M01-20-2015 Town Council Meeting 02/03/15 Item # 1b MINUTES OF THE TOWN COUNCIL/PARKING AUTHORITY MEETING JANUARY 20, 2015 The Town Council of the Town of Los Gatos conducted a Regular Meeting on Tuesday, January 20, 2015, at 7:00 p.m. MEETING CALLED TO ORDER AT 7:00 P.M. ROLL CALL Present: Mayor Marcia Jensen, Vice Mayor Barbara Spector, Council Member Steve Leonardis, Council Member Rob Rennie, Council Member Marico Sayoc. Absent: None PLEDGE OF ALLEGIANCE Keaton Jones led the Pledge of Allegiance. The audience was invited to participate. PRESENTATIONS Mayor Jensen presented commendations to outgoing board and commission members.  Arts and Cultural Commission – Cheryl Hare (present), George Havelka  Community and Senior Services Commission – Bido Baines  Library Board – Rita Baum (present)  Personnel Board – Phil Nielsen  Parks Commission – Rob Rennie (present)  Planning Commission – Margaret Smith, Marico Sayoc (present)  Transportation and Parking Commission – Glenn Roberts, Michael Kane COUNCIL/TOWN MANAGER REPORTS Council Matters - Council Member Rob Rennie stated he attended the Cities Association meeting and volunteered to serve on the Affordable Housing and Transportation sub-committees; also attended the League of California Cities training for new council members; and met with Assemblyman Evan Low. - Vice Mayor Barbara Spector stated she and Mayor Jensen attended the Town Council Policy Committee meeting. - Council Member Steve Leonardis stated he attended the West Valley Sanitation District Board of Directors meeting, where he was appointed chair. - Council Member Marico Sayoc stated she and Mayor Jensen attended the Housing Element Advisory Board (HEAB) meeting. - Mayor Marcia Jensen stated she attended the Valley Transportation Authority (VTA) Policy Advisory Committee meeting. Manager Matters - Provided a brief overview of the new Pending Planning Projects map on the Town website. CONSENT ITEMS (TO BE ACTED UPON BY A SINGLE MOTION) 1. Approve Council Minutes of December 16, 2014. 2. North Forty Specific Plan, General Plan Amendment GP-14-001, Zoning Code Amendment Z-14-001, and Environmental Impact Report EIR-10-002. Project Location: the plan area comprises approximately 44 acres located at the northern extent of the Town of Los Gatos, bordered by State Route 17 and State Route 85 freeways to the West and North, Los Gatos Boulevard to the east, and Lark Avenue to the south. APN 424-07-009, 010, 024 through 027, 031 through 037, 052 through 054, 060, 063 through 065, 070, 081 through 086, 090, 094 through 096, 099, 100, 424-06-115, 116, and 129. Property Owners: Thomas & Miyoko Yuki, Herbert & Barbara Yuki, ETPH LP, William Mattes, Peter Brutsche, William Fales. Applicant: Town of Los Gatos. Adopt the Resolution certifying the Final Environmental Impact Report for the RESOLUTION 2015-002 North Forty Specific Plan. 3. Tract Map No. 10275 - 100 Prospect Avenue Adopt a resolution approving the final map for Tract No. 10275 – 100 Prospect Avenue, accepting the dedications, and authorizing the Town Manager to execute the subdivision improvement agreement for the construction of public improvements and approving the request to add the name “Sisters Court” to the Town’s Official Street Name List to be used at the proposed development. RESOLUTION 2015-003 4. Old Library Re-Use Project 411-821-2105 a. Authorize the Town Manager to execute a change order with Terry J. Martin Associates in an amount not to exceed $50,050. b. Authorize a budget transfer in the amount of $50,050 from the Town Digital Aerial Photograph/Topographic Map Project 411-821-2006 to the Old Library Re-use Project 411-821-2105. VOTE: Motion passed unanimously. VERBAL COMMUNICATIONS Jeff Loughridge - Commented on the State mandates for affordable housing as it relates to the North 40. Tricia Hancock - Commented on the smoking ordinance in Los Gatos and inquired what can be done to notify the business owners and public about the smoking ordinance. 2 Town Council/Parking Authority January 20, 2015 OTHER BUSINESS 5. United States Postal Service delivery in Los Gatos Greg Larson, Town Manager, presented the staff report. Opened Public Comment at 7:33 p.m. Ryan Jones, Los Gatos This Week Newspaper - Commented they mail their newsletter to all residents and the first four issues last year took two weeks to be delivered and apparently some weren’t delivered. Mr. Lopez, LG Postmaster - Briefly outlined what the Los Gatos Post Office has done to address the issues raised by the residents. Ivy Chen - Commented that she is still experiencing delivery issues with her mail. Ted Halunen - Commented on the proper flying of the American Flag at the Post Office and Civic Center. Closed Public Comment at 7:43 p.m. 6. Recommendations from the Arts and Culture Commission regarding a Veterans Memorial at the Town of Los Gatos Civic Center Christina Gilmore, Assistant to the Town Manager, presented the staff report. Opened Public Comment at 7:58 p.m. Scott Borga - Commented in favor of the fountain area and statuary. Marlene Rodman, Friends of the Library President - Commented in favor of the upper deck. John Lochner - Commented on the history of memorials in Los Gatos and spoke in favor of the conceptual design as submitted. Eric Fox, Parks Commissioner - Spoke on behalf of the Commission as a stakeholder in the process, which voted to “support the subject matter of a memorial within the parks or park support areas honoring those that have defended our country” and spoke personally in favor of a memorial with statuary and arbor. 3 Town Council/Parking Authority January 20, 2015 Other Business Item #6 – continued Brian Miguel - Commented in favor of a statue at the fountain area on the upper deck. Michael Silva - Commented in favor of the upper plaza and against the proposed statuary. He requested that the Council give more time to consider the options before making a decision. Mary Ellen Comport, representative of the volunteers in the community - Commended the work the Arts & Culture Commission did in reviewing the proposal from the Veterans Memorial Foundation; spoke against the statuary proposal; and requested the Council form a committee of all the stakeholders to study the proposals. Daniel Snyder - Commented in favor of a veterans memorial in a prominent location. Robert Macartney - Commented that the proposed memorial was too overwhelming for the upper deck. Bob Garzee - Commented in favor of the memorial and urged the Council not to delay a decision. Mary Ellen Kaschub - Commented in favor of a memorial; against a statue; and that the proposal was not in keeping with the architecture of the Civic Center. Barney Davidge - Commented that the scale of the proposed memorial is a redesign of the Civic Center and it should be done with due process; it should be in keeping with the architecture; and asked if a conceptual design can be approved. Angelia Doerner - Thanked the Arts & Culture Commission for their work, and spoke in favor of a memorial and against the proposal. Paul Barrish - Commented in favor of a memorial at the Civic Center. Eileen Werner - Commented against a statue memorial as proposed. 4 Town Council/Parking Authority January 20, 2015 Other Business Item #6 – continued Dennis Gerber - Commented in favor of the proposed five person statue. Dick Scott - Commented in favor of a veterans memorial in a location and made with material that is significant and emphasizes the honor that should be provided to our veterans. He commented in favor of a statue. Kent Hillhouse, Veterans Memorial Foundation Member - Commented on behalf of the Veterans Memorial Foundation; thanked the Arts & Culture Commission (ACC) for their time and review of the submittals; addressed the recommendations by the ACC that the Veterans Memorial Foundation agreed to; and urged the Council to meet the Veterans Memorial Foundation half way. Diane Chandler - Commented in favor of a significant location for the memorial. Jeffrey Janoff, NUMU President - Commented in favor of the ACC recommendation and that the upper deck is not the best location. Ryan Hall - Commented in favor of a memorial. B.J. Tucker, Veterans Memorial Foundation Treasurer th - Read a letter from Dr. Francis Harvey, 19 Secretary of the Army, recommending the veterans memorial as presented by the Veterans Memorial Foundation. George Hall - Requested that the Council make the memorial significant and not put in an insignificant location; commented on the process of removing the fountain; and stated the Veterans Memorial Foundation is willing to take on the responsibility. Lee Quintana - Commented that the veterans need to be recognized. Louise Scott - Commented in favor of the upper deck and the statuary. Tom Griffin - Commented on what the military does in times of peace. Michael Frangadakis, Veterans Memorial Foundation Member - Urged the Council to approve a memorial on the upper deck with statuary. Sara Wright - Commented in support of the veterans memorial on the upper deck with statuary. Paul Smith - Commented in support of an abstract memorial. Scott Plautz - Commented in support of the Veterans Memorial Foundation proposal. Suzette Austin - Commented in favor of the proposal by the Veterans Memorial Foundation. Dave Knapp - Commented in favor of the proposal by the Veterans Memorial Foundation in the proposed location. Sandra James, former Mayor of Cupertino, Co-founder & President of the Cupertino Veterans Memorial - Commented in favor of the upper deck and urged the Council to approve a location so the Foundation may move forward. Ed Lucey - Commented against the upper deck location and the proposed design not fitting with the design of the buildings. Tyler Kemp - Commented in favor of the upper deck location and statuary. Terry Leary - Did not speak. Tim DuClos - Commented in favor of statues in a prominent location. 6 Town Council/Parking Authority January 20, 2015 Other Business Item #6 – continued Duino Giordano - Commented on behalf of the Los Gatos Community Foundation, and the Foundation unanimously voted to support the proposal. Rex Naden, Veterans Memorial Foundation Member - Commented on behalf of the Veterans Memorial Foundation and discussed the recommended alternative locations for the memorial. Ron Cassel - Commented in favor of a memorial. John Forrett - Commented in support of a veterans memorial on the upper deck. Clyde Horn, Veterans Memorial Foundation Board Member - Commented in support of human figures as part of the memorial. Anthony Frangadakis - Commented that the memorial is to honor veterans and first responders and urged the Council to approve the concept. Jim Free, President and CEO of Campbell Veterans Memorial - Commented in support of the memorial. Steve Rice, former Mayor of Los Gatos - Urged the Council to approve a conceptual design of arbors and statuary for the upper plaza, and allow the Veterans Memorial Foundation to bring back two or three designs for the statuary for final approval by Council. David Middlebrook - Commented on the public art process and expressed support for a veterans memorial in the right location. Closed Public Comment at 10:20 p.m. Council discussed the matter. 7 Town Council/Parking Authority January 20, 2015 Other Business Item #6 – continued MOTION: MotionVice Mayor Barbara Spector by to direct the Veterans group to move forward, if they so choose, to come back to Council with a finalized design for a trellis on the Civic Center Plaza with a focal point, should they decide they want one, and also a design for the redwood grove and statuary there, all at the discretion of the Veterans group, should they decide to move forward on either of Seconded these locations and within either of those parameters. Council Member Rob Rennie. by VOTE: Motion passed 3/2. Mayor Marcia Jensen and Council Member Marico Sayoc voting no. 7. Planned Development Overlay Zone a. Consider the Planning Commission’s recommendations to the Town Council regarding the Planned Development Overlay Zone and b. Adopt a resolution appointing a Study Committee, or c. Implement the Council Ad Hoc Committee’s recommendation Ad Hoc Committee’s recommendation Due to time constraints, the Mayor continued the item to a future date. 8. Senior Group Homes Transfer and Rehabilitation Loans Adopt a resolution authorizing the Town Manager to Execute: a. Agreements facilitating the transfer of 185 Anne Way (APN 527-48-020) and 14390 Blossom Hill Road (APN 527-31-013) Senior Group Homes from Senior Housing Solutions (formerly Project Match) to Charities Housing Development Corporation (Los Gatos Senior Homes LLC). b. New Rehabilitation Loan Agreements addressing necessary repairs and improvements to preserve the long-term affordability and maintenance of the homes in the Town’s affordable housing stock.
