AUTHORIZING AN AMENDMENT
TO CORRECT AN ERROR IN THE CONTRACT
BETWEEN THE
BOARD OF ADMINISTRATION
OF THE
PUBLIC EMPLOYEES' RETIREMENT SYSTEM
AND THE
TOWN COUNCIL
OF THE
TOWN OF LOS GATOS
WHEREAS, the Town Council of the Town of Los Gatos hereinafter referred to as Public
Agency, and the Board of Administration of the Public Employees' Retirement
System entered into a contract effective March 1, 1972 providing for the
participation of Public Agency in the Public Employees' Retirement System; and .
WHEREAS, said contract was amended effective July 1, 1976. Due to an inadvertent error, the
class of "firemen" was added to the Amendment to Contract and included in
subsequent contracts effective October 1, 1976, January 4, 1990 and December 16,
1992; and
WHEREAS, Section 20472 of the Government Code provides that errors in a contract may be
corrected through contract error amendments executed by the adoption of suitable
resolutions by the contracting parties;
NOW, THEREFORE, BE IT RESOLVED that said governing body of Public Agency
authorizes, and it does hereby authorize, a contract error amendment to said
contracts effective July 1, 1976, October 1, 1976, January 4, 1990 and December
16, 1992, as follows:
A. Paragraph 3 of said contracts shall be changed as follows:
a. Local Police Officers (herein referred to as local safety members;
b. Employees other than local safety members (herein referred to as local
miscellaneous members).
BE IT FURTHER RESOLVED, that the presiding officer of the governing body of Public
Agency is hereby authorized, empowered, and directed to execute said amendment
for and on behalf of Public Agency.
