RESOLUTION OF THE TOWN COUNCIL
OF THE TOWN OF LOS GATOS
REJECTING BID RECEIVED ON PROJECT 9616
STREET RESURFACING CAPE SEAL PROGRAM
AND AUTHORIZING READVERTISEMENT OF PROJECT FOR BID
WHEREAS:
1. On September 3, 1996, the Town Council approved the plans and specifications for
Project 9616 - Street Resurfacing Program Cape Seal, and authorized the project to go out for bid.
2. The project was duly advertised, and on September 16, 1996, at the date and time
advertised, bids for the project were opened.
3. Only one complete bid was received and that was from Graham Contractors, Inc. for
$103,080.
4. The amount of bid exceeded the Engineer's Estimate for this project. The Town cannot
afford to pay this price.
5. Pursuant to Public Contract Code 20166, it is in the best interest of the Town to reject
the bid received, to redo the plans and specifications, and to consider alternatives.
6. It is further in the best interests of the Town to permit Graham Contractors, Inc. to be
able to participate in the project in the future.
RESOLVED:
A. The bid from Graham Contractors, Inc. submitted on September 16, 1996, for Project
9616 is rejected, which was the only bid received.
B. Graham Contractors, Inc. shall be permitted to submit a bid on the project without
prejudice.
C. This decision constitutes a final administrative decision pursuant to Code of Civil
Procedure Section 1094.6 as adopted by Section 1.10.085 of the Town Code of the Town of Los
Gatos. Any application for judicial relief from this decision must be sought within the time limits
and pursuant to the procedures established by Code of Civil Procedure Section 1094.6, or such
shorter time as required by state or federal law.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of Los
Gatos, California, held on the 16th day of September, 1996, by the following vote.
