Attachment 5- - - -- Original Message---- - From: Marcia Fariss fmailto:hear@gizmology com] Sent: Wednesday, May 13, 2015 2:41 PM To: Council Subject: Hwy 85 expansion Mayor Jensen, Fellow City Council Members, As a former Los Gatos resident and currently a Saratoga resident, I urge you to join the unanimous votes of the Cupertino and Saratoga City Councils in initiating litigation against Caltrans and VTA. Several years ago VTA signed contracts with several Hwy 85 corridor cities, (those agreements allowed the West Valley portion of the freeway to built) that bound them to certain items. Included in those agreements were that there would be no more than a total of 6 lanes, that the median strip would be reserved for light rail, that noise abatement and landscaping measures would be instituted, and that comprehensive EIRs would be performed for any proposed changes to Hwy 85. Caltrans and VTA are simply willfully ignoring those agreements in their efforts to expand Hwy 85 and create 2 express toll lanes. They have performed no comprehensive EIR and their recent Negative Declaration is a joke! It is logically impossible that such proposed massive changes to Hwy 85 would have no adverse effects. Then, of course, there is VTA's own documentation that the multi millions of dollars cost of the expansion would be effective for 8 years or less. My personal communications with many Los Gatos residents have demonstrated that none of them is in favor of the current VTA plans to expand Hwy 85. The VTA /Caltrans proposed plans would adversely affect large numbers of your residents; therefore, it is in Los Gatos' best interests to oppose it. Please support your neighboring cities and your residents in this vital matter and join in the litigation against Caltrans and VTA. Thank you for taking the time to read this and seriously consider the above requests. Sincerely, Marcia Fariss Saratoga, CA ATTACHMENT 5
