Since the development was approved back in 2008, we have been hoping for a restaurant use as was marketed for in the newly constructed building, but was ultimately occupied by a medical use. We are excited that there is still an opportunity to provide a restaurant in our neighborhood and believe that the type of restaurant planned would be a great addition. We understand that a successful restaurant is a natural fit and wonderful amenity for the hotel. We think that this quality fine- dining restaurant, if appropriately executed, could be a staple for the residents in the area for many years to come. The idea of bar style seating and the to -go window are very appealing in the neighborhood setting, for quick access to quality food and a great way to "stop -in" on our way home. We have watched as the owners of the motel property have taken a neglected, dilapidated, and somewhat unsafe motel and turned it into an upgraded hotel which appeals to a new higher -class clientele and can now better compete with the accommodations available in downtown Los Gatos. We are confident that the current owners have alignment with the residents in keeping the restaurant a fine dining location, complimenting the improved hotel that offers quality service to both the hotel guests and the surrounding community. We believe that the mutual success of the hotel and the restaurant will help ensure that the site will be worthy of Los Gatos well into the future. We understand that the current owners will keep tight controls on noise and deliveries, since they will have hotel guests occupying the rooms adjacent to the new restaurant, and it is in their best interest in an attempt to be good neighbors as well as provide for an enjoyable guest experience. The hotel is staffed 24 x 7, so we are confident that the hotel employees will be vigilant and work in conjunction with restaurant management to ensure a peaceful environment. Since the restaurant is walking distance to our neighborhood, we will now have a food option that will not require us to drive into downtown or Los Gatos Blvd, which in turn will alleviate traffic in those areas, as well as relieves pressure on parking spaces. We are excited that this is finally coming to fruition and recommend you approve this use as planned, making whatever exceptions and conditions as necessary for the restaurant to quickly move forward to opening. The Commission continued the matter to this agenda and requested that the applicant provide clearer plans and clarification on seating, how the patio seating will be enclosed, how the breakfast room and private dining room will be used, and operation of the proposed To Go window. ANALYSIS: The applicant has provided the following information to address the comments and recommendations of the Planning Commission (see Exhibit 11): Plan Revisions - The floor plan was revised to relocate and reduce the size of the bar from a large circular configuration to a smaller linear bar. The smaller bar would have eight seats. The requested 82 seats are allocated as follows: • Main dining room: 36 (nine tables for four) • Bar dining area: 18 (inclusive of 8 seats are at the bar, one table for two and two tables for four) • Private dining room/breakfast room: 16 (four tables for four) • Patio: 12 (three tables for four) Patio Seating - The applicant has indicated that the tree planter shown on the site/floor plan will provide a barrier for the outdoor seating. A barrier that fully encloses the seating area is required for service of alcoholic beverages. The patio seating will need to be fully enclosed with a fence, wall, or other acceptable barrier or alcoholic beverage service will not be allowed in this area. To Go Window - The applicant states that the To Go window will be open during restaurant hours of operation. The concept is that motel guests can order food to take to their room or off premises, and members of the public can order food for consumption off premises. Orders would be picked up at the To Go window, eliminating the need for patrons to enter the restaurant to obtain a take -out order. Alcoholic beverage service will not be available at the To Go window. Planning Commission Staff Report - Page 4 55 Los Gatos - Saratoga Road/U -I3 -018 May 21, 2014 Private Dining Room - The private dining room will be used as a breakfast room for motel guests in the morning (the restaurant will not be open for breakfast on weekdays, although brunch will be served on weekends). When the restaurant is open for business, the space will be used as a private dining room. Alcoholic Beverage Service - The applicant has not provided any additional information on requested alcohol service. PUBLIC COMMENTS: Exhibit 12 is a letter of support from the Las Casitas Homeowners. Exhibit 13 is a letter from the owner of the commercial property on the west side of Alberto Way, directly across the street from the subject property. The last page of the letter (Exhibit 13) includes recommendations for the CUP application. SUMMARY AND RECOMMENDATION: A. Summary The Planning Commission should determine if the direction to the applicant has been satisfactorily addressed, and if so, forward a recommendation to the Town Council on the CUP application. B. Recommendation It is recommended that the Planning Commission forward a recommendation to the Town Council for denial of Conditional Use Permit application U -13 -018 as the applicant is requesting service of alcoholic beverages after 10:00 p.m. which is not consistent with the Town's Alcoholic Beverage Policy. This application shall be completed in accordance with all of the conditions of approval listed below and in substantial compliance with the plans approved by the Town Council on , 2014, and noted as received by the Town on May 15, 2014. Any changes or modifications to the approved plans shall be approved by the Community Development Director, the Planning Commission or the Town Council, depending on the scope of the changes. 2. EXPIRATION. The Conditional Use Permit approval will expire two years from the approval date pursuant to Section 29.20.320 of the Town Code, unless the approval is used prior to expiration. 3. TOWN INDEMNITY. Applicants are notified that Town Code Section 1.10.115 requires that any applicant who receives a permit or entitlement from the Town shall defend, indemnify, and hold harmless the Town and its officials in any action brought by a third party to overturn, set aside, or void the permit or entitlement. This requirement is a condition of approval of all such permits and entitlements whether or not expressly set forth in the approval, and may be secured to the satisfaction of the Town Attorney. 4. LAPSE FOR DISCONTINUANCE. If the activity for which the Conditional Use Permit has been granted is discontinued for a period of one (1) year the approval lapses. 5. USE. The approved use is a quality restaurant with full alcohol service. If a different type of restaurant is proposed in the future, the CUP shall be amended. 6. SEATING. The maximum number of seats is 82 inclusive of the restaurant, dining bar, breakfast room and the outdoor patio. 7. HOURS OF OPERATION. Maximum hours of operation are as follows: a. 11:00 a.m. to 11:00 p.m., Monday through Thursday b. 11:00 a.m. to 11:30 p.m. Friday C. 9:00 a.m. to 11:30 p.m. Saturday d. 9:00 a.m. to 11:00 p.m. Sunday 8. ALCOHOL SERVICE. Alcoholic beverage service is allowed in the restaurant dining room and dining bar, and outdoor patio, only in conjunction with meal service. 9. ALCOHOLIC BEVERAGE POLICY: The applicant shall comply with any new requirements in the Town's Alcoholic Beverage Policy within six (6) months of the date of the change in policy. The design of the enclosure shall be consistent with the Commercial Design Guidelines and compliant with ABC requirements. 12. DELIVERY HOURS. Deliveries shall occur between 9:00 a.m. and 7:00 p.m., Monday through Saturday. 13. LIVE ENTERTAINMENT. No live entertainment or amplified music is allowed. 14. ONE YEAR REVIEW. The Planning Commission shall review the Conditional Use Permit within one year from final occupancy to evaluate the success of the conditions of approval, any compliance matters, and to determine if modifications to the conditions are needed. This review shall be noticed as a public hearing. 15. CERTIFICATE OF USE AND OCCUPANCY. A Certificate of Use and Occupancy from the Los Gatos Community Development Department must be obtained prior to commencement of use. 16. BUSINESS LICENSE. A business license must be obtained from the Town prior to the commencement of use. Building Division 17. PERMITS REQUIRED. A Building Permit shall be required for the any alterations to the restaurant space. Separate permits are required for electrical, mechanical, and plumbing work as necessary. 18. CONDITIONS OF APPROVAL. The Conditions of Approval must be blue -lined in full on the cover sheet of the construction plans. A Compliance Memorandum shall be prepared and submitted with the building permit application detailing how the Conditions of Approval will be addressed. 19. SIZE OF PLANS: Four sets of construction plans, maximum size 24" x 36 ". 20. TITLE 24 ACCESSIBILITY — COMMERICAL: For any proposed tenant improvements, on -site parking and general path of travel shall comply with the latest California Title 24 Accessibility Standards. Work shall include, but not be limited to, accessibility to building entrances from parking facilities and sidewalks. The building shall be upgraded to comply the latest California Title 24 Accessibility Standards. OUTDOOR TRASH ENCLOSURES. Outdoor trash enclosures shall be covered and provided with area drains connected to the sanitary sewer per current NPDES requirements. Temporary trash enclosures are exempt from this condition. 24. GREASE TRAPS. Meet all requirements of the Santa Clara County Health Department and West Valley Sanitation District for the interception, separation or pretreatment of effluent. TO THE SATISFACTION OF THE POLCE CHIEF: 25. UNIFORMED SECURITY. Uniformed privately provided security guards may be required in or around the premises by the Chief of Police if alcohol related problems recur that are not resolved by the licensed owner. 26. CONSULTATION AND TRAINING. At the discretion of the Chief of Police, periodic meetings will be conducted with representatives from the Police Department for on -going employee training on alcoholic beverage service to the general public. 27. Response to April 23d Planning Commission Meeting Since the April 23rd Planning Commission meeting, we have secured a tenant for the proposed restaurant space. This is the same tenant that Ion Shank referenced during the April 23rd meeting. We have been speaking to this tenant for a long time, so this is not a brand new relationship for us. We didn't realize the importance that the Planning Commission would place on having a tenant secured, which is why we are bringing him forward now. He plans to be present at the May 21" meeting. He has approximately thirty (30) years of experience in the restaurant industry and is currently a distinguished, local restaurateur. His input has influenced our response below along with the updated drawings that have been submitted. We are furnishing an itemized list of comments we perceived from the Planning Commission and hope that the responses meet with their approval. Comment #1: Alcohol service area is too dominant Response: The alcohol service area has been changed from what appeared to be a large, circular bar into a kitchen /food service /alcohol service area. The area has been moved up against a wall and is now connected to the kitchen. It is essentially a kitchen as well. As mentioned many times, this area is intended for a dining experience with an accompanying beverage. We have enclosed a picture that shows the functionality that is planned for this area. Forthe success of the restaurant, it is imperative that this area be a food - service space ratherthan an area just forserving alcohol. Again, this is why items such as a pizza oven, an oyster service area and supportive kitchen equipment will be placed in this space. We anticipate that our new tenant will be providing a fine - dining menu that we can submit by the time of the May 21'` meeting. Comment #2: Unclear if private dining room and hotel breakfast room are the same room. Response: Yes, these rooms are the same. The hotel would arrange for breakfast to be served in this room. The restaurant operator would then have access to this room for the midday and evening periods, thus allowing it double as private dining for the restaurant. Comment #3: Unsure if parking will work with to -go window. Response: The parking study was done with fifty (50) guest rooms and ninety -five (95) seats in the restaurant. Our application is for eighty -two (82) seats in the restaurant, and the hotel has been reduced to forty -eight (48) guest rooms. The buffer created by the additional seats and guest rooms that were done in the study should more than cover any impacts from the to -go window. We anticipate the to -go window will help us with parking overall as it will speed up a to -go guest's process for retrieving their order from the restaurant. The to -go window will be open during all hours of operation. When an order is ready, it will be staged at the to -go window instead of at a serving station. A kitchen employee will simply give the order to to -go- window guest at the time they arrive. Ever since the project was approved to have a restaurant and coffee shop, we have been looking forward to having a place within walking distance that we could frequent, or even stop by on our way home from work in the evenings. Even though I am sure the dialysis center that is going in will be a good business decision, it was a little disappointing to not get the restaurant we wanted. Many of us have admired how the Inn of Los Gatos has been transformed in the past fewyears, and we put our friends and family up in their facilities. Now that there is a chance for the site to get a restaurant where the old lobby was located, we are in full support for this. The management of the botel has been very responsive to our questions and comments, and we feel that the addition of a dining facility that we can use because of its close proximity will be nothing but beneficial. We certainly don't want this to become a huge production, but with the parking situation under control and onsite supervision from the hotel management, we don't have reservations about noise or traffic. In fact, the bar at the Los Gatos Lodge is likely to be far noisier with their live bands, and they are on the other side of Highway 4.
