IMPROVEMENT PROJECT
AUTHORIZE THE TOWN MANAGER TO EXECUTE A CERTIFICATE OF
ACCEPTANCE AND NOTICE OF COMPLETION ACCEPTING THE WORK
OF CB CONCRETE CONSTRUCTION, INC. AND AUTHORIZE
RECORDING BY THE CLERK ADMINISTRATOR.
RECOMMENDATION:
Authorize the Town Manager to execute a Certificate of Acceptance and Notice of Completion
(Attachment 1) accepting the work of CB Concrete Construction, Inc. and authorize recording by
the Clerk Administrator.
BACKGROUND:
The Town's adopted five year Capital Improvement Program (CIP) Budget designates funding
for curb, gutter, and sidewalk replacement and public access infrastructure improvement
projects. This project entailed repairing and replacing damaged curb, gutter, and sidewalk and
improving public safety throughout the Town, including tree root pruning when necessary to
mitigate future damage. A portion of the project funding came from the Community
Development Block Grant (CDBG) program for installation of accessibility ramps.
DISCUSSION:
On March 17, 2015, the Town Council awarded the contract for the Annual Curb, Gutter and
Sidewalk Maintenance and Public Access Infrastructure Improvement Project in an amount not
to exceed $359,969, plus a $33,000 contingency for future change orders. After bids were
received, the Town entered into an agreement with CB Concrete Construction, Inc. in the amount
of $296,920.

DISCUSSION (cont'd):
Five percent of the faithful performance bond will remain in effect for a period of two years as
guarantee for any needed repair or replacement caused by defective materials and workmanship.
The execution and recordation of the Certificate of Acceptance is now required to finalize the
Town's acceptance of the project.
CONCLUSION:
Staff recommends that the Town Council authorize the Town Manager to execute a Certificate of
Acceptance and Notice of Completion accepting the work of CB Concrete Construction, Inc. and
authorize recording by the Clerk Administrator.
ENVIRONMENTAL ASSESSMENT:
This is a project as defined under CEQA but is Categorically Exempt (Section 15301c). A
Notice of Exemption will not be filed.
FISCAL IMPACT:
The final project cost was $306,343, of which $296,920 was direct construction costs, all within
the Council approved budget of $359,969, as demonstrated in the fiscal table below. The
remaining unexpended funds will carry forward to the next Curb, Gutter, and Sidewalk
Maintenance and Public Access Infrastructure Projects.
