This is not a letter that I want to write but I am tired of trying to participate in the process as a
citizen that loves Los Gatos, only to repeatedly have the feeling that I am being actively
handicapped by staff. Specifically, I have been told that it is Town policy that all documents
submitted by both the applicant and the appellant, will be mutually shared between both parties.
This is simply not happening and I vent hoping for the necessary changes. Here is the relevant
timeline:
1. January 13, 2015. DRC approves A &S Application #S -14 -072. I appeal their decision on
January 13, for the PC meeting of March 11, 2015.
2. February 17, 2015. Davidon sends an email letter to staff in response to my appeal. I first see
this letter 19 days later when I log onto the Town's website on March 8th, in preparation for the
PC meeting, because it was not sent to me. Why was the stated Town policy of sending all
correspondence to the appellant, not done? - no email or snail mail. Without prior knowledge of
Davidon's letter, I was unable to adequately prepare for the PC meeting on March 11th.
3. March 3, 2015. Davidon submits a visual analysis to staff for the upcoming PC meeting. As
with the Davidon letter of February 17th, I first find out about these analyses on March 8th. But
it wasn't until I read the latest Davidon letter dated April 30, 2015, that I discover when this
analysis was actually send to staff. Because this analysis wasn't referred to in the Davidon
February 17th letter, I had just assumed this was a desk item, not something sent to staff on
March 3rd.
4. March 11, 2015 is the PC meeting. I appeal their decision a few days later to the TC for its
May 5th meeting.
5. April 8, 2015. Davidon sends a letter to staff (I assume via email but it is not noted on the
letter). I first see this letter 23 days later on May 1 when I log onto the Town's website. That now
makes three correspondences from the applicant that weren't sent to me in any manner, timely or
not.
6. April 12, 2015. I email a letter and photographs to staff for the upcoming TC meeting. I know
that this letter is forwarded to the applicant because on April 30, they send a reply and analysis to
staff. Their analysis took several days if not weeks to prepare. I asked staff on May 4th, when my
letter of April 12th was forwarded to Davidon. I await their answer.
7. April 30, 2015. Davidon sends a letter and photos to staff in response to my letter of April
12th. I assume via email since staff thought the letter arrived on April 30th and the visibility
analysis from Bassenian/Lagoni is dated April 30th. (In fairness, Marni said her kids have been
sick).

8. May 4, 2015, one day before the TC meeting, I receive via email a copy of the Davidon letter dated April 30th, and via
snail mail, the Council Agenda Report for the May 5th meeting. This is the first time I have seen that April 30th letter
since it was not on the Town's website on May 1st. And that Council Agenda Report was the only information I received
from staff re the upcoming meeting. Why isn't it Town policy to send out the full report to the appellant and other
interested parties, via email, at the same time that full report is sent to the PC or TC members? Or at least an email saying
that the meeting information is now posted. But I also think that it is unfair for me to only have some 24 hours to prepare a
response to Davidon's letter of April 30th.
Given the timeline presented above, especially the receipt of the April 30th letter one day before the TC meeting, it seems
prudent and fair to delay the hearing until I can adequately respond to the issues raised by Davidon. Alternatively, this
matter could be referred back to the PC during which time both I and staff can accurately evaluate this last minute -
information submitted by Davidon.
