M08-18-2015 Town Council Meeting 09/01/15 Item #1 MINUTES OF THE TOWN COUNCIL/PARKING AUTHORITY MEETING AUGUST 18, 2015 The Town Council of the Town of Los Gatos conducted a Special Meeting on Tuesday, August 18, 2015, to hold a Closed Session at 5:00 p.m., a Study Session at 6:00 p.m., and a Regular Meeting at 7:00 p.m. CLOSED SESSION – 5:00 P.M. CS-1 PUBLIC EMPLOYEE APPOINTMENT [Government Code Section 54957(b)(1)] Title: Town Manager CS-2 CONFERENCE WITH LABOR NEGOTIATOR (Government Code Section 54957.6) Town Negotiator: Rumi Portillo, Human Resources Director Unrepresented Employee: Town Manager STUDY SESSION – 6:00 P.M. ROLL CALL Present: Mayor Marcia Jensen, Vice Mayor Barbara Spector, Council Member Steve Leonardis, Council Member Rob Rennie, Council Member Marico Sayoc. Absent: None. VERBAL COMMUNICATIONS There were no verbal communications. FY 2015-2016 Department Work Plans Review and discuss the departmental work plans a. Offer suggestions for improving how this information is reported b. Les White, Interim Town Manager, presented the staff report. Council discussed the matter. STUDY SESSION ADJOURNED Study session adjourned at 6:54 p.m. BUSINESS MEETING CALLED TO ORDER AT 7:00 P.M. ROLL CALL Present: Mayor Marcia Jensen, Vice Mayor Barbara Spector, Council Member Steve Leonardis, Council Member Rob Rennie, Council Member Marico Sayoc. Absent: None. PLEDGE OF ALLEGIANCE Anjali Manish Vaidya led the Pledge of Allegiance. The audience was invited to participate. PRESENTATIONS Mayor Jensen presented the Small Business, Big Applause commendation T-Birds Pizza. Faris Monshin thanked the Town and Council for their support. CLOSED SESSION REPORT Robert Schultz, Town Attorney, stated Council met in Closed Session as duly noted on the agenda and there is no report. COUNCIL/TOWN MANAGER REPORTS Council Matters - Council Member Rob Rennie stated he attended the Mid-Peninsula Open Space District’s Legislators, the Cities Association meeting, and as President of Los Gatos Morning Rotary, he hosted Senator Beall who spoke at their last meeting. - Vice Mayor Barbara Spector stated she attended the Art in the Council Chambers (AICC) reception along with Mayor Marcia Jensen and Council Member Steve Leonardis, and the promotional ceremony for two Los Gatos-Monte Sereno Police officers. - Mayor Marcia Jensen stated she has been conducting media outreach regarding traffic, and participated in orientation for new student Youth Commissioners. - Council Member Steve Leonardis stated he chaired the West Valley Sanitation District (WVSD) Board of Directors meeting. - Council Member Marico Sayoc stated she attended the Association of Bay Area Governments (ABAG) meeting, the San Jose Water Company drought meeting, and the Los Gatos-Monte Sereno Police promotional ceremony. Manager Matters - Les White, Interim Town Manager, Matt Morley, Parks and Public Works Director, and Captain Michael D’Antonio, provided an update on the pilot steps being taken to try to reduce cut-through traffic. CONSENT ITEMS (TO BE ACTED UPON BY A SINGLE MOTION) 1. Approve Council Minutes of: June 16, 2015 a. August 4, 2015 b. 2. Adopt an Ordinance amending the Code of the Town of Los Gatos Section 2.30.285 regarding the removal process of the Town Manager from office ORDINANCE 2243 3. Adopt a resolution to establish a suicide prevention policy 4. Authorize the Town Manager to execute an amendment to the purchase and service agreement with Robert Half International, Inc. dba Office Team 2 Town Council/Parking Authority August 18, 2015 Consent Items – continued 5. PPW Job No. 816-0412 Frank Avenue Storm Drain Improvements. Staff recommends that the Town Council: Approve plans and specifications for Frank Avenue Storm Drain a. improvements and authorize the Town to advertise the project for bid. Authorize the Town Manager to award and execute a construction b. agreement in an amount not to exceed the available construction budget amount of $157,440, including contingencies and any change orders. Authorize a budget adjustment of $26,240 from the storm basin #2 c. fund to allow for bid variations. Funding source for the proposed adjustment is the available fund balance from the storm basin #2 fund (462). 6. Adopt a resolution authorizing the Town Manager to execute master agreements, fund exchange agreements, fund transfer agreements and amendments with the State of California Department of Transportation. RESOLUTION 2015-051 7. Authorize the Town Manager to execute an Agreement For Services with Pro- Sweep to provide downtown sidewalk power washing services in an amount not to exceed $38,571 MOTION: MotionCouncil Member Steve Leonardis by to approve Consent SecondedCouncil Member Rob Rennie. VERBAL COMMUNICATIONS Beverly Lozoff - Thanked Council for adopting the suicide prevention policy resolution and provided information about the National Alliance on Mental Illness (NAMI). Sara Walker - Commented there is still an area that is not receiving water at Bachman Park, expressed her concern on the Town’s trip and fall hazard policy, and commented that it was difficult to get home last weekend with the traffic calming measures in Downtown. Chris Miller - Thanked the Council for putting the suicide prevention item on the agenda. Jonathan Knowles - Provided information on the Los Gatos-Monte Sereno Police Foundation, who they are and what they do. 3 Town Council/Parking Authority August 18, 2015 Verbal Communications – continued John Shepardson - Thanked the Police Foundation for all they have done for the community, commented on the trip and fall liability throughout the Almond Grove neighborhood and suggested the Council may want to consider installing trip and fall signs for the neighborhood. OTHER BUSINESS 8. Veteran’s Foundation update regarding a proposed Veterans Memorial at the Los Gatos Civic Center Christina Gilmore, Assistant to the Town Manager, presented the staff report. Opened Public Comment at 7:46 p.m. Len Pacheco - Commented on the proposed layout and the lack of a design professional on the review panel. Angelia Doerner - Commented in support of the memorial. David Stonesifer - Commented on the size of the proposed new concrete walk. John Shepardson - Thanked the Veterans Foundation for their time and suggested the area be named “Veterans Park.” Lee Quintana - Requested clarification of the proposed site. MOTION: MotionVice Mayor Barbara Spector by to approve the proposed location to the extent that it is in the redwood grove and ivy, that it is in the location that is adjacent to the parking lot next to the building that the New Museum of Los Gatos (NUMU) occupies, and that it incorporates a concrete walk that accommodates ADA SecondedCouncil Member Marico Sayoc. requirements. by VOTE: Motionpassed unanimously. 4 Town Council/Parking Authority August 18, 2015 9. 2015-2017 Strategic Goals Identification and prioritization of 2015-2017 Strategic Goals Laurel Prevetti, Assistant Town Manager/Community Development Director, presented the staff report. Opened Public Comment at 8:11 p.m. Lee Quintana - Suggested implementing a program in the Town to search and apply for grants, and to update the Zoning Code to be consistent with other policy documents. Jak Van Nada - Suggested having staff do a cost comparison of the Police Department versus the Sheriff’s Department. Shawn Lucca - Commented on his previous suggestion of installing parklets in the Downtown area and thanked staff for working with him on the idea. John Shepardson - Commented on the costs of the Police Department versus the Sheriff’s Department and suggested a third party cost comparison be done. Sally Reagan - Commented against conducting a review of the Police Department and the stated the Police Foundation should have the discretion to spend money as they see fit. David Weissman - Requested the hillside fence ordinance, grading ordinance, and tree ordinance be revised, and commented in favor of updating the smoking ordinance. Kaye Little - Commented on the conflict of interest policy for the Police Department. Angelia Doerner - Suggested the board and commission retreats be removed from the strategic goals and to have the Finance Department provide the cost analysis of the Police Department versus the Sheriff’s Department. Doug McNeal - Requested that any evaluation of any part of the Town services that all aspects be included. 5 Town Council/Parking Authority August 18, 2015 Other Business Item #9 – continued Shannon Susick - Requested that the unification of the Town be moved to the top of every list. Closed Public Comment at 8:51 p.m. Recess at 8:51 p.m. Reconvened at 9:01 p.m. Council discussed the matter and gave the following direction to staff:  Bring back to Council at the September 1 meeting information showing: The five unanimous items o Counts for the other items that were identified o A budget for an item when needed o Progress timeline o If a department is over or under loaded with projects. o  Council will consider and discuss how they would like to add to and prioritize the items.
