CS -1 CONFERENCE WITH REAL PROPERTY NEGOTIATOR (Government Code Section 54956.8): Instructing Town's real property negotiator regarding the price and terms of payment for the sale, exchange, or lease of real property as to 5 parcels. ROLL CALL Present: Mayor Marcia Jensen, Vice Mayor Barbara Spector, Council Member Steve Leonardis, Council Member Rob Rennie, Council Member Marico Sayoc. Absent: None PLEDGE OF ALLEGIANCE Viki Toram led the Pledge of Allegiance. The audience was invited to participate. PRESENTATIONS Mayor Jensen presented the Small Business, Big Applause commendation to Dan and Katie Melin, owners of Affordable Treasures. CLOSED SESSION REPORT Robert Schultz, Town Attorney, stated Council met in Closed Session as duly noted on the agenda and there is no report. 2 Town Council /Parking Authority October 20, 2015 COUNCIL/TOWN MANAGER REPORTS Council Matters - Council Member Rob Rennie stated he attended the Cities Association meeting where he was appointed as an alternate to the Santa Clara County Emergency Operation Area Council. - Vice Mayor Barbara Spector stated she attended the Conceptual Development Advisory Committee (CDAC) meeting. - Mayor Marcia Jensen stated she attended the CDAC meeting. Prior to the Council meeting, interviews were conducted and appointments were made to the Ad Hoc Citizen Committee. Council also authorized re- advertising of the vacant position for another two weeks. Appointed to the Committee are Lee Fagot and Mark Robinson. - Council Member Steve Leonardis stated he chaired the West Valley Sanitation (WVSD) Board of Director meeting. - Council Member Marico Sayoc stated she attended the Planned Development Study Committee meeting along with the Mayor. Manager Matters - Ms. Prevetti stated the Town is hosting an Open House at Town Hall, Saturday October 24, from 11:00 a.m. to 2:00 p.m. Tours will be available as well as opportunity to meet with Council and staff; applications for the Town's Poet Laureate are being accepted and are due November 22; and the Town is recruiting for all other boards and commissions and applications are due December 4. CONSENT ITEMS (TO BE ACTED UPON BY A SINGLE MOTION) 1. Approve Council minutes of October 6, 2015. 2. Authorize the Town Manager to purchase two replacement police patrol vehicles from Folsom Lake Ford in an amount not to exceed $70,009. 3. Authorize the Town Manager to execute agreements with Deborah Ellis and Walter Levison to provide services as consulting arborist to the Town. 4. Authorize the Town Manager to execute an agreement with Hello Housing for administration of the Town's Below Market Price Affordable Housing Program (BMP). MOTION: Motion by Council Member Steve Leonardis to approve Consent Items 1 through 4. Seconded by Council Member Rob Rennie. VOTE: Motion passed unanimously. VERBAL COMMUNICATIONS Wendi Baker - Invited all to participate in the Silicon Valley Turkey Trot on Thanksgiving Day and provided flyers with information and the website to register. 3 Town Council /Parking Authority October 20, 2015 Verbal Communications — continued John Shepardson - Commented on police department budgets for Saratoga and Los Gatos. PUBLIC HEARINGS 5. Adopt an Ordinance of the Town Council of the Town of Los Gatos adding division 3B to Section 29.20 to the Los Gatos Town Code to provide an expedited, streamlined, permitting process for small residential rooftop solar systems as required by Assembly Bill 2188 (Chapter 521, Statues 2014). ORDINANCE 2245 Rob Schultz, Town Attorney, presented the staff report. Opened and closed Public Comment at 7:26 p.m. Council discussed the matter. MOTION: Motion by Council Member Marico Sayoc to approve the introduction and first reading of the ordinance by title only; direct staff to advise the Planning Commission that their first recommendation was included in the ordinance and the second was not and the reasons for such; and staff to draft an administrative policy regarding historic structures to be brought to the Policy Committee for further review. Seconded by Vice Mayor Barbara Spector. VOTE: Motion passed unanimously. The Clerk Administrator read the title of the ordinance. OTHER BUSINESS 6. Accept the Los Gatos Library Strategic Plan for 2015 -2020. Heidi Murphy, Library Director, presented the staff report. Opened and closed Public Comment at 7:31 p.m. Council discussed the matter. MOTION: Motion by Mayor Marcia Jensen to accept the Library Strategic Plan. Seconded by Council Member Marico Sayoc. VOTE: Motion passed unanimously. Town Council /Parking Authority October 20, 2015 Accept the Report on the Parks, Transportation and Parking, and Bicycle and Pedestrian Advisory Commission Priorities. Matt Morley, Director of Parks and Public Works; Eric Fox, Parks Commission Vice Chair; Maria Ristow, Transportation and Parking Commission (T &P) member; and Crystal Huang, Bicycle and Pedestrian Advisory Commission (BPAC) Vice Chair, presented the staff report. Opened and closed Public Comment at 7:55 p.m. Council discussed the matter. MOTION: Motion by Vice Mayor Barbara Spector to accept the report on the Parks, Transportation & Parking, and Bicycle and Pedestrian Advisory Commission priorities. Seconded by Council Member Rob Rennie. VOTE: Motion passed unanimously. 8. Within the existing adopted fiscal year (FY) 2015/16 operating budget approve the Arts and Culture Commission (ACC) recommendation to: a. Reallocate $1,600 from the Forbes Mill Footbridge Project and $2,000 from the Arts Commission project to the Catwalk Phase II Public Art Project, for a total project budget not to exceed $8,000; b. Approve the recommendation from the Arts and Culture Commission to issue a Request for Proposal (RFP) for the Catwalk Phase 11 Public Art Project. Christina Gilmore, Assistant to the Town Manager, presented the staff report. Opened and closed Public Comment at 8:10 p.m. Council discussed the matter. MOTION: Motion by Council Member Marico Sayoc to continue the item until all quotes are received for the reproduction and installation of the artwork for the Forbes Mill Footbridge to determine if there are enough funds to go forward with the Catwalk project. Seconded by Vice Mayor Barbara Spector. VOTE: Motion passed unanimously. Town Council /Parking Authority October 20, 2015 9. PPW Job No. 13 -31 — Almond Grove Street Rehabilitation Project Staff recommends that the Town Council proceed with the Almond Grove Project by: a. Complying with ADA with respect to sidewalks; b. Phasing the project with Broadway and Bachman first; c. Approving Plans and specifications and bidding Broadway and Bachman for asphalt and concrete reconstruction with the curb line in the existing location and no additional allocation of design fees; d. Issuing a request for proposals for designing the remaining eight project streets. (Continued from 9115115) Mayor Jensen announced the issue of the backstop at Blossom Hill Park would be bifurcated from the Almond Grove Street Rehabilitation Project for public testimony and consideration. Opened Public Comment for the backstop at 8:21 p.m. Phil Knopf - Thanked the Parks Commission, Parks & Public Works staff, and the members of the community for their support to have the funding approved for the backstop. Closed Public Comment for the backstop at 8:25 p.m. Council discussed the matter. MOTION: Original Motion by Council Member Steve Leonardis to move $25,000 from the $325,000 Bachman Park fund to Blossom Hill Park for repair of the back stop and tennis court. MOTION AMENDED: to specifically approve releasing the $25,000 on page D20 of the Capital Improvement Projects (CIP) Budget for repair of the back stop and direct staff to investigate the cost and funding to repair the tennis court at Blossom Hill Park. Seconded by Council Member Marico Sayoc. VOTE: Motion passed unanimously. Lisa Petersen, Town Engineer, presented the staff report. Opened Public Comment at 8:38 p.m. Tom Boyce - Commented on the costs for the project. 6 Town Council /Parking Authority October 20, 2015 Other Business Item #9 — continued Robert Cowan - Commented on the bid process, considering the long term life cycle of material when choosing asphalt or concrete, and the curb extensions for trees and safety. Angelia Doerner - Commented on the ADA requirements for the project, the timing of the streets, and the necessity for inclusion of sidewalk repairs. Lynn Brandhourst - Commented the residents on Broadway have no objection to reducing the streets by six inches on each side and are in support of bidding the project as it is currently designed. Closed Public Comment at 8:51 p.m. Council discussed the matter. MOTION: Motion by Council Member Rob Rennie to accept staff's recommendations to phase the project including: 1) doing an Request for Proposal (RFP) for the remaining eight streets; 2) conduct the ADA improvements where needed and save the existing sidewalks as best we can. MOTION AMENDED TO ADD: 3) ensure the trees are handled per the existing Tree Ordinance and ensure that no more trees are removed and possibly retain more trees; 4) keep Broadway and Bachman with their existing curb line as currently exists in the field and bid both for asphalt and concrete; 5) include a five year replacement policy so if there are any cuts they are amended; and 6) when bids return that staff will include life cycle costs for both asphalt and concrete so Council has the full information. MOTION AMENDED TO ADD: that Council set aside a reserve of $12.2 million and retain $2.1 million of Capital Projects identified as being "on hold" for further discussion, as identified in Attachment 7 of the staff report. Seconded by Council Member Marico Sayoc. VOTE: Motion passed 3/2. Mayor Marcia Jensen and Council Member Steve Leonardis voting no.
