SUBJECT: CONSIDER THE RECOMMENDATIONS OF THE POLICY COMMITTEE TO:
A. APPROVE THE REVISED COMMISSION APPOINTMENTS POLICY, AND
B. ADOPT A RESOLUTION TO RESCIND THE FOLLOWING RESOLUTIONS
AND THEIR ASSOCIATED POLICIES:
i. RESOLUTION 2002 -175: COMMUNITY BENEFIT POLICY;
ii. RESOLUTION 1994 -78: STANDARDS FOR OUTDOOR RESTAURANT
SEATING; AND
iii. RESOLUTION 1995 -105: INTERIM POLICIES FOR DEVELOPMENT
APPLICATIONS ALONG LOS GATOS BOULEVARD FROM
SPENCER AVENUE TO ROUTE 85
REMARKS:
In response to a question from a Council Member regarding the recommended rescission of the
Community Benefit Policy, this Addendum provides additional background and explanation as to why the
Community Benefit Policy is outdated.
Prior to August 2014, the notion of Community Benefit existed in a land use policy (the subject of this
agenda item) as well as the old Traffic Impact Policy. The old Traffic Impact Policy, adopted by Council
Resolution 1991 -174, required a Community Benefit from developers for projects generating five or more
trips. The intention was to obtain a voluntary offering from a developer to offset potential negative traffic
impacts of a proposed development. Community Benefits could include items such as an additional
Below Market Price housing unit, a traffic improvement beyond the required mitigation under the
California Environmental Quality Act (CEQA), or other neighborhood improvement.
This requirement was removed last August when the Council rescinded Resolution 1991 -174 and adopted
an updated Traffic Impact Policy (Resolution 2014 -059) as a companion to the increased traffic impact
fees. Last August, the Council also discussed making other Town policy changes to align with the new
Traffic Impact Policy. The Policy Committee, in its review of land use policies, recommended the
rescission of the stand -alone Community Benefit Pol' y which gov s land use items.
