MinutesDRAFT Town Council Meeting 10/21/14 Item # MINUTES OF THE TOWN COUNCIL /PARKING AUTHORITY MEETING OCTOBER 7, 2014 The Town Council of the Town of Los Gatos conducted a Regular Meeting on Tuesday, October 7, 2014, at 7:00 p.m. CLOSED SESSION — 6:15 P.M. CS -1 CONFERENCE WITH LEGAL COUNSEL - EXISTING LITIGATION (Government Code Section 54956.9 [d][11) Name of Case: Saghari v. Town of Los Gatos MEETING CALLED TO ORDER AT 7:00 P.M. ROLL CALL Present: Mayor Steven Leonardis, Vice Mayor Marcia Jensen, Council Member Joe Pirzynski, Council Member Diane McNutt, Council Member Barbara Spector. Absent: None PLEDGE OF ALLEGIANCE Will Avery led the Pledge of Allegiance. The audience was invited to participate. PRESENTATIONS Mayor Leonardis presented the Small Business, Big Applause commendation to Thu Cates for her 7- Eleven store at N. Santa Cruz Avenue and Blossom Hill Road. CLOSED SESSION REPORT Robert Schultz, Town Attorney, stated Council met in Closed Session as duly noted on the agenda and there is no report. COUNCIL /TOWN MANAGER REPORTS Council Matters - Council Member Joe Pirzynski stated he attend the Valley Transportation Authority (VTA) Congestion Management Commission meeting, the VTA Board of Directors Workshop, the VTA Board of Directors meeting, the Metropolitan Transportation Commission meeting, and the Ad Hoc Alcohol and Entertainment Committee meeting with Mayor Leonardis. - Council Member Barbara Spector stated she and Council Member Diane McNutt attended the Council Policy Committee meeting. - Town Manager, Greg Larson, at the request of Council Member Barbara Spector, provided an update on the Rinconada Water Treatment Restoration project. He stated staff has been in contact with the Water District and there has been extensive neighborhood outreach. An additional Community Meeting has been scheduled for October 29 at the Water District office. A link will be added on the Town's website for the Water District that will provide information on the project. Council Matters — continued Mayor Steve Leonardis stated he attended the West Valley Mayors and Managers meeting. Manager Matters - Board and Commission recruitment continues and the application deadline is December 5 with interviews and appointments to occur later in December. - The Annual Community Garage Sale concludes on Saturday, October 11 and guides will be available on the website on Tuesday, October 8. Did You Know...? Jackie Rose, Community Outreach Coordinator, presented information on the Los Gatos Prepared program. CONSENT ITEMS (TO BE ACTED UPON BY A SINGLE MOTION) 1. Approve Council Minutes of September 16, 2014 2. Approve the Memorandum of Understanding between the Town of Los Gatos and Los Gatos Police Officers' Association for the period October 1, 2014 through September 30, 2016 and authorizing the Town Manager to execute the Memorandum of Understanding 3. Approve an amendment to the employment agreement between the Town of Los Gatos and the Town Manager for a 2% wage increase retroactive to July 1, 2014 4. Authorize the Town Manager to execute an agreement with Los Gatos - Saratoga Union High School District, Los Gatos Union School District, and LGS Recreation for additional School Resource Officer services for the period starting October 8, 2014 through June 30, 2015 5. Authorize the Town Manager to execute an agreement with the Los Gatos /Monte Sereno Police Foundation outlining services provided by the Foundation to the Town and the Town's support to the Foundation 6. Authorize the Town Manager to execute an agreement with All City Management Services, Inc., Los Gatos Union School District, Union School District for Crossing Guard Services for the period starting July 1, 2014 through June 30, 2018. 7. Old Library Re -Use Project 411 - 821 -2105 and HVAC Upgrades — Old Library Project 411 - 821 -2103 a. Authorize the Town Manager to execute a construction contract with California Plus Engineering, Inc. in an amount not to exceed $1,391,500.00 b. Authorize staff to execute future change orders to the construction contract as necessary in an amount not to exceed $136,650.00 c. Authorize an expenditure budget adjustment in the amount of $491,039 in the Old Library Re -Use Project 411 - 821 -2105 funded by a transfer of $211,039 from the Facilities Maintenance Internal Service Fund 633 and a transfer of $280,000 from the General Fund Non - Departmental Program; Town Council /Parking Authority October 7, 2014 Consent Items — continued d. and authorize an expenditure budget adjustment in the amount of $443,379 in the HVAC upgrades — Old Library Project 411-821-2103 funded by a transfer of $443,379 from the Facilities Maintenance Internal Service Fund 633 8. Planned Development Application PD -13 -002, General Plan Amendment GP -13- 001, Environmental Impact Report EIR -13 -003. Project Location: 375 Knowles Drive. Property Owner: County of Santa Clara. Applicant: KT Properties. Adopt an Ordinance amending the Town Code effecting a zone change from O To O:PD at 375 Knowles Drive. APN 406 -28 -032 MOTION: Motion by Mayor Steven Leonardis to approve the consent items. Seconded by Council Member Joe Pirzynski. VOTE: Motion passed unanimously on items 1 -7. Council Member Barbara Spector and Vice Mayor Marcia Jensen voting no on item #8. Council Member Joe Pirzynski continuing no vote on item #3 in the Minutes from the September 16, 2014 meeting. VERBAL COMMUNICATIONS Angela Doerner - Commented on the Almond Grove Street Resurfacing project. Scott Broomfield - Invited all interested persons to the Los Gatos Union School District Board meeting at Fisher School Library on October 14 at 6:30. The agenda includes Town Council candidates, review of the demographic study, review school boundary issues and processes, and a discussion and possible vote on the Fisher sports complex. John Shepardson - Commented on global warming. Stephanie Lahat - Invited all to participate in the Turkey Trot on November 28. PUBLIC HEARINGS 9. Planned Development Application PD -14 -003. Proiect Location: 15574, 15588 15602, 15615, 15630 15644, 15657, 15672, 15685 Shady Lane and 15315, 15310, 15330, 15343 15358, 15365, 15371 Santella Court and 15415 Santella Drive and 15675 15685 Gum Tree Lane (Located in the Highlands of Los Gatos Planned Development on Shady Lane East of Short Road). Property Owner /Applicant: Davidon Homes Town Council /Parking Authority October 7, 2014 Public Hearing Item #9 — continued Consider a request to modify the existing Planned Development (Ordinance 2147) to modify the requirement for exterior colors on property zoned HR- 2'h:PD. APNS 527 -09 -010 through 024 and 030 through 033 Joel Paulson, Planning Manager, presented the staff report. Dennis Razzari, applicant, spoke on the project. Opened the Public Hearing at 7:51 p.m. John Shepardson - Commented on the light reflective value impact on greenhouse gases. Rob Abrams - Commented in favor of the proposal. Jeff Thayer, applicant, addressed comments. Closed the Public Hearing at 7:58 p.m. Council discussed the matter. MOTION: Motion by Council Member Barbara Spector to return the application to staff to look at all exterior colors using pictures, paint chips, etc., with input from Mr. Cannon. Bring analysis back to Council indicating which sites are visible and to what extent and if the process to evaluate exterior colors is changed indicate to Council how the process can be memorialized for future developments. Seconded by Vice Mayor Marcia Jensen. VOTE: Motion passed unanimously. OTHER BUSINESS 10. Receive the Staff Report on Cut Through Traffic Matt Morley, Director of Parks and Public Works, presented the staff report. Opened Public Comment at 8:31 p.m. John Shepardson - Encouraged Council to explore every possible idea and creative solution. 4 Town Council /Parking Authority October 7, 2014 Other Business Item #10 — continued Bess Zientek - Commented on traffic congestion during non - commute time, accessibility for public safety vehicles and lack of enforcement for blocked intersections. Maria Ristow - Commented on the traffic congestion in Town during high impact incidents on the freeway. Closed Public Comment at 8:37 p.m. Council discussed the matter. Staff to bring forward to Council, as part of the strategic goals process and /or budget considerations, a number of possible work items to be considered. Recess was called at 8:50 p.m. Meeting reconvened at 8:58 p.m. 11. Complete Streets Project 411- 812 -0123 a. Provide guidance on scope and location of a Complete Streets Pilot Project b. Adopt a Council resolution supporting the Town's grant submittal to Caltrans for the 2015/16 Sustainable Transportation Planning Grant Lisa Petersen, Town Engineer, presented the staff report. Opened Public Comment at 9:24 p.m. John Shepardson - Commented on green bike lanes. Maria Ristow - Commented on the use and design of green bike lanes and requested a workshop with community stakeholders before a consultant is brought in. Jeff Loughridge - Commented on the need for safer multi -modal alternatives. Closed Public Comment at 9:33 p.m. Council discussed the matter. 5 Town Council /Parking Authority October 7, 2014 Other Business Item #11 — continued MOTION: Motion by Council Member Diane McNutt to adopt the resolution, with the revision to the third whereas to include the wording "up to $25,000 in Town costs," supporting the grant submission with the understanding that the Town, through the Transportation and Parking Commission or some other means, start the process of getting testimony on where the need is and staff may continue their work on determining where to put in green bike lanes, etc. Seconded by Vice Mayor Marcia Jensen. VOTE: Motion passed unanimously. MOTION: Motion by Vice Mayor Marcia Jensen to use the existing $100,000 to start a pilot program with green bike lanes with the focus around school areas: Blossom Hill Road, University to Roberts, Los Gatos Boulevard to Van Meter, Blossom Hill Road to Blossom Hill School; direct staff to do what needs to be done to begin the process of where to do undergrounding and bring back to Council the estimated costs; and return to Council with proposed bike lane paint locations, distances, configurations, and patterns to allow public comment as well. Seconded by Mayor Steven Leonardis. VOTE: Motion passed unanimously. 12. Report of the Los Gatos /Monte Sereno Police Services Contract Ad Hoc Committee Council Member Barbara Spector presented the staff report. Opened and Closed Public Comment at 10:08 p.m. Council discussed the matter. MOTION: Motion by Vice Mayor Marcia Jensen to opt for a combination of #2 and #4 and to direct staff to present the information that is indicated in #2 when it is available with a view to bringing it back for discussion in February with the strategic goals plan. Seconded by Mayor Steven Leonardis. VOTE: Motion passed unanimously.
