1995-117-Execute A Cost Allocation Agreement With The Four Other West Valley Cities For Animal Control Services Pursuant To The April 1, 1994 Agreement To Provide Animal-Related Services To The West Valley CitiesRESOLUTION 1995 -117 RESOLUTION AUTHORIZING TOWN MANAGER TO EXECUTE A COST ALLOCATION AGREEMENT WITH THE FOUR OTHER WEST VALLEY CITIES FOR ANIMAL CONTROL SERVICES PURSUANT TO THE APRIL 1, 1994 AGREEMENT TO PROVIDE ANIMAL - RELATED SERVICES TO THE WEST VALLEY CITIES WHEREAS, in April 1994, the five West Valley Cities entered into an agreement to provide animal- related services for its citizens, and WHEREAS, this joint effort has successfully delivered a level of service and cooperation that benefits each of the communities, and WHEREAS, the April 1994 Agreement provides that following the first year of experience, the five West Valley Cities are to reach agreement on allocating the costs of the joint animal- related services program on the basis of total services utilized in each municipality, and WHEREAS, the five West Valley Cities have analyzed the experience of usage during the past year, and the Animal Services Committee has recommended a cost sharing system for the coming year, and WHEREAS, the Town Manager should be given authority to execute the cost allocation agreement for subsequent years under the April 1994 Agreement, NOW, THEREFORE, BE IT RESOLVED, as follows: 1. The Town Manager is authorized and directed to execute the Agreement to Allocate Costs attached hereto as Exhibit A for Fiscal Year 1995 -1996 under the April 1994 Animal Services Agreement. 2. The Town Manager is further authorized and directed to review the recommendations of the Animal Services Committee and execute annual cost allocation agreements on behalf of the Town during the term of the Animal Services Agreement as the Manager determines is appropriate pursuant to the terms of that Agreement. FOR FISCAL YEAR 1995 -1996 FOR BID• ANIMAL SERVICESTO THE FIVE WEST VALLEY CITIES THIS AGREEMENT is made and entered into this _ day of 1995, by and between the CITY OF CAMPBELL, a municipal corporation, the CITY OF CUPERTINO, a municipal corporation, the TOWN OF LOS GATOS, a municipal corporation, the CITY OF MONTE SERENO, a municipal corporation, and the CITY OF SARATOGA, a municipal corporation (hereinafter collectively referred to as "West Valley Cities "). RECITALS WHEREAS, on April 1, 1994, the West Valley Cities entered into an Agreement to provide Animal Services to their citizens through a coordinated planning and contracting process, and WHEREAS, the April 1, 1994, Agreement provided in the Recitals and Paragraph 8(a) that following the first year of experience, the West Valley Cities would meet and agree to allocate the costs of providing the services on the basis of percentage of total services actually utilized each year, and WHEREAS, the Animal Services Committee has analyzed the information on utilization during the first year of experience and recommended the percentage allocation of actual services used contained in Attachment 1 to this Agreement. NOW, THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS: 1. For fiscal year 1995 -1996, the costs of providing animal - related services pursuant to the April 1, 1994, Agreement between the West Valley Cities shall be allocated pursuant to Attachment 1 to this Agreement. 2. Prior to April 1, 1996, the West Valley Cities shall meet and analyze the cost experience of providing animal services and attempt to reach agreement on the cost allocation for fiscal year 1996 -1997.
