RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
ADOPTING THE FIRST AMENDMENT TO THE COUNTY OF SANTA CLARA
COUNTY WIDE NONDISPOSAL FACILITY ELEMENT
AS THE TOWN OF LOS GATOS' NONDISPOSAL FACILITY ELEMENT
PURSUANT TO PUBLIC RECORDS CODE SECTION 41730 ET SEQ
WHEREAS, California Public Resources Code Section 41730 et seq. requires the
Town of Los Gatos (Town) to prepare, adopt and transmit to the County of Santa Clara (County)
a Nondisposal Facility Element that identifies all existing, expansion of existing, and proposed
nondisposal facilities which will be needed to implement the Town's source reduction and
recycling element; and
WHEREAS, the County of Santa Clara First Amendment to the Countywide
Nondisposal Facility Element (NDFE) has been prepared by County staff in accordance with
requirements of Public Resources Code Section 41730 et seq., and said NDFE identifies all
existing, expansion of existing, and proposed nondisposal facilities necessary to implement the
Source Reduction and Recycling Element of the Town; and
WHEREAS, pursuant to Public Resources Code Section 41734 the NDFE has been
reviewed by the Solid Waste Commission of Santa Clara County, acting as the Local Task Force;
and
WHEREAS, pursuant to Public Resources Code Section 41734, the adoption of the
NDFE is not subject to the environmental review requirements of the California Environmental
Quality Act; and
WHEREAS, pursuant to section 18766 of Title 14, Chapter 9, Article 7.0, of the
California Code of Regulations, the Town has conducted a public hearing on the final draft of the
NDFE, and after testimony was presented, and upon review of all evidence in record;
NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of
Los Gatos that the attached County of Santa Clara First Amendment to the Countywide
Nondisposal Facility Element (exhibit 1) is hereby approved and adopted.
BE IT FURTHER RESOLVED that the Town Council of the Town of Los Gatos
hereby authorizes the County of Santa Clara to submit a copy of this resolution and the NDFE to
the California Integrated Waste Management Board of the Town's behalf.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos, California, held on the 2 day of June, 1997 by the following vote:
