Dear Mayor Leonardis and Members of the Council:
This office represents ValleyOne Investment, LLC and Shunliang Wang, the applicants on
the above - referenced project. Although we did not participate in the planning of this development or
the Planning Commission hearing, I have reviewed the transcript of the Planning Commission
hearing.
It appears that the Planning Commission erred or abused its discretion primarily by treating
the request for a Conditional Use Permit as somehow being in violation of Town regulations or
policies. It is clear in the Staff Report and in the Town Code itself, of course, that residential is
allowed in this zone with a use permit subject to appropriate conditions.
The development proposed here is innovative in that it uses a condominium form of
ownership for a detached project, but I understand that the attorney with whom this form of
ownership was developed for this project will be available to explain how that it is appropriate for
this site and why it is not a project design that the Town should in any way shy away from.

Since the policy of the Town of Los Gatos already allows residential development with a
conditional use permit, it was not appropriate for the planning Commission to in effect deny the
applicability of this policy to the subject property.
Staff agreed that the project is well designed, and the Town consulting architect has approved
of the design. I believe that Mr. Wang and his architect will also be able to explain to you
modifications that are proposed in the project now to address issues of neighborhood compatibility
that were raised by some of the residents living nearby. These modifications should go a long way
toward removing any such objections.
