RESOLVED, the Memorandum of Understanding signed by the Town Representative and the President of the Los Gatos Police Officers` Association on May 13, 1975, is hereby approved. Smith Egon Jensen NOES: COUNCILMEN None ABSENT: COUNCILMEN None ATTEST: I CLERK ,`OWN 0 LOS GATOS MEMORANDUM OF UNDERSTANDING This Memorandwn of Understanding ( "Memorandum ") is made and entered into on the 13th day of May , 1975, between the Town of Los Gatos ( "Town ") and the Los Gatos Police Officers' Association ( "Association ") by the Town Employee Relations Representa- tive and the Association President, as a result of meeting and conferring under the provisions of the Meyers- Mil.ias -Brown Act. The Town and the Association agree: ARTICLE I Term 1. The term of this agreement shall be twelve (12) months coruencing July 1, 1_975 and ending June 30, 1976. ARTICLE II General 2. The Association is a recognized employee organization within the meaning of the Town's Employer- Employee Relations Resolution No. 1974 -4L. 3. The Association represents all employees in the Police Unit. This unit consists of the Town classifications of Police Officer and Police Sergeant. 4. The Association is the only employee organization which is entitled to meet and confer with th.e Town on behalf of represented employees in the Police Unit. 5. Representatives of the Town and the Association have met and conferred pursuant to the provisions of the Meyers- Milias -Brown Act and Resolution No. 1974 -41 for the purpose of reaching agreement concerning the salaries, wages, and supplemental benefits to be received by Town employees whom the Association represents during the term of this Memorandum of Understanding. 6. An agreement has been reached. 7. The Association agrees that it will not attempt to meet on any items within the scope of representation, as defined by the Meyers- Milias -Brown Act and Town Resolution No. 1974 -41, during the term of this Memorandum of Understanding. ARTICLE III Definition As used in this agreement: 8. The term "Personnel Rules" means those regulations titled "Town of Los Gatos Personnel. Rules and Regulations," enacted as Resolution No. 1965 -191 and as thereafter and hereafter amended. 9. The term "Salaries", "Wages ", or "Salaries and Wages" shal:L mean the gross monthly base pay prior to any deductions. 10. The term "PERS" means the Public Employees' Retirement System created by and administered under Title Z, Division 5, Part 3 of the Government Code. ARTICLE IV Salaries - Wages - Supplemental. Benefits A. Salaries and Wages 11. The salaries and wages paid by the Town to employees represented by the Association shall be paid according to the job classifications which they hold as follows: a. Effective July 1, 1975, the salary ranges in effect on June 30, 1975, shall be increased by five (5%) percent. (Prior to this increase, the temporary one -half percent reduction imposed -2- January 1, 1975, -to correct for Consumer Price Index errors will be restored to all salary ranges.) b. Effective January 1, 1976, the salary ranges in effect on December 31, 1975, shall be increased by -two (2%) percent. B. Supplemental Benefits 12. Effective July 1, 1975, the Town shall amend Rule XIII, Sec. 1(A), of the Personnel Rules to .provide that the Town will pay the full premium for the existing medical and hospitalization insurance for the employee and all eligible dependents. 13. Effective July 1, 1975, the Town shall amend Rule XIII, Sec. 1(B), of the Personnel Rules, to provide that the Town will contribute $12.00 per employee per month into the Dental Plan Fund. 14. Effective July 1, 1975, the Town shall amend. Rule XI, Sec. 10, of the Personnel Rules, and See-Lion 1 -13 of the Los Gatos Town Code to provide for the addition of Washington's Birthday as a paid holiday, with a corresponding change in the holiday pay proration for shift personnel. 15. Effective July 1, 1975,a -the Town shall amend Rule XI, Sec. 3, of the Personnel Rules to provide as follows: a. Payment for unused sick leave will be made upon retire- meat at age 55 or over, or at any age retirement. Payment will be made for accumulated sick leave at the rate of on the effective date of retirement. a Paragraph 15(a) shall also appl. during the month of April-, 1975. -3- in the case of disability up to eighty (80) days of one -half the base rate of pay to any individuals retiring b. The maximum allowable accumulation for sick leave will be increased from 130 to 150 days. Affected employees will begin to accumulate sick leave in excess of 130 days at the normal accumulation date when this provision becomes effective. 16. The Town and Association agree that an employee vote on with- drawal from Social Security will be held no later than March 1, 1976. In the event that the Town Council determines that a substantial majority of Town employees covered by Soeiai Security voted in favor of terminating Social Security coverage effective June 30, 1976, the Town will, effective July 1, 1976: a. Provide employees with, at the mi.njinum, the basic, unmodified Public Safety Retirement Plan (2% at 55 ) . Further, the Town will utilize any savings it realizes from any difference in cost between the current Social Security contributions plus PERS contributions, and the cost to the Town of the unmodified PERS plan described above, to provide optional improvements to the PERS contract for police. Such improve- ments will be subject to the mutual approval of a majority of PERS Public Safety members and the Town Council. 17. The Town and Association agree to conduct a joint study to determine the cost and benefit of the PERS Retirement Plan known as 112% at 50." 18. All other supplemental benefits provided for in the Personnel Rules on June 30, 1975, shall remain in effect for the term of this Memorandum of Understanding. ARTICLF. V Miscellaneous 19. Effective July 1, 1975, the Town shall allow any retiree to continue as a member of any Town medical, hospital, and /or dental plan in which they were enrolled. Membership shall be dependent upon the - LJ-- retiree paying all premiums to the Town in advance, and could con- tinue until the retiree or the retiree's spouse reaches age 65 (whichever occurs Latest). Any funds received as a result of the sick leave pay -out plan described in Paragraph 15(a) may be utilized to pay these premiums at retirees option. 20. No later than February 15, 1976, the Association shall provide the Town with its written requests on items within the scope of representation for -the period commencing July 1, 1976.
