SUBJECT: CLARIFICATION AND CORRECTION OF APRIL 21, 2014 COUNCIL ACTIONS
REGARDING ARCHITECTURAL CONSULTANT AND YOGURT IN LOVE
RECOMMENDATION:
Clarify and correct Council actions on April 21, 2014 as follows:
• Study Session: Revise motion to state that modifications to Council Policy 2002 -25 regarding
the Architectural Consultant will return to the Town Council for review and action; and
• Item #11: Replace "strongly discourage" with "discourage" in two of the "Whereas" clauses in
the resolution approving the Conditional Use Permit for Yogurt in Love.
BACKGROUND:
At the April 21, 2014 Council meeting, the Town Council took two actions which, upon subsequent staff
review, require correction or clarification.
DISCUSSION:
The motion made and adopted regarding modifications to Council Policy 2002 -25 pertaining to the
Architectural Consultant included language that the revised resolution would return to the Planning
Commission. Based on follow -up discussions with the motion maker and seconder, staff became aware
that the return to Planning Commission was not the intent of the action. Consequently, this clarification
and correction will return the revised policy to the Town Council.
The resolution approving the Conditional Use Permit for Yogurt in Love inaccurately stated that Council
Resolution 2021 "strongly discourages" the conversion of Downtown retail space to restaurant use,

while Resolution 2021 only states "discourages." This clarification and correction will delete the word
"strongly" from the resolution in the two "Whereas" clauses in which it was inaccurately included.
ENVIRONMENTAL ASSESSMENT:
Is not a project defined under CEQA, and no further action is required.
FISCAL IMPACT:
There is no fiscal impact associated with this action.
