Staff Report�OwN °F MEETING DATE: 08/18/15 µ ITEM NO: cos un�os COUNCIL AGENDA REPORT DATE: AUGUST 11, 2015 TO: MAYOR AND TOWN COUNCIL FROM: ROBERT SCHULTZ, TOWN ATTORNEY SUBJECT: ADOPT AN ORDINANCE AMENDING THE CODE OF THE TOWN OF LOS GATOS SECTION 2.30.285 REGARDING THE REMOVAL PROCESS OF TOWN MANAGER FROM OFFICE RECOMMENDATION: Adopt ordinance that was introduced at the Town Council meeting of August 4, 2015. BACKGROUND: On August 4, 2015, the Town Council introduced an ordinance, which amends Section 2.20. 10 of Los Gatos Municipal Code to change the removal process for the Town Manager from 4/5 vote of Town Council to a majority of Town Council. DISCUSSION: At its meeting on August 4, 2015 the Town Council held a public hearing to consider amending Section 2.30.285 of the Town Code that currently requires a 4/5 vote for the removal of the Town Manager. The vast majority of Cities across the State of California require a majority vote for the removal of the Town Manager. In addition, the International City /County Management Association model ordinance recommends a majority removal of the Town Manager. CONCLUSION: If Council adopts the ordinance at its August 18, 2015 meeting, the ordinance would go into effect in 30 days from adoption. Attachment: 1.
