REQUEST FOR REFUND OF DEMOLITION FINE. APN 510 -18 -045.

On April 7, 2015 the Council considered this matter. Following consideration and two failed
motions, the item was continued to a future Council meeting. Council Member Rob Rennie must
continue to recuse himself because his property ownership results in a conflict of interest.
A chronology and analysis of events is included in the April 7, 2015 Town Council Staff Report.
There is no written documentation that Mr. Schmidt was advised directly about the appeal
process.
On May 11, 2015 the Historic Preservation Committee expressed that the penalties for unlawful
demolition of historic structures pursuant to Town Code Section 29.10.09030 are too high in
some cases. The Committee also discussed a variety of related items:
• Whether there should be a distinction between demolition and disassembly;
• Whether the finished design of a project outweighs demolition;
• What other cities are doing; and
• A potential Code modification to give the Historic Preservation Committee discretion to
determine the amount of fines for unlawful demolition of historic structures.
The matter was continued to the June 24, 2015 Historic Preservation Committee meeting for
further discussion.
