1987-042 - Amendments to the General PlanRESOLUTION NO. 1987 -42 TOWN OF LOS GATOS A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS CONCERNING AMENDMENTS TO THE GENERAL PLAN WHEREAS, pursuant to Government Code Section 65353, the Town Council conducted a public hearing for consideration of amendments to the Los Gatos General Plan on January 5, January 26 and February 23, 1987. WHEREAS, during these hearings the Town Council considered all of the items shown in Resolution No. 86 -7 and Resolution No. 87 -2 of the Planning Commission. WHEREAS, the amendments included in this Resolution shall be considered General Plan Amendment No. 1 for 1987. RESOLVED: The Town Council finds that General Plan Amendments GP -86 -1 and GP -87 -1 will not have a significant impact on the environment and makes the Negative Declaration. FURTHER RESOLVED: The Town Council finds that Los Gatos General Plan Amendment GP -86 -1 and GP -87 -1: (a) are internally consistent with the Town of Los Gatos General Plan, and (b) that all proceedings have been conducted in compliance with the provisions of Government Code Section 65350 et seq. FURTHER RESOLVED: The Town Council hereby amends the General Plan Land Use Plan for the property located at High School Court and Church Street as shown in Exhibit A. Secondary Units A Secondary Unit shall be defined as a permanent structure with separate entrance, bath and kitchen facilities. A Detached secondary unit is physically separate from the main unit. The Town shall concentrate its efforts in identifying existing secondary units and the development of a realistic program to assure that all units existing on June 1, 1983 meet health and safety codes. This program shall be implemented before processing applications for new secondary units. (2) The secondary unit may not be sold as a separate unit. (3) New secondary units may be allowed with a Conditional Use Permit in all zones except the HR and RC Zones. (4) No more than two existing secondary units may be allowed to remain on a lot. There shall not be more than one new secondary unit on a lot. (5) Minimum lot size, maximum unit size and maximum number of persons (restrictions) as established below shall be utilized to regulate all new secondary dwelling units: Minimum lot size Interior 10,000 sq.ft. Attached 12,000 sq. ft. Detached 15,000 sq. ft. Maximum Unit Size Maximum Persons 750 sq.ft. 1 750 sq. ft. 1 900 sq. ft. 2 (6) The Town Council shall establish application fees as low as possible for existing secondary units. (7) No exceptions to any Codes will be allowed for new secondary units. (8) Adequate off - street parking shall be required for cars belonging to occupants of new secondary units.
