A RESOLUTION INITIATING PROCEEDINGS FOR THE
ANNEXATION OF CERTAIN UNINHABITED TERRITORY
DESIGNATED AS FARLEY ROAD NO. 3 TO THE TOWN OF LOS GATOS
On June 7, 1978, the Local Agency Formation Commission of the County
of Santa Clara, State of California, pursuant to a petition signed by
the owners of some of the property within the territory to be annexed,
approved the annexation of that hereinafter described area designated
as Farley Road No. 3 to the Town of Los Gatos and by their Resolution
No. 78 -97 directed the Town Council of the Town of Los Gatos to initiate
proceedings to annex said territory. This resolution has therefore been
prepared in conformance with Section 35220 of the Government Code of
the State of California.
THE TOWN COUNCIL OF THE TOWN OF LOS GATOS RESOLVES:
(a) A petition requesting this annexation (change of organization)
as authorized by Section 35110 of the Government Code, was submitted
to the Local Agency Formation Commission by Franklin J. Larson, an owner
of property within the proposed annexation.
(b) The territory proposed to be annexed is designated as Farley
Road No. 3 Annexation and the boundaries are described in the real
property description and map attached hereto marked Exhibits "A" and
"B," respectively.
(c) The territory proposed to be annexed is uninhabited as defined
by Section 35038 of the Government Code of the State of California as
determined by the Local Agency Formation Commission in its Resolution
No. 78 -97.
(d) The reason for the proposed annexation as set forth in the
proposal thereof submitted to the Local Agency Formation Commission
is to obtain municipal services and to allow construction of two single -
family dwellings on property located within the proposed annexation.
(e) The Local Agency Formation Commission's resolution of approval
did not specify any special terms or conditions for the proposed
annexation.
(f) On August 7, 1978, at the meeting of the Town Council beginning
at 7:30 p.m. in the Council Chambers of the Civic Center, 110 E. Main
Street, Los Gatos, California, a public hearing will be held during
which the Town Council will hear protests against the annexation by
any person holding real property within the territory.
(g) Since the territory is uninhabited, law provides that written
protests from registered voters (other than landowners) shall not be
received.
(h) Any owner of land within the territory proposed for annexation
may file a written protest against the annexation with the Town Clerk
at any time prior to the conclusion of the Town Council's hearing on
the proposed annexation.
The Town Clerk is directed to cause notice of the hearing on the
proposed annexation to be given as provided in Section 35055 of the
Government Code and said notice shall include all the information

specified in Section 35220 of the Government Code. The Town Clerk
shall also give mailed notice of the hearing as required by Section
35223 of the Government Code.
PASSED AND ADOPTED AT A REGULAR MEETING OF THE TOWN COUNCIL OF THE
TOWN OF LOS GATOS held on the 3rd day of July , 1978,
by the following vote:

All that real property situate in the County of Santa Clara, State
of California, described as follows:
Beginning at the most Westerly corner of Northeast No. 13 Annexation
to the Town of Los Gatos; thence South 19 049' West 254.10 feet to a
point on the centerline of Farley Road; thence along said centerline
South 57 054' East 25 feet, more or less, to the Northerly corner of
Farley Road No. 2 Annexation to the Town of Los Gatos; thence along
the Northeasterly line of last said annexation South 57 054' East 122
feet, more or less, to the Northeasterly corner of last said annexation,
said corner also being on the Northwesterly line of said Farley Road
No. l Annexation; thence along last said line Northeasterly 172 feet,
more or less to the intersection thereof with the Southwesterly line
of said Northeast No. 13 Annexation; thence along last said line North-
westerly 58 feet, more or less, to the Southwesterly corner of last
said annexation; thence along the Southwesterly line of last said
annexation North 19 049' East 80 feet, more or less, to an angle point
in last said line; thence along the boundary of last said annexation
North 57 054' West 98.00 feet to the point of beginning.
Containing .77 acre.
