RESOLUTION DENYING APPEAL OF A DECISION OF THE PLANNING COMMISSION
REVOKING CONDITIONAL USE PERMIT U -93 -14 FOR O'SHEA'S PUB AND GRILL
PROPERTY LOCATION: 258 UNION AVENUE.
PROPERTY OWNER: ANDREW J. AND HARRIET M. UNZEN, TRUSTEE.
APPELLANT: STAN SCHWARTZ /O'SHEA'S PUB AND GRILL
WHEREAS:
A. This matter came before the Council for public hearing on September 15, 1997, on
an appeal by Stan Schwartz, O'Shea's Pub and Grill from a decision of the Planning Commission and
was regularly notice in conformance with State and Town law.
B. Appellant did not appear or have a representative present at the hearing. There was
no testimony or other evidence presented in support of the appeal. The Council considered materials
submitted, including the record of the Planning Commission proceedings and the packet and
documents attached to the Council Agenda Report dated September 4, 1997.
C. The Planning Commission held one public hearing over two separate dates. The
appellant did not attend or send a represetative on the second date. The Planning Commission
determined that the establishment operated in violation of the Conditional Use Permit, which the
ommission then revoked.
D. The applicant is appealing the Planning Commission's decision to revoke the
Conditional Use Permit.
E. The Planning Commission decision was correct.
RESOLVED:
The appeal of the decision of the Planning Commission is denied.
This decision constitutes a final administrative decision pursuant to Code of Civil
Procedure Section 1094.6 as adopted by section 1. 10.085 of the Town Code of the Town of Los
Gatos. Any application for judicial relief from this decision must be sought within the time limits and
pursuant to the procedures established by Code of Civil Procedure section 1094.6, or such shorter
time as required by State or Federal law.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of Los
Gatos, California held on the 6th day of October, 1997, by the following vote:
