
TO AUTHORIZE STAFF TO NEGOTIATE PURCHASE AGREEMENT
FOR AN ASPHALT PAVER
WHEREAS, paving operations take place during the months of May through
September, and
WHEREAS, purchase of new equipment for five months of work is not cost
effective, and
WHEREAS, quotations received on new equipment exceeded budgeted amount, and
WHEREAS, Layton Manufacturing provided a factory demonstrator model # PT505
tow type paver for staff evaluation, and
WHEREAS, Great West Equipment Company and Peterson Tractor proposed self
propelled equipment too large for Town operations, and
WHEREAS, the type of equipment sought and configuration vary between
manufacturers and comparisons for competitive bidding do not work, and
WHEREAS, cost savings on a demonstrator unit vary from $3,000.00 to $5,000.00
based on model and options, and
WHEREAS, the most cost effective solution to meet operational needs would be to
negotiate purchase with Layton Manufacturing, and
WHEREAS, demonstrator equipment is fully warranted for one year from date of
purchase, and
WHEREAS, Section 2.50.130 (3) of the Town Code provides that if the Town
Council finds that because of the uniqueness or special characteristics of the equipment, it
would be more advantageous to the Town to purchase equipment after an informal
investigation of the source of supply for ascertaining the most cost effective price, the
Council may waive the competitive bidding process.
THEREFORE, BE IT RESOLVED, by the Town Council of the Town of Los Gatos
to authorize Staff to negotiate a purchase agreement with Layton Manufacturing.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of
Los Gatos, California, held on the 7th day of November, 1994 by the following vote.
