The Sisters of the Holy Names would like to thank you for all of your efforts in preparing
our subdivision application for the Town Planning Commission Hearing on February 26,
2014. We are pleased that the Planning Commission has unanimously (7 -0) recommended
approval of our Vesting Tentative Map as proposed, including the demolition of the Stone
House.
Per your request we are writing to supply you with additional information on the
condition of the Stone House. As you are aware, our original lot layout plan for the
property included the retention of the approximately 800 square foot Stone House in
place. This original plan was presented before the Conceptual Development Advisory
Committee on March 13, 2013. However, after further investigation and detailed review of
studies completed on the structure, the best course of action is to remove the structure. The
Stone House is not now nor would it ever be visible to the public. In its current condition
the structure is structurally unsound and restoration would require a complete rebuild of
the structure (new pier or deepened footing foundation, excavation and replacement of
footing, new support post and retaining walls, wall reinforcement, rewiring of all utilities
and replacement of most interior and exterior features) and disturbance of a steep hillside
area where development is strongly discouraged by the Town.
Structural Integrity
A home inspection report was completed on the structure in January 2011 by Insight
Home Services. The inspection determined that a total replacement of the masonry
foundation is necessary. The foundation is currently unreinforced construction which is an
antiquated system that is not designed to withstand seismic activity. Loose and missing
brick units were also observed in the masonry foundation and no anchor bolts were visible

during the inspection. Construction of a new foundation would likely require that the
entire structure to be lifted, that the exiting footings and retaining walls be excavated,
demolished, off hauled and replaced, and that additional grading of the hillside take place
in order to create a suitable building pad and foundation. A new foundation would likely
have to be on piers or deep footing to ensure stability of the structure.
In addition, the home inspection report also found that the cripple walls on the left side of
the structure, which provide center bearing support for the interior ends of the floor joists,
were leaning and unstable. This is likely due to the fact that that portion of the building is
physically embedded the hill and has direct contact with soil which has likely expanded
and settled over time. The report also found that the wall framing was leaning, that the
rafters were sagging and that the entire electrical system was not property grounded or
wired and was exposed in several locations. The electrical system would need to be
completely removed and replaced to bring it into conformance with local requirements.
The report also found that the current grading causes sloping towards the structure which
in turn causes inadequate drainage. Because the hillside is literally in contact with the roof
and windows due to how the structure was built, this condition has promoted water
accumulation at the building, which has resulted in deterioration of the foundation and
water penetration into the crawlspace and windows.
A termite report was also completed for the property by Thrasher Termite. The termite
report found that there was extensive subterranean and dry wood termite damage as well
as fungus damage throughout the entire structure. The damaged wood, which includes
support post, beams, rafters, the deck, comer and diagonal log supports, shingles and
other areas, would need to be removed and replaced with new materials.
Given the extensive structural and electrical inadequacies of the building, if it were to be
retained it would essentially need to be entirely rebuilt with new materials inside and
outside which would leave very little if any of the existing structure in tact.
Location
The area which the structure is currently located is outside of what the Town has
identified as The Least Restrictive Development Area (LRDA), meaning it is in an area of
30 percent slope or greater. In addition, the structure is located in an area which has been
identified as an Oak Woodland in the Biological Resources Assessment Report completed
for the proposed Tentative Map project. Oak Woodland are considered sensitive biological
communities and construction within this area is discouraged. The Sisters are currently not
proposing any home development outside of the LRDA or within the area identified as
Oak Woodland. The current location of the Stone House (on a steep slope, with the entire
left side at or below surrounding grade with direct soil contact) would need to be
reformed in order to ensure structural stability. Restoration of the Stone House would
require extensive construction activity outside of the LRDA and within the Oak Woodland
area and would violate many of the Hillside standards that the Town has put in place,
including significant cut, fill, construction of retaining walls and foundation, grading of the
hillsides and development outside the LRDA.
Soil Quali ty
As part of the environmental review for the project, a soil quality evaluation was
completed on the property. The evaluation found that DDT, dieldrin and lead
concentrations exceeding residential hazardous waste criteria were detected at and around
the foundation of the Stone House. As part the required remediation of the site,
contaminated soil will need to be removed and appropriately disposed of. In order to
ensure that contaminated soils near the Stone House are completely removed, the best
course of action is to remove any contaminated soil that may be located underneath the
structure as well. In order to do so the structure would need to either be demolished or
temporarily moved in order to gain complete access to currently inaccessible areas
underneath the structure. Given the structural integrity of the building, location on steep
slope, existing mature trees and limited access, moving the building is not physically
feasible.
Historical Significance
A historic resources evaluation was also completed by Archives and Architecture as part
of the environmental review for the proposed Vesting Tentative Map. The entire property
was evaluated for significance under State criteria for identification and designation of
historic resources. While the Stone House is over 50 years in age, Archives and
Architecture found that the structure would not be eligible for listing on the California
Register of Historical Resources due to the fact that the site lacks historical integrity due to
the loss of relevant historic context and setting. The property as a whole as been
irreversibly altered by the demolition of the previous estate that existed on the property
and the construction of the mid- twentieth- century campus of the Sisters of the Holy
Names that covers much of the original property today. The report concluded that the
Stone House has "only minor local architectural associations".
The Stone House is currently listed on the Town's Historic Resources Inventory list and
the Town Code requires that certain findings be made for the demolition of any historic
structure:
1. The building is not associated with any events that have made a significant
contribution to the Town.
While the property has history, the historical resources evaluation did not find
that the building was associated with any events that have made a significant
contribution to the Town.
2. No significant persons are associated with the site
The site is associated with Henry C. Smith, who was identified in the historic
evaluation as a significant regional architect during the first half of the twentieth
century. However, due to the loss of the original Smith house and the construction
of the mid - twentieth - century campus of the Sisters of the Holy Names that covers
much of the original property, the site as a whole (including the Stone House) lacks
integrity to the original Smith estate. The report concluded that the Stone House
has "only minor local architectural associations ".
3. There are no distinctive characteristics of type, period or method of construction or
representation of work of a master
The historic evaluation found that the Stone House was a representation of the
work of Henry C. Smith, who was identified in the historic evaluation as a
significant regional architect during the first half of the twentieth century.
However, due to the loss of the original Smith house and the construction of the
mid - twentieth - century campus of the Sisters of the Holy Names that covers much
of the original property, the site as a whole (including the Stone House) lacks
integrity to the original Smith estate. The report concluded that the Stone House
has "only minor local architectural associations ".
4. The structure does not yield information to Town history
The historical resources evaluation did not find that the Stone House yields any
information to Town history.
5. Structural integrity of the building
As noted above, the structural integrity of the building is highly compromised due
to the construction methods used to construct the building, its location on a very
steep hillside and the fact that portions of the structure are built at or below grade
directly against soil; it is structurally unsound.
Based on the information provided above, and because preservation of the Stone House
would place an undue financial burden on the Sisters, we are requesting that the Council
accept the professional staff recommendation and unanimous Planning Commission
recommendation to approve demolition of the Stone House and the Tentative map as
proposed.

ITEM 1A FINDING: Evidence of subterranean termite activity was noted at the subarea framing. The
infestations appear to be originating at the exterior soil and subarea soil.
RECOMMENDATION: Perform a guaranteed soil treatment for the control of
subterranean termites using a registered termiticide. This treatment may include, but is
not limited to the following methods of treatment: treat the subarea soil adjacent to the
foundation walls (only when the infestations originate at these areas). Treat the subarea soil
adjacent to the piers and /or plumbing lines. Treat the exterior soil adjacent to all accessible
exterior foundation walls using drill and treat, trench and treat and /or rod and treat application
methods. After the treatment all holes will be patched and all accessible evidence of subterranean
termites (mud shelter tubes and /or swarmers) will be removed.

In the performance of the above recommendation, we propose to use the chemical Termidor
(Fipronil).
NOTE: We will be unable to guarantee an exact match at the areas that are drilled and then
patched. This will include painted surfaces, aggregrate, brick, tile, grout, etc.
NOTE: We will attempt to perform the outlined drill and treat without damaging any electrical
conduits, gas lines or plumbing lines that may exist. If any damage does occur we would assist the
property owner by contacting the proper tradesperson for repairs (if requested). The property
owner would be responsible for all expenses that result from these additional repairs. All interested
parties should be aware that Thrasher Termite & Pest Control, Inc. assumes no responsibility for
damage that may occur to any of these concealed conduits, gas lines or plumbing lines. By signing

Environmental Impact Report EIR -13 -002
Requesting approval to subdivide a 10.3 acre parcel into 17 lots on property zoned R-1:20. An
Environmental Impact Report has been prepared. APN 529 -44 -005.
PROPERTY OWNER/APPLICANT: Sister of the Holy Names of Jesus and Mary
FINDINGS:
Required finding for CEQA:
An Environmental Impact Report (EIR) was prepared for the project and is being certified for
the proposed subdivision application. A Mitigation Monitoring and Reporting Program is
being adopted as required by CEQA.
Required finding required by Housing Element Policy HOU -9.1:
The proposed development is consistent with the Town's Housing Element and addresses the
Town's housing needs as identified in the Housing Element.
Required finding for demolition of a historic structure:
Pursuant to Section 29.10.09030 of the Town Code, the Stone House poses a safety hazard
due to its poor condition and lack of structural integrity. A detailed structural report and
termite report were submitted in support of the demolition.
Subdivision Map Act findings for denial:
■ In order to deny the application, the deciding body must make one or more of the following
findings, as required by Section 66474 of the State Subdivision Map Act:
a. That the proposed map is not consistent with applicable general and specific plans as
specified in Section 65451.
b. That the design or improvement of the proposed subdivision is not consistent with
applicable general and specific plans.
C. That the site is not physically suitable for the type of development.
d. That the site is not physically suitable for the proposed density of development.
e. That the design of the subdivision or the proposed improvements are likely to cause
substantial environmental damage or substantially and avoidably injure fish or
wildlife or their habitat.
f. That the design of the subdivision or type of improvements is likely to cause serious
public health problems.
