All recommendations made by the Town arborist in her report of December 10, 2014, should be made part of this approval and for future lots in Highlands. 2. Advertising brochures show extensive lawn areas for these houses - certainly not restricted to within the 30' from the house perimeter as required or "limited to locations immediately adjacent to the house such as entry ways or small gardens at the rear' (HDS &G, page 51). 3. No grading by developer should be permitted if more than 30' from house, even if less than 1000 square feet. This includes surface scraping for poison oak. No permit should be issued for such grading unless good reasons presented. Exceptions are listed in Town code Section 12.20.015, except for the 1000 square foot clause. Also, since there is no time period given for grading, someone could argue that they could grade 999 sq feet on Monday, 999 sq feet on Tuesday, etc. 4. It should be general policy that the Town's arborist should inspect any tree for which a tree removal permit is requested unless it is part of the A & S application. S. The consulting arborist needs to make more than "periodic" visits to the site to insure that trees are being adequately protected. That person should have the authority to mandate immediate changes. In just the last few days, the materials stored on several lots around Lot 7 have been removed, but Debra Ellis suggested this happen over 2 years ago. Also fill dirt being deposited on Lot 13 is now in contact with a major oak on site. ATTACHMENT 2 6. Fencing should be of an open nature, such as wood and as illustrated in the HDS &G (page 42). Such fencing should not have wire mesh, yet was approved on page 3 of Ordinance 2147, and recorded in the CC &Rs, because such wire mesh restricts animal movements, in contradiction to the HDS &G (page 42).
