Draft Housing ElementtowN of MEETING DATE: 09/02/14 ITEM NO. 10 tos sAtos COUNCIL AGENDA REPORT DATE: AUGUST 25, 2014 TO: MAYOR AND TOWN COUNCIL FROM: GREG LARSON, TOWN MANAGER SUBJECT: ADOPT A RESOLUTION AUTHORIZING SUBMITTAL OF THE DRAFT HOUSING ELEMENT TO THE CALIFORNIA HOUSING AND COMMUNITY DEVELOPMENT DEPARTMENT FOR ITS 60 -DAY REVIEW. RECOMMENDATION: Adopt a resolution authorizing submittal of the draft Housing Element to the California Housing and Community Development Department for its 60 -day review. BACKGROUND: The Town is required to prepare an updated General Plan Housing Element for the period covering 2015 -2023 for adoption by the Town Council no later than January 31, 2015. After adoption, it is submitted to the California Department of Housing and Community Development (HCD) for consideration for certification. The updated Housing Element is required to show how the Town intends to accommodate the housing needs of its residents and local businesses for the upcoming eight years and includes policies to facilitate the planning for these units. On February 3, 2014, the Town Council authorized the creation of a 13- member Housing Element Advisory Board (HEAB) to facilitate public outreach and community involvement in the update of the Town's Housing Element. The members include the 9- member General Plan Committee and four additional residents from geographically distributed neighborhoods Town -wide. The Board has held a series of eight public meetings from March to August 2014 to review the existing Housing Element, consider the Town's projected housing needs for the next eight years, identify potential housing sites, review the draft updated Element, and comment on the draft Housing Element document. PREVETTI II�u� �z� Assistant Town Manager / )Director of Communit' y Development Reviewed by: N/A Assistant Town Manager P—b— Town Attorney ��Finance N:\DEV\TC REPORTS\2014 \Authorize Housing Element submittal 2014 .doc Reformatted: 5/30/02 PAGE 2 MAYOR AND TOWN COUNCIL SUBJECT: SUBMITTAL OF DRAFT HOUSING ELEMENT AUGUST 25, 2014 On August 21, 2014, the Board recommended approval of the draft 2015 -2023 Housing Element (Exhibit A of Attachment 1) to the Planning Commission and Town Council along with two items to consider separately from the Housing Element update, possibly as part of Council's annual Strategic Goals discussion or as a future General Plan update: Completion of an assessment of the needs for housing for households earning between 120 and 200% of County median income (i.e., "workforce" or entry level housing) and determine policies, potential Code changes, and programs to meet this need. • Examining the jobsihousing balance in the Town and identify actions to address any concerns DISCUSSION: The attached resolution authorizes the transmittal of the draft 2015 -2023 Housing Element to the State Department of Housing and Community Development (HCD) to initiate the formal 60 -day review process. The Town's update document is eligible for a streamlined 60 -day review by HCD rather than the typical standard review (which may often take multiple years) because of the Town's previous efforts in preparing the certified 2007 -2014 Housing Element and the work undertaken by the Planning Commission and Town Council in 2013 to implement many of its provisions. Staff anticipates receiving comments from HCD in a timely manner and the draft document is also available for additional public review and comment. The Town Council is welcome to provide its comments on the draft Element at this meeting or at a later date. Staff will then prepare any necessary revisions to the draft Housing Element. The HEAB will reconvene if needed. The Planning Commission and Town Council are anticipated to hold public hearings on the Housing Element in late Fall 2014. After Council adoption, the Element will be sent to HCD for certification. Alternatives are not being provided for this item because the Housing Element will be returning to the Planning Commission and Town Council at public hearings this fall. Potential issues and comments will be reviewed and brought back for consideration at that time. CONCLUSION: Adoption of the resolution allows the Town to transmit the draft 2015 -2023 Housing Element to the State for its review. This is a time sensitive matter given that the Town's public hearings should not occur until after HCD provides its comments. The FY2014- 2015 adopted budget includes funding for approximately $180,000 for the preparation of the draft Housing Element update and retention of consultants. ENVIRONMENTAL ASSESSMENT: The transmittal of the Housing Element document to the State is not a project under the California Environmental Quality Act (CEQA). Attachments: 1. Draft Resolution with Exhibit A: Draft 2015 -2023 Housing Element LRP:EO:cg THIS PAGE INTENTIONALLY LEFT BLANK RESOLUTION 2014- RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS AUTHORIZING SUBMITTAL OF THE DRAFT 2015 -2023 HOUSING ELEMENT TO THE CALIFORNIA HOUSING AND COMMUNITY DEVELOPMENT DEPARTMENT FOR ITS 60 -DAY REVIEW WHEREAS, the Town of Los Gatos is required by the State Housing Element Law to prepare an update of its existing State Certified Housing Element in 2014; and WHEREAS, the Housing Element must be submitted to the State Department of Housing and Community Development for review and comment prior to the Town Council considering its adoption; and WHEREAS, the updated Housing Element must include plans and policies to show how Los Gatos plans to accommodate the estimated housing needs of the community for the next eight year period; and WHEREAS, on February 3, 2014, the Town Council authorized the creation of a 13- member Housing Element Advisory Board to facilitate public outreach and community involvement in the update of the Town's Housing Element; and WHEREAS, the Housing Element Advisory Board has held a series of eight public meetings from March to August 2014 to review the existing Housing Element, consider the Town's projected housing needs for the next eight year period, identify potential housing sites, review proposed revisions, and consider recommendations that have been included in the draft Housing Element document; and ATTACHMENT I WHEREAS, on August 21, 2014 the Housing Element Advisory Board recommended approval of the draft 2015 -2023 Housing Element to the Planning Commission and Town Council; and NOW, THEREFORE, BE IT RESOLVED, that Town Council of the Town of Los Gatos does hereby authorize the Town Manager to submit the Draft 2015 -2023 Housing Element, as noted in Exhibit A, to the State Department of Housing and Community Development to begin the formal, 60 -day review of the Town's Housing Element update.
