REMARKS:
The attached correspondence (Attachment 58) was received after distribution of the Addendum
on February 27, 2015.
Additionally, Council Members requested input from staff regarding the questions listed below.
The questions are followed by staff remarks in italics.
1. By way of example, how would State's senior housing density bonus apply to Eden if it
submitted an application for 60 units? Would it be a 20% bonus above 60?
If an applicant requested a State Density Bonus, they would be entitled to request up to a 35
percent density bonus above the density that is permitted by the Specific Plan. In the
example of the current Phase I application, the developer could request a Density Bonus of
up to 35 percent and request three concessions. The density bonus would be calculated
based on the proposed number of units for the Phase I application (335 units). It should be
noted that the applicant has not requested a Density Bonus for the Phase I application
2. Why should we place a Commercial Square Footage Table (see Table 2 -7 on page 4 of the
staff report) in the glossary?
The Table was provided in the Staff Report as an option for controlling the size of
commercial tenant spaces, similar to the Residential Table in the Glossary. If the Council
determines that this is an appropriate tool then it could be put in the Glossary or the main
text of the Specific Plan. The Advisory Committee looked at different variations of this Table
and ultimately decided to use policy language to address the appropriate type and size of
commercial space.
3. Explain the language "percentages apply to 400,000 or the total amount of square feet (sf) at
buildout" in Table 2 -7 on page 4 of the Staff Report.
The original intent of the Table was to encourage a mix of commercial sizes and to protect
the Town from getting an application with all small stores. The statement above was
intended to accommodate the possibility that there may be less than 400,000 square feet of
new commercial space built. For example, if a hotel and/or office space is constructed the
new commercial square footage may have to be reduced because there is a 580,000 square
foot maximum for all commercial uses and approximately 70,000 square feet of existing
commercial that would remain.
4. Didn't the council say it did not want medical offices?
Removing medical office entirely was not included in the consensus motions at the last
meeting. If the Council would like to remove this use, then staff will make that modification.
Please note that it would be helpful to distinguish between the removal of new and existing
medical office uses. For example, if medical uses were not permitted then the current

medical uses in existing buildings to remain on Los Gatos Boulevard would become non-
conforming.
5. Why did the Advisory Committee select square footage numbers for residential (see page 5
of the staff report)?
Originally there was a more complicated table that broke down the types of residential units
and an approximate square footage of each type. Percentages of each residential type were
then multiplied by the square footage to come up with a number. The Table originally broke
out net area and gross area and it became too complex and was not helpful. The Table was
then simplified and moved to the Glossary.
6. What are the "incentives" envisioned by staff as noted on page three, paragraph three of the
Staff Report dated February 26, 2015? The example given is a 20% density bonus. How
would this apply specifically to senior housing? Is it contemplated that some incentive
specific to the North 40 be included in the Specific Plan?
State Density Bonus law permits all senior housing to receive a 20 percent density bonus
whether or not the project is affordable. The prospective developer would need to ask for
this density bonus with their application. Incentives may include items such as reduced
parking requirements, modifications to setbacks, etc. The Town is not required to identify
incentives upfront in the Specific Plan.

Dear Council,
I'm writing to you regarding the North 40 Plan and my opposition of approving specific plans that will
allow not only the North 40 to become another Santana Row, but for the precedence it will hold for
future proposed development within the town limits.
I was born and raised in Los Gatos. My husband and I have raised our kids here, and I have a business
here. For over 10 years, I have attended focus studies, council meetings, neighborhood meetings, etc.,
regarding the North 40. It has felt like a massive machine moving forward that no one can stop. I know
the town is looking for the best way to develop the land with minimal impact. However, the truth is,
there is no way this development is not going to impact the traffic, the schools, and the environment of
our town. I could get into greater detail of my frustration regarding traffic and how it takes over 20
minutes to get from my home on Bruce Ave. to downtown Los Gatos or the effect of all of this
development will have on our schools and town services (police and fire...), but you already have heard
that from many other people.
So, in short, I wanted to let you all know that I oppose the North 40 plan as it is currently proposed.

Keep the traffic to a minimum. Los Gatos Blvd. is getting worse and the approved developments have
only begun.
Keep North 40 housing to seniors who will not drive as much and have not children to impact the
schools. No more medical!
Keep Hillbrook School as its present enrollment... most of the traffic generated by HB through our
neighborhood is from people who live outside of Los Gatos.

We wanted to say that the North 40 project is to be commended
for its imaginative and important inclusion of community gardens
and heritage orchard elements. Inviting the Los Gatos community
at large to join new residents of the North 40 is a wonderful idea.
We also like the proposal's Market Hall concept that could include
produce from the orchard and vegetables from the community
garden. Perhaps a downtown restaurant or two could adopt one of the
gardens and/or have a presence in the Market Hall in order to boost
downtown business as well.

Good Afternoon,
My name is Gina Robinos, part of the D'Agostino family which owns APN #424 -0785 —15015 Los Gatos Blvd.
Our family has owned this property for over 50 years. We have been waiting many years for the specific plan to get
approved. We know many different investors have come to the town over the years going back 20 years but we have
never gotten this far. We have not been able to do any property improvements or develop on it. Our hands have been
tied for many years now. I came to the town in 2006 to address the movement of getting the specific plan approved and
basically was told nothing was going on at this time. Here we are 8 plus years later and still trying to get this approved.
My family is strongly hoping the North 40 Specific plan can get approved this month or in a timely fashion based on the
EIR being approved and that we have been working on this over the years. I know that some people of the town are
new to the North 40 and are trying to delay or adjust what we have been on and trying to do, we are hoping this does
not interrupt this process that we have been working on and waiting for and the town moves to approve the specific
plan. It's not about the developer, we have been waiting for this to get done for over 20 years. I don't want our small
voice to be over shadowed by the developer. We have been waiting for many years for this to get approved so we can
make improvements to our location.
Thank you for your time and we look forward to the town meeting tomorrow. This process has taken a huge financial
and emotional toll on my family. Your consideration to this matter is greatly appreciated.

Re: North 40 Specific Plan, Northern District Support Planning Commission Recommendation
Dear Mayor and Members of the Town Council:
Thank you for the time and resources you have put into the North 40 Specific Plan.
As I mentioned at the September 2, 2014 Town Council Hearing, our company, St. Anton Communities, controls a
number of infill parcels in the Northern District of the proposed North 40 Specific Plan. We are a privately owned
statewide developer and builder with nearly 7,000 residential units, including income - restricted, mixed - income and
market rate communities.
The properties that we control in the Northern District provide a very unique opportunity to meet the Town's
objectives with minimal impact to the existing resources.
I. All of our properties are in the Cambrian school District not the Los Gatos school district. We have been
in communication with Cambrian and they have confirmed their boundaries and capacity to serve our
potential future residents.
2. Our property assemblage includes frontage on both Burton Road and Los Gatos Boulevard, thus allowing
for vehicular and pedestrian circulation in, around and out of the project site.
Specifically, I write to respectfully request that you accept the Los Gatos Planning Commission's August 15, 2014
recommendation stated below:
August 15, 2014 Planning Commission Formal Recommendations) Section B, Page 2, Set 3:
Table 2 -1 Permitted Uses on page 2 -7: To provide more flexibility, delete the note saving "Residential only allowed
in Northern District when located above commercial."
The Planning Commission's recommendation is consistent with the Town Council's direction to "spread housing
throughout the North Forty." The Northern District can help Los Gatos meet its housing needs without impacting
the Los Gatos school system. Although well intentioned, requiring residential to be "above commercial" can result
in incompatible design, excessive costs and vacant /blighted commercial spaces.

I am a homeowner and resident on Highland Oaks Way. It has been brought to my attention that there
has been a push to make changes in the North 40 plans regarding the amount of space allocated to
small vs large retail. As I am directly impacted by the types of retail stores going into the North 40
development, I want to make it known that I do not support increasing large retail space. It was our
understanding, from previous town reports and what has been printed in the Los Gatos Weekly that the
agreement was for an increase in small retail and a decrease in large retail.
I do not want to live next to a power shopping center! I want to be able to walk along quaint paths and
enjoy upscale dining and boutique shopping. The addition of boutique stores in the North 40 will only
enhance the Town of Los Gatos. Rarely do I venture into town to shop, with the exception of movies and
and occasional dinner. All of the small boutique stores that gave downtown Los Gatos so much character
over the decades have sadly gone away. The town is now inundated with coffee shops, salons,
restaurants, chain stores, and medical offices. PLEASE BRING BACK THE SMALL COMMUNITY
BOOKSTORE, THE SMALL ARTISTIC AND CAMPY BOUTIQUE SHOPS.

Winchester every day. I love our town but have never seen a 11/2 mile stretch that has more traffic

Mr. Larson,
I am writing concerning the North 40 project. I live at 131 Highland Oaks Drive, off Lark
Avenue. Our neighborhood is the most impacted residential neighborhood adjacent to
this project.
We have met a couple time with both Grovner and Summerhill and we have appreciated
their interest in our concerns and desires for the development of the North 40. As I'm
sure you are aware, we have few retail and fine dining on this side of town. We have a
number of grocery stores and fast food and feel we have no need to add to that
continually growing list. We seek to have a place where we can enjoy retail shopping
and a better dining experience, which includes outdoor seating and entertainment. We
hope to have a destination we can walk to with our families and enjoy with our
neighbors.
It has come to our attention that a discussion reducing the amount of small retail space
and increasing the amount of large retail has begun at the Council level. We would
implore you to not move in this direction. We do not wish to be adjacent to large retail
shopping. We wish to enjoy walk -able small retail and dining that maintains our quality
of life that we enjoy in Los Gatos. We wish to maintain the unique nature of Los Gatos
on the North side of town as well as our Downtown. It would be unfortunate to have the
development of the North 40 influenced by the property owners of many downtown
buildings. This will be a stand -alone North side of town attraction, one that is very
needed. If done correctly, the development of the North 40 will increase the attraction
of Los Gatos.
We thank you for the attention that is being placed on the nature of this development
and we ask that, as you review and discuss, you keep in mind the adjacent
neighborhoods who see this at a great opportunity on this side of town.

Dear Greg Larson,
I'm a resident on Highland Oaks Way, and It has been brought to my attention that there has been a push to make changes
in the North 40 plans regarding the amount of space allocated to small vs large retail. Being that I am directly impacted by
the types of retail stores going into the North 40 development, I want to make it understood that I do not support the
increase of large retail space. It was my understanding, from previous town reports and what has been printed in the Los
Gatos Weekly, that the agreement was for an increase in small retail and a decrease in large retail.
I do not want to live next to a power shopping center! The addition of boutique stores in the North 40 will only enhance
the Town of Los Gatos. Rarely do I venture into town to shop, with the exception of movies and and occasional dinner. All
of the small boutique stores that gave downtown Los Gatos so much character over the decades have sadly disappeared.
The town is now inundated with coffee shops, salons, restaurants, chain stores, and medical offices. PLEASE BRING
BACK THE SMALL COMMUNITY BOOKSTORE, THE SMALL ARTISTIC AND CAMPY

Dear Town Council,
I am writing to you to express my great concern for North 40 project and its effect on our school
district.
I have a very hard time believing that the number of kids calculated to be added to our schools will be so
little.
I understand that there is a need for housing, and I understand the state requirements for low income
housing in our town. However, the current housing plan for this project is placing all the single family
homes in Los Gatos School district rather than evenly distributing them between Los Gatos school
District and Cambrian school district. It seems to me that the developers are anticipating families with
children looking at these units and want to make these units more desirable (and more expensive) by
building them in the LG school district.
If the main goal of our city council is to satisfy the state requirements for affordable housing, why not
ask the developers to change the housing plans to distribute these houses evenly between the two
school districts. Currently, only the senior housing is in the Cambrian School District.
I sincerely appreciate your review of these plans, and I know that as voted elected officials you will have
the best interest of our town in heart.
Please preserve our town and quality of our schools.

Mr. Larson -
We live at 118 Highland Oaks Dr., Los Gatos. We have attended previous planning commission
meetings, concerning the traffic impact on our street from the North Forty project. We have learned
that the commission is considering the reduction of the number of small retail establishments, and
increasing large retail businesses for the project. As longtime residents, we have been concerned
about the lack of small retail establishments, including the definite lack of restaurants and other eating
establishments, in our area. The recent building of a medical center on Los Gatos Blvd., is one
example. The establishment of large retail in the proposed project would only lessen the image of Los
Gatos as an idyllic town setting. The residents in our area would appreciate the enjoyment of
patronizing smaller shopping and dining establishments, as the residents of the downtown area already
do. There are already larger shopping complexes that serve the community (ie, Santana Row, Oakridge
Mall, Westfield Mail (Valley Fair). We respectfully request that the commission give serious
consideration to the placement of smaller retail and dining establishments in the North Forty project, to
preserve the business integrity and diversity of our town.
