RECOMMENDATION: Authorize the Town Manager to execute an agreement with Los Gatos - Saratoga Union High School District, Los Gatos Union School District, and LGS Recreation for additional School Resource Officer services for the period starting October 8, 2014 through June 30, 2015. BACKGROUND: The Town currently has an existing agreement with the Los Gatos - Saratoga Union High School District and the Los Gatos Union School District for a full time School Resource Officer (SRO) that works in the local schools with the costs shared between the two school districts and the Town. This agreement is in effect through June 30, 2015 and funds a full time police officer, including salary and benefits. The School Districts and Police Department have identified a need for additional SRO services to concentrate on duties that are not currently provided and /or are being provided to a lesser degree under the existing single SRO model; such as: • Take an active role in training the newly assigned SRO to better facilitate smooth integration into the high school and continue high level of response to school staff through active problem solving and collaborative dispositions • Unify emergency preparedness protocols and philosophies between Los Gatos High School, Los Gatos elementary /middle schools, District Offices, and the Nova transition program • Unify school violence and active shooter protocols and responses between Los Gatos elementary /middle schools, Los Gatos High School, District Offices and Nova PREPARED BY: MATT FRISBY Chief of Police Reviewed by: Town Manager ... "M"' "P" - 96U SRO.doe Attorney PAGE 2 MAYOR AND TOWN COUNCIL SUBJECT: AUTHORIZE THE TOWN MANAGER TO EXECUTE AN AGREEMENT WITH LOS GATOS- SARATOGA UNION HIGH SCHOOL DISTRICT, LOS GATOS UNION SCHOOL DISTRICT, AND LGS RECREATION FOR ADDITIONAL SCHOOL RESOURCE OFFICER SERVICES FOR THE PERIOD STARTING OCTOBER 8, 2014 THROUGH JUNE 30, 2015 SEPTEMBER 22, 2014 BACKGROUND (cont'd): • Incorporate social media awareness and cyber bullying education into the Nova curriculum • Provide security oversight to on -going construction projects at the high school and address associated complexities of displacing students from these locations during the lunch hour and after school • Be an additional asset in adhering to continued SRO expectations with an increasing school population providing better overall coverage at the elementary /middle schools, high school, district offices, and Nova In summary, the addition of 960 hours of SRO coverage between both the elementary and high school districts will provide both districts and the Town with the ability to better address a variety of known issues as detailed above, as well as unforeseen matters that inevitably arise each school year. DISCUSSION: One of the Town Council's 2014 -16 Strategic Goals is to "Expand community partnerships for crime prevention and response." The proposal, agreed to by the school districts and LGS Recreation, would further expand the Police Department's partnership to better serve Los Gatos youth. Approval of this item will provide the equivalent of 960 hours (e.g., 120 8 -hour days) this academic year at a cost of $15,000 per school district, $10,000 from LGS Recreation, and $10,000 from the Town. The model would allow for an increase in the above specified services and continue the Department's commitment to proactively engage with the youth of our community through involvement with the schools. CONCLUSION: Staff recommends that the Town Council authorize the Town Manager to execute an agreement with the Los Gatos - Saratoga Union High School District, the Los Gatos Union School District, and LGS Recreation for additional School Resource Officer services for the period beginning October 8, 2014 through June 30, 2015. ENVIRONMENTAL ASSESSMENT: The agreement is not a project defined under CEQA, and no further action is required. The funding from the Town will come from the Police Department FY 2014/15 adopted budget using vacancy and other savings. No additional funding is requested for this agreement. Attachments: 1. THIS AGREEMENT is dated for identification this 22`h of September, 2014 and is made by and between TOWN OF LOS GATOS, a California municipal corporation, ( "Town ") and LOS GATOS — SARATOGA UNION HIGH SCHOOL DISTRICT ( "High School District "), LOS GATOS UNION SCHOOL DISTRICT ( "Los Gatos Union "), and LGS RECREATION ( "Recreation "). This Agreement is made with reference to the following facts. This contract will remain in effect from October 8, 2014 to June 30, 2015. I. RECITALS 1.1 Town, High School District, Los Gatos Union, and Recreation desire to formally establish and confirm the framework for a shared funding strategy to provide an additional 960 hours of School Resource Officer services. 1.2 Town, High School District, Los Gatos Union, and Recreation, NOW, THEREFORE in consideration of the recitals and mutual promises contained herein it is agreed as follows: II. AGREEMENTS 2.1 Funding (1) All Parties agree to provide funding for the additional 960 hour school resource office on an annual basis, to cover expenses including the hourly wage of $51.71. All Parties shall contribute toward the total overall cost of the additional School Resource Office as follows: • High School District $15,000 • Los Gatos Union $15,000 • Recreation $10,000 • Town $10,000 (2) Beginning October 8, 2014, Town shall invoice High School District, Los Gatos Union, and Recreation for the School Resource Officer's time. All invoices are due upon receipt. 2.2 Town Employs While assigned to the additional School Resource Officer position, Town employees so assigned shall remain exclusively the employees of the Town. The provisions of this section shall survive the termination of this Agreement. ATTACHMENT 1 2.3 Term and Termination of Agreement (1) This agreement shall take effect October 8, 2014 and remain in effect through June 30, 2015, unless terminated as set forth in this Agreement. (2) All Parties have the right to terminate this agreement, with or without cause. The terminating party must give all other parties 30 days prior written notice thereof. (3) Notice of termination, in writing, may be issued by the Police Chief or Superintendents of the respective entities. If one or more schools terminate, each terminating school shall remain liable for any unpaid monthly obligation incurred prior to or after the termination through the end of that fiscal year for services rendered by the Town, pursuant to this Agreement. 2.4 Indemnification /Hold Harmless None of the respective Parties, their respective Boards, board members, Town Councils, council members, employees, officers, agents and assigns shall be responsible for any damage or liability occurring by reason of anything done or omitted to be done by other parties arising from this Agreement. Each party to the agreement will hold all other parties harmless. 2.5 Reporting Requirements The Town will present an annual report to the Board of Trustees of Los Gatos Union, the High School District, and Recreation by the end of the school year, or as soon as possible following the school year. This report will inform the Boards about services provided to Los Gatos Union, the High School District, and Recreation throughout the year, both on site at the elementary and middle school and at Los Gatos High School and in the neighboring community. This report will be presented by the Chief of Police or Designee and the School Resource Officers. 2.6 Entire Agreement This Agreement represents the entire agreement between Los Gatos Union, the High School District, Recreation, and Town.
