RESOLVED, the Memorandum of Understanding signed by the Town Representative and the President of the Town Employees Assoeiation on May 9, 1975, is hereby approved. Smith Egon Jensen NOES: COUNCILMEN None ABSENT: COUNCILMEN None ?e� k +r CLERK \p T11F T WN , F LO GS ATOS MEMORANDUM OF UNDERSTANDING This Memorandum o_f Understanding ("Memorandum") is made and entered into on the 9th day of May , 1975, between the Town of Los Gatos ( "Town ") and the Town Employees Association ( "Assoei.ati.on") by the Town Employee Relations Representative and the Association President, as a result of meeting and conferring under the provisions of the Meyers - Milias -Brown Act. The Town and the Association agree: ARTICLE I Term 1. The term of this agreement shall be twelve (12) months commeneing July 1, 1975 and ending June 30, 1976. ARTICLE II General 2. The Association is a recognized employee organization within the meaning of the Town's Employer- Employee Relations Resolution No. 1974 -41. 3. The Association represents all employees in the Miscellaneous Unit and the Corporation Yard. Unit, except employees paid by the hour; temporary employees; and employees who work less than twenty (20) hours per week. All Town classifications except Police Officer, Police Sergeant, and those designated as Management employees in Resolution No. 1974 -4.1_, are included in these units. 4. The Association is the only employee organization which is entitled to meet and confer with the Town on behalf of represented employees in the Miscellaneous Unit and the Corporation Yard Unit. 5. Representatives of the Town and the Association have met and conferred pursuant -to the provisions of tine Meyers -Mil ids -Brown Act and Resolution No. 1974 -41 for the purpose of attempting to reach agreement eo.ncerning the salaries, wages, and supplemental benefits to be received by Town employees whom the Association represents during the term of this Memorandum of Understanding. 6. An agreement has been reached. 7. The Association agrees that it will not attempt to meet and confer on any items within the scope of representation, as defined by the Meyers -Milias -Brown Act and Town Resolution No. 1974 -41 during the term of this Memorandum of Understanding. ARTICLE III Definitions As used in this agreement: 8. The term "Personnel Rules" means those regulations titled "Town of Los Gatos Personnel Rules and Regulations," enacted as Resolution No. 1965 -191 and as thereafter and hereafter amended. 9. The term "Salaries ", "Wages", or "Salaries and Wages" shall mean the gross monthly base pay prior to any deductions. 1.0. The term "Town Retirement Plan" shall mean the Town of Los Gatos Retirement Plan created by and administered under Chapter 20 of the Los Gatos Town Code. 11. The term "PERS" means -the Public Employees' Retirement System created by and administered under Title 2, Division 5, Part 3 of the Government Code. ARTICLE IV Salaries - Wages - Supplemental Benefits A. Salaries and Wages 12. The salaries and wages paid by the Town to employees -2- represented by the Association shall be paid according to the job classifications which they hold, as follows: a. Effective July 1, 1975: the salary ranges in effect on June 30, 1975, shall be increased by $59.00 per month for full -time personnel. Represented one -half time personnel will receive an increase of $29.50 per month. (Prior to this increase, the temporary one -half percent reduction imposed January 1, 1975, to correct for Consumer Price Index errors will be restored to all salary ranges.) b. Effective January 1, 1976, the salary ranges in effect on December 31, 1.975, shall be increased by two (2"o percent. B. Supplemental Benefits 13. Effective July 1, 1975, the Town shall amend Rule XIII, Sec. 1(A), of the Personnel Rules to provide that the Town will pay the full. .premium for -the existing medical and hospitalization insurance for the employee and all eligible dependents. 14. Effective July 1, 1975, the Town shall amend Rule XIII, Sec. 1(B), of the Personnel Rules, to provide that the Town will contribute $12.00 per employee per month into the Dental Plan Fund. 15. Effective July 1, 1975, the Town shall amend Rule XI, Sec. 10, of the Personnel Rules, and Section 1 -13 of the Los Gatos Town Code, to provide for the addition of Washington `s Birthday as a paid holiday. 15. Effective July 1, 1975,a the Town shall amend Rule XI, See. 3, of the Personnel Rules -to provide as follows: aParagraph 16(a) shall also apply to any individuals retiring during the month of April, 1975. -3- a. Payment for unused sick leave will be made upon retire- meat at age 55 or over, or at any age in the case of disability retirement. Payment will be made for up to eighty (80) days of accumulated sick leave at the rate of one -half -the base rate of pay on the effective date of retirement. b. The maximum allowable accumulation for sick leave will be increased from 130 -to 150 days. Affected employees will begin to accumulate sick leave in excess of 130 days at the normal.. accumulation date when this provision becomes effective. 17. Effective July 1, 1975, the Town shall amend Rule XIII, Sec. 4(b), of the Personnel Rules to provide that represented personnel in the Corporation Yard Unit shall receive a $125.00 per year uniform allowance. This allowance shall be kept in an individualized account for each employee and may be used to purchase required uniform items subject to prior approval of type, style, nature and price by manage - went personnel designated by the Town Manager. Equipment Mechanic may continue -to utilize the existing laundry service, at their option. 18. The Town and Association agree that an employee vote on withdrawal from Social Security will be held no later than March 1, 1976. In the event that the Town Council determines that a substantial majority of Town employees covered. by Social Security voted in favor of terminating Social Security coverage effective June 30, 1976, the Town will, effective July 1, 1976: a. Provide employees in PERS with the basic, unmodified Miscellaneous Retirement Plan. Further, the Town will utilize any savings it realizes from the difference in the Town's cost between the -L.- current Social Security contributions plus PERS contributions, and the cost to the Town of the Unmodified PERS plan, to provide optional improvements to the PERS contract. Such improvements will be subject to the mutual approval of a majority of PERS miscellaneous members and the Town Council. b. For members of the Town Retirement Plan, the Town will agree -to either increase its contribution to the Town Plan by an amount equal to the current Social Security contribution (5.85 percent of first - $14,100 earned in any calendar year), or to contribute all or part of such money to any other investment program or supplemental retirement benefit mutually agreed to by the majority of the members of the Town Plan, Retirement Board, and the Town Council. 19. All other supplemental benefits provided for in the Personnel Rules on June 30, 1975, shall remain in effect for the term of this Memorandum of Understanding. ARTICLE V Miscellaneous 20. Effective July 1, 1975, the Town shall allow any retiree to continue as a member of any Town medical, hospital, and/or dental- plan in which they were enrolled. Membership shall be dependent upon the retiree paying premiums to the Town in advance, and could continue until the retiree or the reti.ree`s spouse reaches age 65 (whichever occurs latest). Any funds received as a result of the sick leave pay- out plan described in Paragraph 16(a) may be utilized to pay these premiums, at retiree's option. 21. Effective July 1, 1975, the following reclassifications shall take effect: -5- a. The existing Police Clerk - Matron 1, Range 5, shall. be reelassi.fi.ed to Police Clerk- Matron II, Range 7. b. Tile existing Secretary- Stenographer, Police Department, shall be reclassified to Police Clerk- Matron II, with no change in salary range. e. The existing Engineering Aide II, Range 18, shall be reclassified to Engineering Technician I, Range 21. d. The classification title of Head Gardener shall be changed to Park Foreman, with no change in salary range. e. The existing Equipment Operator- Mechanic shall be reclassified to Equipment Mechanic, with no change in salary range. 22. No later than February 1_5, 1975, the Association shall provide the Town with its written requests on items within -the scope of representation for the period commencing July 1, 1976. The Town and Association shall commence to meet a' onfer within thirty (30) days after that date.
