RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
AUTHORIZING AND DIRECTING THE TOWN MANAGER TO EXECUTE
DOCUMENTS NECESSARY FOR THE TOWN TO RECEIVE FUNDS AS A RESULT OF
THE STIPULATED FINAL JUDGEMENT IN CASE NO. CV753054 (PEOPLE VS.
BRENMOR CABLE PARTNERS, L.P.); AND AGREEING TO THE PERCENTAGE
DISTRIBUTION FORMULA ESTABLISHED BY THE SANTA CLARA COUNTY
DISTRICT ATTORNEY'S OFFICE; AND FURTHER AGREEING TO USE ALL SUCH
RECEIPTS FOR ENHANCING PUBLIC, EDUCATIONAL, AND GOVERNMENT
CABLE - RELATED ACCESS AND USE.
WHEREAS, the District Attorney for the County of Santa Clara has reached agreement with
South Bay CableVision regarding alleged overcharges for late fees for cable television service in
Santa Clara County, including the Town of Los Gatos, and
WHEREAS, the terms of the settlement agreement provide that if there are any funds
remaining in the settlement trust fund, the funds are to be distributed to consumer protection funding
and cable television franchise authorities that agree to use their share of the money to enhance
public, educational, and government access and use of cable - related services, and
WHEREAS, the Town of Los Gatos is willing to accept the stipulated percentage of any
remaining balance and to devote these funds to certain cable - related services,
NOW, THEREFORE, IT IS HEREBY ORDERED:
1. The Town of Los Gatos agrees to the 12% share of the trust fund stipulated in Paragraph
6.G.2.b.4 of the Stipulated Final Judgment of the Santa Clara Superior Court in Case No. CV753054
(People vs. Brenmor Cable Partners, L.P.).
2. The Town of Los Gatos further agrees that it shall use any such distribution solely to
enhance public, educational, and governmental (including institutional network) access to and use
of cable - related services by funding equipment, facilities, maintenance, programming, staffing,
and /or training, for the benefit of consumers and cable subscribers in the Town of Los Gatos.
3. The Town Manager is directed and authorized to execute any documents that may be
necessary for receipt of the funds from the trust fund.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of Los
Gatos, California, held on the 16th day of September, 1996 by the following vote:
