A RESOLUTION REVERSING A DECISION OF THE
TOWN PLANNING COMMISSION
WHEREAS, Peter Formosa has duly and regularly filed an appeal with
the Town Council, from a decision of the Town Planning Commission as follows:
Approval of Architecture and Site Application S -78 -12 for
an office building, 290 Saratoga Avenue.
WHEREAS, pursuant thereto, a public hearing with respect to said
appeal has been duly and regularly held by the Town Council; and
WHEREAS, the Town Council has determined that the decision of the
Town Planning Commission should be reversed.
NOW, THEREFORE, BE IT RESOLVED:
1. The decision of the Town Planning Commission, as hereinabove set-
forth, is hereby reversed as follows:
Appeal granted and application referred back to Planning Commission.
2. There was an error or abuse of discretion in the decision of the
Planning Commission in the following particulars: Planning Commission failed
to consider replacement of building on the lot and the barnlike appearance of
the building and failed to consider circulation.
PASSED AND ADOPTED AT A REGULAR MEETING OF THE TOWN COUNCIL OF THE
TOWN OF LOS GATOS this 15th day of May, 1978, by the following votes:

John B. Lochner, Peter W. Siemens & Mardi Gualtieri
NOES: COUNCIL MEMBERS: None
