Additional Correspondence STAFF REMARKS: On November 12, 2014, the Planning Commission continued the subject application to December 10, 2014 because the Commission did not have a quorum. Main Street/U -13 -017 December 10, 2014 After further consideration, the applicant requests that museum and private events be permitted up to 11:00 p.m. Given that -events could include the service of beer and wine, if the deciding body finds merit to allow events past 10:00 p.m., the deciding body shall make the findings required by the Town's current Alcoholic Beverage Policy (Exhibit 7) for alcoholic beverage service past 10:00 p.m. The applicant has submitted justification to allow beer and wine service after 10:00 p.m. (Exhibit 9). If the deciding body finds merit to allow events with beer and wine service up to 11:00 p.m., staff recommends the conditions be modified as follows (deletions stfiekea, additions underlined 5. MUSEUM EVENTS: Museum events, such as committee meetings, exhibit openings, fundraisers, and private art/history receptions, are permitted. Museum events may require a special event permit from the Los Gatos -Monte Sereno Police Department, or a Park Permit from the Los Gatos Parks and Public Works Department. a. OCCURANCE: Museum events cannot conflict with Town meetings, events and operations. The applicant must coordinate with the Town Manager's Office for events that may affect parking at the Civic Center. b. HOURS: Museum events may occur past 7:00 p.m. when no Town meeting or event is scheduled, and must end by 1911:00 p.m. c. NUMBER OF ATTENDEES: The maximum number of attendees is 253 based on maximum occupancy inside the space leased from the Town. 6. ALCOHOLIC BEVERAGE SERVICE: The service of beer and wine is permitted prior to 1-011:00 P.M. 7. PRIVATE EVENT RENTAL: The space may be rented out for private events and receptions, including weddings. a. OCCURANCE: Private events are permitted up to 26 times per year. When the new library was planned, a community meeting room (expected of all good libraries) had to be sacrificed due to space and parking constraints. At that time the Friends of the Library, charged with raising $2.1 million dollars to furnish the new library were "unofficially" promised via the EIR that the old library could be converted to a community meeting room. When the Council met to consider uses of the former library, the proposals by Town staff and myself were ignored. 1 am assuming that you plan to hold events in the NUMU. I would that you would make such space available to other groups. We are the only West Valley city that has no municipally owned community meeting space. The large room at the neighborhood center is much too large and expensive - and heavily booked. As you get town approval for your renovations, it would be great if the Town added a requirement that space be available to other non - profit groups who schedule meetings open to the public. This may be a lost cause - but you asked for suggestions at the Ground - Breaking, so 1 feel compelled to keep asking. It is unlikely that service to 11:00 pm will adversely impact the residential neighborhoods. There is only one home in close proximity to the Museum. The other homes are up the hill behind the Civic Center. In addition the Museum events are not known to be loud or boisterous. B. The Museum does not have a history of complaints regarding the ABP. C. The Museum provides a cultural benefit to the Town. Thank you.
