RESOLUTION DENYING AN APPEAL OF THE DECISION OF THE PLANNING
COMMISSION DENYING A REQUEST FOR ARCHITECTURE AND SITE
APPROVAL AND A CONDITIONAL USE PERMIT FOR A COMPRESSED NATURAL
GAS FUELING FACILITY ON PROPERTY IN THE OFFICE ZONE.
PROJECT APPLICATION: PFJ -97 -044.
NEGATIVE DECLARATION: ND -97 -3.
PROPERTY LOCATION: 14800 WINCHESTER BOULEVARD.
PROPERTY OWNER: TOWN OF LOS GATOS.
APPELLANT: SCOTT BAKER, DIRECTOR OF BUILDING AND ENGINEERING SERVICES
WHEREAS:
A. This matter came before the Council for public hearing on June 16, 1997, on an appeal
by Scott Baker (Director of Building and Engineering Services) from a decision of the Planning
Commission and was regularly noticed in conformance with State and Town law.
B. The Council received testimony and documentary evidence from the property owners
and all interested persons who wished to testify or submit documents. The Council considered all
testimony and materials submitted, including the record of the Planning Commission proceedings and
the packet and documents attached to the Council Agenda Report and Desk Items dated June 12th,
June 13th and June 16, 1997.
C. The applicant is requesting approval to operate a compressed natural gas fueling
facility on property in an area designated for office facilities under the existing Zoning Ordinance.
The property located at 14800 Winchester Boulevard is a vacant lot.
D. The Planning Commission decision was correct.
RESOLVED:
The appeal of the decision of the Planning Commission on Project Application PRJ -97 -044
is therefore denied.
This decision constitutes a final administrative decision pursuant to Code of Civil Procedure
section 1094.6 as adopted by section 1. 10.085 of the Town Code of the Town of Los Gatos. Any
application for judicial relief from this decision must be sought within the time limits and pursuant to
the procedures established by Code of Civil Procedure section 1094.6, or such shorter time as
required by State or Federal law.

Gatos, California held on the 7th day of July, 1997, by the following vote:
