1997-020-Prepare And File An Annual Report In Accordance With Streets And Highways Code And Following Regarding Landscaping And Lighting District Assessment No. 1RESOLUTION 1997 -20 RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS ORDERING THE DISTRICT ENGINEER TO PREPARE AND FILE AN ANNUAL REPORT IN ACCORDANCE WITH STREETS & HIGHWAYS CODE §§ 22565 AND FOLLOWING REGARDING LANDSCAPING & LIGHTING DISTRICT ASSESSMENT NO. I- BLACKWELL DRIVE BENEFIT ZONE KENNEDY MEADOWS BENEFIT ZONE. SANTA ROSA HEIGHTS BENEFIT ZONE VASONA HEIGHTS BENEFIT ZONE AND HILLBROOK BENEFIT ZONE; AND LANDSCAPING & LIGHTING DISTRICT ASSESSMENT NO. 2 -- GEMINI COURT BENEFIT ZONE OF THE TOWN OF LOS GATOS WHEREAS, Landscaping & Lighting Assessment District No. 1 -- Blackwell Drive Benefit Zone, Kennedy Meadows Benefit Zone, Santa Rosa Heights Benefit Zone, Vasona Heights Benefit Zone, and Hillbrook Benefit Zone; and Landscaping & Lighting Assessment District No. 2 -- Gemini Court Benefit Zone, as created by action of the Town Council pursuant to the Streets & Highways Code; and WHEREAS, the Town Council intends to consider levying and collecting assessments within Landscaping & Lighting Assessment District No. 1 -- Blackwell Drive Benefit Zone, Kennedy Meadows Benefit Zone, Santa Rosa Heights Benefit Zone, Vasona Heights Benefit Zone and Hillbrook Benefit Zone; and Landscaping and Lighting Assessment District No. 2 -- Gemini Court Benefit Zone, as generally shown in Exhibits A, B, C, D, E and F hereto, for Fiscal Year 1997 -1998; and WHEREAS, during the coming fiscal year, the Town intends to undertake the following work and make the following improvements with regard to the improvements in Landscaping & Lighting Assessment District No. 1-- Blackwell Drive Benefit Zone: Install low maintenance landscaping and maintain existing street lighting. WHEREAS, during the coming fiscal year, the Town intends to undertake the following work and make the following improvements with regard to the improvements in Landscaping & Lighting Assessment District No. 1 -- Kennedy Meadows Benefit Zone: N93HARENLNG3399.21 Maintain existing landscaping, perform the mitigation monitoring required by the EIR, and maintain street lighting. WHEREAS, during the coming fiscal year, the Town intends to undertake the following work and make the following improvements with regard to the improvements in Landscaping & Lighting Assessment District No. 1- -Santa Rosa Heights Benefit Zone: Maintain existing landscaping and trail, and maintain street lighting. WHEREAS, during the coming fiscal year, the Town intends to undertake the following work and make the following improvements with regard to the improvements in Landscaping & Lighting Assessment District No. 1-- Vasona Heights Benefit Zone: Maintain existing landscaping and trail, and maintain street lighting. WHEREAS, during the past year, the improvements within Landscaping & Lighting Assessment District No. 1-- Hillbrook Benefit Zone have been maintained in the following way: Install low maintenance landscaping and maintain existing street lights. WHEREAS, during the coming fiscal year, the Town intends to undertake the following work and make the following improvements with regard to the improvements in Landscaping & Lighting Assessment District No. 2 -- Gemini Court Benefit Zone: Install low maintenance landscaping, and maintain street lighting. WHEREAS, the District Engineer should prepare a report describing the current state of the improvements and the proposed changes or work, and calculate the assessments that would be necessary to support this effort, NOW, THEREFORE, IT IS RESOLVED AS FOLLOWS: The area shown in Exhibit A is hereby designated as the Blackwell Drive Benefit Zone of Landscaping and Lighting Assessment District No. 1. 2. The area shown in Exhibit B is hereby designated as the Kennedy Meadows Benefit Zone of Landscaping and Lighting Assessment District No. 1. The area shown in Exhibit C is hereby designated as the Santa Rosa Heights Benefit Zone of Landscaping and Lighting Assessment District No. 1. N \SH UTLNG3397 .21 2 4. The area shown in Exhibit D is hereby designated as the Vasona Heights Benefit Zone of Landscaping and Lighting Assessment District No. 1. The area shown in Exhibit E is hereby designated as the Hillbrook Benefit Zone of Landscaping and Lighting Assessment District No. 1. 6. The area shown in Exhibit F is hereby designated as the Gemini Court Benefit Zone of Landscaping and Lighting Assessment District No. 2. 7. The District Engineer, Director of Parks, Forestry & Maintenance, is ordered to prepare and file an annual report in accordance with Streets & Highways Code §§ 22565 and following regarding Landscaping & Lighting Assessment District No. 1 -- Blackwell Drive Benefit Zone. 8. The District Engineer, Director of Parks, Forestry & Maintenance, is ordered to prepare and file an annual report in accordance with Streets & Highways Code §§ 22565 and following regarding Landscaping & Lighting Assessment District No. 1-- Kennedy Meadows Benefit Zone. 9. The District Engineer, Director of Parks, Forestry & Maintenance, is ordered to prepare and file an annual report in accordance with Streets & Highways Code §§ 22565 and following regarding Landscaping & Lighting Assessment District No. 1 - -Santa Rosa Heights Benefit Zone. 10. The District Engineer, Director of Parks, Forestry & Maintenance, is ordered to prepare and file an annual report in accordance with Streets & Highways Code §§ 22565 and following regarding Landscaping & Lighting Assessment District No. I-- Vasona Heights Benefit Zone. 11. The District Engineer, Director of Parks, Forestry & Maintenance, is ordered to prepare and file an annual report in accordance with Streets & Highways Code §§ 22565 and following regarding Landscaping & Lighting Assessment District No. 1 -- Hillbrook Benefit Zone. 12. The District Engineer, Director of Parks, Forestry & Maintenance, is ordered to prepare and file an annual report in accordance with Streets & Highways Code §§ 22565 and following regarding Landscaping & Lighting Assessment District No. 2 -- Gemini Court Benefit Zone. 13. Upon the filing of these reports, the Town Manager shall set the matter on the Council agenda for consideration of a resolution of intention regarding the levying and collection of assessments in Landscaping & Lighting Assessment District No. 1 -- Blackwell Drive Benefit Zone, Kennedy Meadows Benefit Zone, Santa Rosa Heights Benefit Zone, Vasona Heights Benefit Zone and Hillbrook Benefit Zone; and Landscaping & Lighting Assessment District No. 2 -- Gemini Court Benefit Zone in Fiscal Year 1997 -1998.
