RESOLUTION OF THE TOWN COUNCIL
OF THE TOWN OF LOS GATOS
INITIATING PROCEEDINGS FOR THE FORMATION OF
KENNEDY MEADOWS BENEFIT ZONE
TO LANDSCAPE AND LIGHTING DISTRICT NO. 1,
DESIGNATING THE ENGINEER OF WORK AND
DIRECTING THE FILING OF AN ANNUAL REPORT
WHEREAS, the Town Council intends to levy and collect assessments within the
Kennedy Meadows Benefit Zone of Landscaping and Lighting Assessment District No. 1
during the fiscal year 1996 -1997, an area of land located in the Town of Los Gatos, County of
Santa Clara; and
WHEREAS, property owners within Tract No. 8612 have signed a petition consenting to
the formation of the Kennedy Meadows Benefit Zone of Landscaping and Lighting Assessment
District No. 1, as shown on Exhibit A, and
WHEREAS, the new Benefit Zone will only be assessed for the maintenance, repair and
upkeep of the open space area as shown on Exhibit A, and any enlargement in the area of this
benefit zone should only occur after a resolution of intention has been adopted by the Council, a
public hearing held, the increase subjected to majority protest of the property owners, and a
determination by Council then made pursuant to the procedures of the Landscaping and Lighting
Act of 1972,
NOW, THEREFORE, IT IS RESOLVED AS FOLLOWS:
A. Proceedings to form the Kennedy Meadows Benefit Zone, as described in Exhibit
A hereto of the Town Landscaping and Lighting District No. 1 are hereby initiated.
B. The Planning Director is ordered to prepare and file a report in accordance with
Article 4 of Chapter 1 of the Landscaping and Lighting Act of 1972 (Commencing with Streets
and Highways Code § 22565).
PASSED AND ADOPTED at a regular meeting of the Town Council held on the 1st day
of April, 1996 by the following vote:
