CONSIDER A REQUEST FOR A CONDITIONAL USE PERMIT FOR A HIGH TURNOVER SIT DOWN RESTURANT (SUPER DUPER BURGERS) WITH OUTDOOR SEATING AND BEER AND WINE SERVICE WITH MEALS ON PROPERTY ZONED CH:PD. APN 529 -65 -028. REMARKS: This Addendum addresses an inquiry by a couple of Council Members regarding outdoor patio seating at Philz Coffee located at 681 Blossom Hill Road, Suite #102. Philz Coffee will share the outdoor patio space with the proposed Super Duper Burgers tenant space (15991 Los Gatos Boulevard) if this application is approved. On June 26, 2013, the Planning Commission approved Conditional Use Permit (CUP) application U -13 -008 for a restaurant ( Philz Coffee) with outdoor seating. Philz Coffee has approval for a maximum number of 12 seats which includes both outdoor and indoor seats. Staff has received inquiries from the public regarding Philz Coffee's outdoor seating and the desire to increase the number of overall seats. Staff has been in communication with the property owner and Philz Coffee regarding this matter and the Conditional Use Permit modification process. Any additional seats over the approved maximum of 12 seats would require Philz Coffee to apply for a modification of their CUP. If the Council agrees with staff and the Town Attorney that the parking credit was approved as a part of the PD and Architecture and Site Applications there are five parking space credits available pursuant to the existing and proposed tenant mix and their corresponding parking requirements.
