RECOMMENDATION:
Adopt a Resolution (Attachment 1) authorizing the filing of the Regional Active Transportation
grant application for the Highway 9 -Los Gatos Creek Trail connection.
BACKGROUND:
In September 2013, California State Governor Brown created the Active Transportation Program
(ATP), which consolidates bicycle and pedestrian oriented funding into one statewide program.
One of the goals of restructuring this program is to provide a broad spectrum of projects that will
increase safety and mobility for non - motorized users. As a result of this modification,
approximately $10 million of competitive grant funding is available for the San Francisco Bay
Area region for bicycle and pedestrian related projects. The Metropolitan Transportation
Commission (MTC) is the regional agency responsible for the management of the ATP regional
competitive grant program. If an agency or municipality is awarded the grant, the agency is
required to provide an 11.47% match of local funds.
The Town submitted a grant application to MTC for the Highway 9 Pathway Connection to Los
Gatos Creek Trail project. This project is included in the adopted FY 2014/15- 2018/19 Capital
Improvement Program Budget. This proposed project will construct a pathway and bridge to
allow non - motorized users direct access to the Los Gatos Creek Trail from Highway 9.
As part of the grant application packet, a Town Council resolution of local support is required.
The grant deadline date was in late July. Because this project is part of the approved CIP budget,
staff submitted a grant proposal request ahead of the deadline.

During the month of July, Town Council was on summer recess and therefore a resolution could
not be reviewed. MTC allows municipal agencies to submit the Council resolution portion of the
grant application documents after the grant application deadline date in such circumstances.
DISCUSSION:
The proposed concept for the Highway 9 Pathway Connection to Los Gatos Creek Trail project
will provide pedestrian and bicycle access to State Highway 9 via the construction of a new
bridge and pathway. A new bridge and pathway will be constructed across the Los Gatos Creek
south of Highway 9, connecting eastbound pedestrians and bicyclists on Highway 9 to the Los
Gatos Creek Trail on the east side of the creek. For westbound bicycle and pedestrians, a new
pathway will be constructed on the north side of Highway 9 at the site of an existing informal
trail. The project will also design and construct a quarter mile of Class II bicycle lanes along the
Highway 17 overpass. Additionally, improvements and upgrades will be made to the existing
infrastructure to achieve compliance with safety and accessibility standards.
Town staff contacted several agencies, schools, and nearby municipalities to engage support for
this project. Caltrans, the Los Gatos Union School District, Santa Clara Valley Transportation
Authority and the cities of Saratoga and Monte Sereno, are some examples of letters of support
received for this project, and were submitted as part of the grant application.
Should the grant be approved, staff would retain a consultant to provide preliminary engineering
and design studies for the bridge and pathway connection. Staff will present these plans to the
Bicycle Advisory Committee and the Transportation and Parking Commission for input. Final
design and construction plans will be presented to Council following this process.
The Town has allocated $500,000 towards the Highway 9 Pathway Connection to Los Gatos
Creek Trail through the adopted FY 2014/15 — 2018/19 Capital Improvement Program Budget.
This amount will be used towards the 11.47% local match requirement. The total estimated cost
of the project is $1,214,000. The grant application proposal request is for $714,000.
CONCLUSION:
It is recommended that the Town Council adopt the attached Resolution authorizing the filing of
the Regional Active Transportation grant application for the filing of the Regional Active
Transportation grant application for the Highway 9 -Los Gatos Creek Trail connection.
ENVIRONMENTAL ASSESSMENT:
The recommended action is not a project as defined under CEQA, and no further action is
required. CEQA review would be conducted as part of the project design.

AUTHORIZING THE FILING OF THE REGIONAL ACTIVE TRANSPORATION
GRANT APPLICATION FOR THE HIGHWAY 9 -LOS GATOS CREEK TRAIL
CONNECTION
WHEREAS, the Town of Los Gatos (herein referred to as APPLICANT) is submitting
an application to the Metropolitan Transportation Commission (MTC) for $714,000 in funding
assigned to MTC for programming discretion, which includes federal funding administered by
the Federal Highway Administration (FHWA) and federal or state funding administered by the
California Transportation Commission (CTC) such as Surface Transportation Program (STP)
funding, Congestion Mitigation and Air Quality Improvement (CMAQ) funding, Transportation
Alternatives (TA) /Active Transportation Program (ATP) funding, and Regional Transportation
Improvement Program (RTIP) funding (herein collectively referred to as REGIONAL
DISCRETIONARY FUNDING) for the Highway 9 Pathway Connection to Los Gatos Creek
Trail (herein referred to as PROJECT) for the Regional Active Transportation Program (herein
referred to as PROGRAM); and
WHEREAS, the Town of Los Gatos is committed to building this PROJECT, and
approved $500,000 in Capital Improvement Program (CIP) funds in the Town's FY 2014/15 —
FY 2018/19 CIP Budget for this PROJECT.
WHEREAS, the Moving Ahead for Progress in the 21" Century Act (Public Law 112-
141, July 6, 2012) and any extensions or successor legislation for continued funding
(collectively, MAP 21) authorize various federal funding programs including, but not limited to
the Surface Transportation Program (STP) (23 U.S.C. § 133), the Congestion Mitigation and Air
Quality Improvement Program (CMAQ) (23 U.S.C. § 149) and the Transportation Alternatives
Program (TA) (23 U.S.C. § 213); and
WHEREAS, state statutes, including California Streets and Highways Code §182.6,
§182.7, and §2381(a)(1), and California Government Code §14527, provide various funding
programs for the programming discretion of the Metropolitan Planning Organization (MPO) and
the Regional Transportation Planning Agency (RTPA); and
WHEREAS, pursuant to MAP -21, and any regulations promulgated thereunder, eligible
project sponsors wishing to receive federal or state funds for a regionally- significant project shall
submit an application first with the appropriate MPO, or RTPA, as applicable, for review and

inclusion in the federal Transportation Improvement Program (TIP); and
WHEREAS, MTC is the MPO and RTPA for the nine counties of the San Francisco Bay
region; and
WHEREAS, MTC has adopted a Regional Project Funding Delivery Policy (MTC
Resolution No. 3606, revised) that sets out procedures governing the application and use of
REGIONAL DISCRETIONARY FUNDING; and
WHEREAS, APPLICANT is an eligible sponsor for REGIONAL DISCRETIONARY
FUNDING; and
WHEREAS, as part of the application for REGIONAL DISCRETIONARY FUNDING,
MTC requires a resolution adopted by the responsible implementing agency stating the
following:
• the commitment of any required matching funds; and
• that the sponsor understands that the REGIONAL DISCRETIONARY FUNDING is
fixed at the programmed amount, and therefore any cost increase cannot be expected
to be funded with additional REGIONAL DISCRETIONARY FUNDING; and
• that the PROJECT will comply with the procedures, delivery milestones and funding
deadlines specified in the Regional Project Funding Delivery Policy (MTC
Resolution No. 3606, revised); and
• the assurance of the sponsor to complete the PROJECT as described in the
application, subject to environmental clearance, and if approved, as included in
MTC's federal Transportation Improvement Program (TIP); and
• that the PROJECT will have adequate staffing resources to deliver and complete the
PROJECT within the schedule submitted with the project application; and
• that the PROJECT will comply with all project- specific requirements as set forth in
the PROGRAM; and
• that APPLICANT has assigned, and will maintain a single point of contact for all
FHWA- and CTC- funded transportation projects to coordinate within the agency and
with the respective Congestion Management Agency (CMA), MTC, Caltrans.
FHWA, and CTC on all communications, inquires or issues that may arise during the
federal programming and delivery process for all FHWA- and CTC - funded
transportation and transit projects implemented by APPLICANT; and
• in the case of a transit project, the PROJECT will comply with MTC Resolution No.
3866, revised, which sets forth the requirements of MTC's Transit Coordination
Implementation Plan to more efficiently deliver transit projects in the region; and
• in the case of a highway project, the PROJECT will comply with MTC Resolution
No. 4104, which sets forth MTC's Traffic Operations System (TOS) Policy to install
and activate TOS elements on new major freeway projects; and
• in the case of an RTIP project, state law requires PROJECT be included in a local
congestion management plan, or be consistent with the capital improvement program
adopted pursuant to MTC's funding agreement with the countywide transportation
agency; and
WHEREAS, that APPLICANT is authorized to submit an application for REGIONAL
DISCRETIONARY FUNDING for the PROJECT; and
WHEREAS, there is no legal impediment to APPLICANT making applications for the
funds; and
WHEREAS, there is no pending or threatened litigation that might in any way adversely
affect the proposed PROJECT, or the ability of APPLICANT to deliver such PROJECT; and
WHEREAS, APPLICANT authorizes its Executive Director, General Manager, or
designee to execute and file an application with MTC for REGIONAL DISCRETIONARY
FUNDING for the PROJECT as referenced in this resolution; and
WHEREAS, MTC requires that a copy of this resolution be transmitted to the MTC in
conjunction with the filing of the application.
RESOLVED that the APPLICANT is authorized to execute and file an application for
funding for the PROJECT for REGIONAL DISCRETIONARY FUNDING under MAP -21 or
continued funding; and
BE IT FURTHER RESOLVED that APPLICANT will provide any required matching
funds.
BE IT FURTHER RESOLVED that APPLICANT understands that the REGIONAL
DISCRETIONARY FUNDING for the project is fixed at the MTC approved programmed
amount, and that any cost increases must be funded by the APPLICANT from other funds, and
that APPLICANT does not expect any cost increases to be funded with additional REGIONAL
DISCRETIONARY FUNDING.
BE IT FURTHER RESOLVED that APPLICANT understands the funding deadlines
associated with these funds and will comply with the provisions and requirements of the
Regional Project Funding Delivery Policy (MTC Resolution No. 3606, revised) and
APPLICANT has, and will retain the expertise, knowledge and resources necessary to deliver
federally- funded transportation and transit projects, and has assigned, and will maintain a single
point of contact for all FHWA- and CTC- funded transportation projects to coordinate within the
agency and with the respective Congestion Management Agency (CMA), MTC, Caltrans.
FHWA, and CTC on all communications, inquires or issues that may arise during the federal
programming and delivery process for all FHWA- and CTC - funded transportation and transit
projects implemented by APPLICANT.
BE IT FURTHER RESOLVED that PROJECT will be implemented as described in the
complete application and in this resolution, subject to environmental clearance, and, if approved,
for the amount approved by MTC and programmed in the federal TIP.
BE IT FURTHER RESOLVED that APPLICANT has reviewed the PROJECT and has
adequate staffing resources to deliver and complete the PROJECT within the schedule submitted
with the project application.
BE IT FURTHER RESOLVED that PROJECT will comply with the requirements as
set forth in MTC programming guidelines and project selection procedures for the PROGRAM.
BE IT FURTHER RESOLVED that, in the case of a transit project, APPLICANT
agrees to comply with the requirements of MTC's Transit Coordination Implementation Plan as
set forth in MTC Resolution No. 3866, revised; .
BE IT FURTHER RESOLVED that, in the case of a highway project, APPLICANT
agrees to comply with the requirements of MTC's Traffic Operations System (TOS) Policy as set
forth in MTC Resolution No. 4104.
BE IT FURTHER RESOLVED that, in the case of an RTIP project, PROJECT is
included in a local congestion management plan, or is consistent with the capital improvement
program adopted pursuant to MTC's funding agreement with the countywide transportation
agency.
BE IT FURTHER RESOLVED that APPLICANT is an eligible sponsor of
REGIONAL DISCRETIONARY FUNDING funded projects.

Wraight Avenue, and between State Route 9 /Saratoga -Las Gatos Road and the Los Gatos Creek Trail.

PROJECT DESCRIPTION
The Highway 9 Pathway Connectlon to Los Gatos Creek Trail project will provide pedestrian and bicycle access to
SR 9, an important east -west link for bicyclists and pedestrians that provides one of only a few connections
across SR 17 in the Town of Los Gatos and the surrounding communities. The Los Gatos Creek Trail extends from
downtown San Jose to Lexington Reservoir south of the Town of Los Gatos. The trail follows along the north -
south waterway and is approximately 11 miles long. At the proposed project location, the trail runs along on the
east side of the creek, traveling below but not connecting to SR 9, as seen in Figure 1 in Part 1 of this application.
The project will design and construct a bridge and pathway across Los Gatos Creek south of SR 9, connecting
eastbound pedestrians and bicyclists on SA 9 to the Los Gatos Creek Trail on the east side of the creek. For
westbound bicycles and pedestrians, a pedestrian pathway will be constructed on the north side of SR 9 at the
site of an existing informal trail. The project will also design and construct a quarter mile of Class it bicycle lanes
along the Highway 17 overpass. The project will upgrade existing pedestrian facilities to match ADA regulations
and improve sight distance along the Highway 17 on- and off - ramps. Pedestrian crossing enhancements will
increase pedestrian safety and comfort through curb extensions, high visibility crosswalks, and advanced
pedestrian warning signs along SR 9 between Santa Cruz Avenue and Alberto Way. This project increases safety
and mobility for non - motorized users and enhances connectivity across a state highway.
A full list of project elements is below; Figure 2 provides a conceptual layout of project improvements.
LIST OF PROJECT ELEMENTS
The following items will be included as part of this proposed project.
Trail Connections (trail spurs and bridge
• Design and construct a trail connection, consisting of a paved Class I shared -use path and
bicycle /pedestrian bridge, from eastbound SR 9 across Los Gatos Creek to the Los Gatos Creek Trail;
• Design and construct a trail connection (trail spur) connecting westbound SR 9 with the Los Gatos Creek
Trail, on the site of the existing informal pedestrian path;
• Extend south sidewalk on SR 9 approximately 200' west to connect with the proposed Class I spur to Los
Gatos Creek Trail;
• Provide a bicycle ramp from the eastbound SR 9 bicycle lane to the proposed Class I path spur;

Provide a bicycle ramp between the westbound bicycle lane and the proposed multi -use trail spur on
the north side of SR 9.
SR 9 Corridor
• Stripe and sign a westbound Class 11 bicycle lane between the proposed multi -use trail spur on the north
side of SR 9 and Wraight Avenueincluding dashed bicycle lane extension through the intersection at Wraight
Avenue and a bicycle ramp connecting the proposed bicycle lane and proposed trail spur;
Stripe and sign an eastbound bicycle lane from University Avenue to the proposed multi -use trail spur
on the south side of SR 9, including a bicycle ramp connecting the proposed bicycle lane and proposed trail spur;
Provide curb extensions on the northwest and northeast corners with directional ADA curb ramps at the
intersection of Wraight Avenue and SR 9 to shorten pedestrian crossing distance. Improvements currently under
construction will convert Wraight Avenue to right -in -right -out operations, reducing the need for a dedicated
southbound left turn lane at this location;
• Construct new ADA - compliant curb ramps (total of four curb ramps)and high- visibility ladder crosswalk
striping at the SR 17 southbound on- and off - ramps;
e Construct new ADA - compliant curb ramps (total of four curb ramps) and high - visibility ladder crosswalk
striping at the SR 17 northbound on- and off - ramps;
Relocate "DO NOT ENTER" and "WRONG WAY" signs next to crosswalk and trim foliage along the SR 17
SR Off -Ramp to enhance pedestrian visibility;
Extend /reconstruct sidewalk on the north side of SR 9 between the SR 17 southbound on ramp and off
ramp to create a curb parallel to the edge of traveled way;
• Replace existing rolled curb with vertical curb along north side at the SR 17 NR on ramp (if applicable
with turning movements of California standard trucks and school buses).
PROJECT STATUS
Conceptual design and public outreach for the trail connection and improvements along SR 9 have been
completed. Environmental clearance in compliance with the California Environmental Quality Act (CEQA) has not
been completed.
