1Town Council Meeting 11/18/13 Item # I MINUTES OF THE TOWN COUNCIUPARKING AUTHORITY MEETING NOVEMBER 4, 2013 The Town Council of the Town of Los Gatos conducted a Regular Meeting on Monday, November 4, 2013 at 7:00 P.M. CLOSED SESSION - 5:45 P.M. CONFERENCE WITH LABOR NEGOTIATOR (Government Code Section 54957.6) To meet with Town Negotiators listed below in closed session pursuant to Government Code §54957.6 regarding negotiations with the Employee Organizations listed below: Town Negotiators (Lead): - Rumi Portillo, Human Resources Director and Greg Larson, Town Manager. Employee Organization(s): - American Federation of State, County and Municipal Employees (AFSCME) - Police Officers' Association (POA) - Town Employees Association (TEA) - Confidential Employees - Management Employees PUBLIC EMPLOYEE APPOINTMENT (Government Code Section 54957) Title: Town Attorney MEETING CALLED TO ORDER The meeting was called to order at 7:00 p.m. ROLL CALL Present: Mayor Barbara Spector, Vice Mayor Steven Leonardis, Council Member Joe Pirzynski, Council Member Diane McNutt, and Council Member Marcia Jensen. Absent: None. PLEDGE OF ALLEGIANCE Valerie Hau, Los Gatos High Valerie Hau, Los Gatos High, led the Pledge of Allegiance. The audience was invited to participate. CLOSED SESSION REPORT Judith Propp, Town Attorney, stated that Council met in Closed Session on October 24, October 30, and November 4, as duly noted on the agendas and that no action was taken. COUNCIL /TOWN MANAGER REPORTS Council Matters - Vice Mayor, Steven Leonardis , stated he attended the West Valley Solid Waste Management Authority meeting and the Santa Clara Valley Water Commission meeting. Manager Matters - Announced the new Art in the Council Chambers exhibit is by the Los Gatos Museums Gallery Artists and will be available through January 30, 2014. - Introduced Matt Morley, the new Parks and Public Works Director, who will be starting with the Town on December 2. - Thanked Bob Kass, Interim Parks and Public Works Director, for his leadership and support the last several months. VERBAL COMMUNICATIONS Dr. Richard Fox - Commented on rules of engagement between the police and community. Jeff Loughridge - Commented on timing of notification of public hearings. CONSENT ITEMS (TO BE ACTED UPON BY A SINGLE MOTION) Approve Council minutes of: a. October 21, 2013 b. October 24, 2013 Special Meeting c. October 30, 2013 Special Meeting MOTION: Motion by Council Member Joe Pirzynski to approve the Consent Items as recommended by Staff. Seconded by Vice Mayor Steven Leonardis. VOTE: Motion passed unanimously PUBLIC HEARINGS 2. Adopt resolution authorizing the continued use of Supplemental Local Law Enforcement Services Funds (SLESF) to provide funding for two (2) full -time Police officers assigned as motorcycle traffic officers RESOLUTION 2013 -045 Scott Seaman, Police Chief, presented the staff report. Town Council /Parking Authority November 4, 2013 Public Hearing Item #2 — continued Opened and closed the Public Hearing at 7:15 p.m. Council discussed the matter. MOTION: Motion by Council Member Joe Pirzynski to adopt the resolution authorizing the continued use of Supplemental Local Law Enforcement Services Funds (SLESF) to provide funding for two (2) full -time police officers assigned as motorcycle traffic officers. Seconded by Vice Mayor Steven Leonardis. VOTE: Motion passed unanimously 3. Town -Wide Vehicle Speed Survey a. Acceptance of Town -Wide Vehicle Speed Survey; b. Introduce an ordinance of the Town of Los Gatos amending section 15.30.235 of the Los Gatos Town Code for establishing speed limits on certain streets Bob Kass, Interim Director of Parks and Public Works presented the staff report. Opened and closed the Public Hearing at 7:32 p.m. Council discussed the matter and directed staff to study two streets for possible future speed limit changes: continuing the 25 mph limit on Los Gatos Blvd. between Roberts Rd. and Blossom Hill Rd. and continuing the 20 mph limit on University between Mullen and Saratoga /Los Gatos Road (Highway 9) and possibly up to Blossom Hill Road. Shelley Neis, Deputy Clerk, read the title of the ordinance. MOTION: Motion by Vice Mayor Steven Leonardis to introduce an ordinance of the Town of Los Gatos amending Section 15.30.235 of the Town Code establishing speed limits on certain streets. Seconded by Council Member Joe Pirzynski. VOTE: Motion passed unanimously 3 Town Council /Parking Authority November 4, 2013 Public Hearings — continued 4. Introduction of a General Plan Amendment to include the Affordable Housing Overlay Zone sites in the Housing Element Technical Appendix Housing Sites Inventory; amending the Town Code to incorporate the Affordable Housing Overlay into Division 5, Article VIII Overlay Zones and Historic Preservation; Adoption of Affordable Housing Overlay Zone Design Guidelines; and application of an Affordable Housing Overlay to five properties generally located at: RESOLUTIONS 2013 -046, 2013 -047, 2013 -048 a. Knowles Drive, east of Winchester Boulevard, APN 424 -32 -077 b. Los Gatos Lodge, 50 Los Gatos - Saratoga Road, APN 529 -24 -032 c. Los Gatos Lodge, 50 Los Gatos - Saratoga Road, APN 529 -24 -001 d. Higgins Business Park, 400 Blossom Hill Road, APN 529 -16 -071 e. Los Gatos Oaks Apartments, 517 Blossom Hill Road, APN 529 -16 -042 Erwin Ordonez, Senior Planner, presented the staff report. Opened the Public Hearing at 7:56 p.m. Matthew Hudes - Thanked the community and staff for their work on the project. John Shepardson - Questioned why there is a General Plan amendment for this proposal. Matthew Dailey - Formally protested high density housing. Closed the Public Hearing at 8:00 p.m. Council discussed the matter. Shelley Neis, Deputy Clerk, read the titles of the ordinances. MOTION: Motion by Vice Mayor Steven Leonardis to approve items 2 -10 as recommended in the Staff Report. Amendment by Mayor Barbara Spector to direct staff to make changes that standardize "standards" verses "guidelines" and "shall' verses "should." Seconded by Council Member Joe Pirzynski. Information Report - Review of the Planned Development Overlay Zone Sandy Baily, Community Development Director, presented the staff report. Opened the Public Hearing at 8:10 p.m. Anne Robinson - Commented on the planned developments recently approved. Jak Van Nada - Commented on the wording and review of planned developments. Jeff Loughridge - Commented on the inconsistencies in the definition of planned development. John Shepardson - Commented on the definition of planned development. Larry Arzie - Commented on the use of planned developments. Maria Ristow - Commented on the use of planned developments. Beverley Bryant - Commented on the use of planned developments. Closed the Public Hearing at 8:28 p.m. Council discussed the matter. MOTION: Motion by Mayor Barbara Spector to refer to Town staff a review of Zoning Ordinance 298080 in terms of specificity, specifically using the first sentence as guidance and the second sentence as potentially unnecessary language; review and clarify the infill ordinance; review wording of the General Plan regarding Planned Developments so that the language is consistent with the first sentence of the Zoning Ordinance; and consider the use of the Planned Development in specified zones. Seconded by Council Member Marcia Jensen.
