M04-14-2014 Town Council Meeting 4/21/14 Item #1b MINUTES OF THE TOWN COUNCIL/PARKING AUTHORITY MEETING APRIL 14, 2014 The Town Council of the Town of Los Gatos conducted a Special Meeting on Monday, April 14, 2014, at 7:00 P.M. CLOSED SESSION – 6:00 P.M. MEETING CALLED TO ORDER AT 7:00 P.M. ROLL CALL Present: Mayor Steven Leonardis, Vice Mayor Marcia Jensen, Council Member Joe Pirzynski, Council Member Diane McNutt, Council Member Barbara Spector. Absent: None PLEDGE OF ALLEGIANCE Mayor Leonardis led the Pledge of Allegiance. The audience was invited to participate. PRESENTATIONS Mayor Leonardis presented the proclamation for Los Gatos Poetry Month to Erica Goss, Los Gatos Poet Laureate. CLOSED SESSION REPORT Robert Schultz, Town Attorney, stated Council met in Closed Session as duly noted on the agenda and there is no report. VERBAL COMMUNICATIONS There were no verbal communications. PUBLIC HEARINGS 1. Architecture and Site Applications S-13-071 and S-13-080. Property Location: 16560 Shannon Road. Property Owner/Applicant: JG Building, LLC. Appellant: RESOLUTION 2014-023 Jeff Curran, JG Building, LLC. Reconsider an appeal of the decision of the Planning Commission decision denying a request to demolish a pre-1941 single-family residence and construct two new single-family residences on property zoned R-1:8, and remanding the matter to the Planning Commission for further consideration. APN 532-04-001 Erin Walters, Associate Planner, presented the staff report. Greg Pinn, applicant, spoke on the project. Opened the Public Hearing at 7:26 p.m. Public Hearing #1 – continued Lee Quintana - Commented that she agreed with the Planning Commission’s interpretation of the Residential Design Guidelines. Greg Pinn, applicant, addressed comments. Council discussed the matter. Closed the Public Hearing at 7:32 p.m. MOTION: MotionCouncil Member Joe Pirzynski by to adopt the resolution granting the appeal (Attachment 9), make the required findings and considerations, and approve Architecture and Site applications S- 13-071 and S-13-080 subject to the Condition in Attachment 6 and the Development Plans that indicate the reduced square footage for lot 2 (Attachment 10); modify Conditions of Approval to combine conditions #44 & #47 to indicate the street improvements will be SecondedCouncil dedicated and an in lieu fee will be paid. by Member Diane McNutt. VOTE: Motion passed 3/2. Vice Mayor Marcia Jensen and Council Member Barbara Spector voting no. 2. Conditional Use Permit Application U-13-020. Architecture and Site Application S-13-050. Property Location: 16268 Los Gatos Boulevard. Property Owner: Fox Creek Fund, LLC. Applicant: Gary Kohlsaat, Architect. Appellant: Marshall Smith Consider an appeal of a Planning Commission decision approving a request to demolish an existing commercial building and to construct a new office building RESOLUTION 2014-024 on property zoned C-1. APN 532-06-060 Suzanne Avila, Senior Planner, presented the staff report. Marshall Smith, appellant, spoke on the project. Florian Barth, applicant, spoke on the project. Gary Kohlsaat, architect for applicant, spoke on the project. Marshall Smith, appellant, addressed comments. Opened and closed the Public Hearing at 8:17 p.m. 2 Town Council/Parking Authority April 14, 2014 Public Hearing #2 – continued Council discussed the matter. MOTION: MotionCouncil Member Barbara Spector by to adopt a resolution (Attachment 5) to deny the appeal and uphold the decision of the Planning Commission to approve applications U-13- 020 and S-13-050, and striking the last clause "will provide needed Class A office space" in paragraph 3, page 2, in Attachment 5. SecondedCouncil Member Diane McNutt. by VOTE: Motion passed unanimously. OTHER BUSINESS 3. Discuss and provide direction, if any, regarding term limits for Town Council seats Pamela Jacobs, Assistant Town Manager, presented the staff report. Lee Quintana requested clarification on Council’s meaning of citizen initiated. Council discussed and took no action on the matter. Direction to staff : For informational purposes, advise Council if the other jurisdictions that have term limits were Council or voter initiated ballot measures.
