RESOLUTION DETERMINING THE VALUE OF
WRITTEN PROTESTS, ORDERING TERRITORY
ANNEXED TO THE TOWN OF LOS GATOS SUBJECT
TO CONFIRMATION BY THE VOTERS, AND CALLING
A SPECIAL ELECTION -- LOS GATOS BOULEVARD NO. 5
(Gov. Code § §35227 -8, 35061, Elec.Code § §23300, 23312)
The matter of the annexation of the territory called
Los Gatos Boulevard No. 5 (which is described in the metes and
bounds description marked Exhibit "A" and shown on the map
marked Exhibit "B ", both of which are attached to this resolution)
was heard by the Town Council of the Town of Los Gatos on
March 5, 1979, April 16, 1979, June 4, 1979 and June 18, 1979.
The council finds:
1. The territory is one which is inhabited, as that
term is used in the Municipal Organization Act.
2. A written protest was filed by Thomas M. Yuki on
his own behalf and on behalf of others whom he was
authorized to represent, and not withdrawn.
3. The written protest was filed by owners of land
who own not less than 25 percent of the total assessed
value of land in the territory.
4. Written protest was not filed by 50 percent or
more of the registered voters in the territory.
5. An election may be held in another political
subdivision on the same day as the day that this
resolution sets for a special election, in the same
territory as that which is proposed for annexation,
or in territory that is partly the same. Under the
provisions of chapter 4, division 14, part 2.5
......... .
(§ §23301.5- 23314) of the Elections Code or Education
Code sections 5325 -5340 such election may be partially
or completely consolidated with the election called by
this resolution.
RESOLVED:
1. The Town Council orders the territory annexed to
the Town of Los Gatos subject to the confirmation by
the voters on the question.
2. A special election is called and the question of
whether the territory shall be annexed is submitted to
the voters residing in Los Gatos Boulevard No. 5.
3. The election will be held on November 6, 1979.
4. The Town Council requests that the governing body
of any political subdivision holding an election on the
same day in territory that is the same or partly the
same consolidate its election with the annexation
election, and provide that the canvass be made by any
body or official authorized by law to do so.
5. Precincts and polling places need not be designated
because the election is to be consolidated.
6. The vote required for confirmation is a majority
of the votes cast on the question.
PASSED at a regular meeting of the Town Council of the
Town of Los Gatos held on the 18tn day of June ,
