RECOMMENDATION:
Adopt a resolution certifying the June 3, 2014 Gubernatorial Primary Election and declaring the election
results.
BACKGROUND:
On October 23, 2013, a Notice of Intent to Circulate a Petition titled Amend the Los Gatos General Plan
and Zoning Code and Adopt a Specific Plan for Development of 90 -160 Albright Way and 14600
Winchester Boulevard was filed with the Town's Election Official.
On December 11, 2013, LezLi Logan and Phillip Albanese, proponents of the initiative, filed with the
Elections Official the petition containing a total number of 4,113 signatures. On December 12, 2013, the
petition was delivered by the Elections Official to the Santa Clara County Registrar of Voters Office for
signature verification. On January 22, 2014, the Santa Clara County Registrar of Voters Office notified
the Town that the proposed initiative had received 3,020 valid signatures, not less than 15% of the
registered voters in the Town.
The Town has received certification of the June 3, 2014 Gubernatorial Primary Election from the Santa
Clara County Registrar of Voters. Also received were the election results which included the total
number of votes for Measure A.

JULY 24, 2014
DISCUSSION:
In accordance with the provisions of California Elections Code Section 10260 and as directed by
Resolution 2014 -002 of the Los Gatos Town Council, the Santa Clara County Registrar of Voters has
completed the official canvass of returns of the June 3, 2014 Special Election, which was consolidated
with the Statewide Gubernatorial Primary Election. The Certificate of Election Results and a copy of the
Official Canvass are included as Exhibit A of the resolution.
CONCLUSION:
After accepting the Elections Official's certification of the election results, Council should adopt the
resolution.
ENVIRONMENTAL ASSESSMENT:
Is not a project defined under CEQA, and no further action is required.
FISCAL IMPACT:
The actual cost to the Town for holding a consolidated election is $54,856.00 which is covered in the
adopted operating budget under account 1201 -62227 and the Town will be reimbursed the total cost per
the agreement with Los Gatos Citizens for Responsible Development and Los Gatos Business Park,
LLC.

RESOLUTION OF THE TOWN COUNCIL
OF THE TOWN OF LOS GATOS
DECLARING THE ELECTION RESULTS
OF THE SPECIAL ELECTION OF JUNE 3, 2014
WHEREAS, the Santa Clara County Registrar of Voters held a Gubernatorial Primary
Election in the Town of Los Gatos on Tuesday, the 3'a day of June, 2014, in accordance with the
laws of the State of California governing the elections of General Law Cities; and,
WHEREAS, Shannon Bushey, Santa Clara County Registrar of Voters, declared that at
the Statewide Gubernatorial Primary Election held on June 3, 2014, and consolidated therewith, a
Special Election was held in the TOWN OF LOS GATOS for the purpose of voting on one
initiative measure in the Town of Los Gatos and; and,
WHEREAS, the Santa Clara County Registrar of Voters canvassed the results of said
Elections in accordance with applicable provisions of the California Elections Code of the State
of California; and,
WHEREAS, attached is the Certification of the Election (Exhibit A) as well as the
Statement of Votes Cast and final official summary results (Exhibit B), which shows the whole
number of votes cast in the Town, and
WHEREAS, the total number of registered voters was 18,544 and the total number of
ballots cast was 7,109, including absentee and write -in ballots.
NOW THEREFORE BE IT RESOLVED that I, Shelley Neis, Clerk Administrator for
the Town of Los Gatos, hereby certify the election of:
Measure A — Shall the Town's General Plan, General Plan Land Use Map, and Zoning
Code and Map be amended and shall the Albright Specific Plan be adopted to provide

I, Shannon Bushey, Registrar of Voters of the County of Santa Clara, State of
California, hereby declare:
1. A Gubernatorial Primary Election was held in the County of Santa Clara, in the
Town of Los Gatos, on June 3, 2014 for the purpose of submitting the following measure
to the voters:
A Shall the Town's General Plan, General Plan Land Use Map, and
Zoning Code and Map be amended and shall the Albright Specific Plan be
adopted to provide land use rules for approximately 21.6 acres of land at
90 -160 Albright Way and 14600 Winchester Boulevard.
2. The official canvass of the returns of the election was conducted by the Office of
the Registrar of Voters in accordance with the appropriate provisions of the Elections Code
of the State of California.
3. The Statement of Votes Cast, now on file at my office, shows the whole number
of votes cast for Measure A in each of the precincts and the total shown is true and
correct.
