MAIN STREET, LOS GATOS, CALIFORNIA. The meeting was called to order at 5:00 p.m. by Chair John Bourgeois. ATTENDANCE: Members presen t: Barbara Spector, Joe Pirzynski, John Bourgeois, Marico Sayoc, Todd Jarvis, Matthew Hudes, Barbara Cardillo, Charles Erekson, Bob Beyer Members absent: None Staff present: Sandy Baily, Assistant Community Development Director; Erwin Ordonez, Senior Planner; Suzanne Avila, Senior Planner Others present: Beverley Bryant, Iddo Hadar, Jeff Loughridge, Ingrid Oakley - Givan, Anne Robinson, Mark Tersini, Marcia Wright VERBAL COMMUNICATIONS Anne Robinson, Charter Oaks resident, commented on the cherry pickers located on site for the Albright project. They would like to have one cherry picker moved to a more appropriate location. The cherry picker for the parking garage is not 35 feet high. There is still no way to evaluate the impact of the project. There is a draft EIR, but it is not accurate for the Charter Oaks development. Two of the viewpoints are not accurate and there is no evaluation of the Lark/Winchester intersection. Many residents do not know what is going on. Many people feel that the Town does not care about north Los Gatos. ITEM 1 APPROVAL OF MINUTES Marico Sayoc made a motion to approve the minutes of March 27, 2013, as submitted. The motion was seconded by Barbara Spector and passed unanimously (6 -0). ITEM 2 REVIEW OF AHOZ SITES Sandy Bally commented on the ABAG desk item and the past potential AHOZ sites exhibits, explaining the information on the color codes for potential sites and reminding the Committee of the different time estimates for required environmental reviews for the different color groups in order to comply with the HCD requirements. The ABAG we 'A's information provided is for an upcoming May 1, 2013, meeting in San Jose. Sandy Bally noted that she is highlighting the MIBIT 14 of Attachment i General Plan Conmnittee Minutes April 10, 2013 Page 2 of 7 notice for the public especially for those individuals who wish to comment on the draft EIR for One Bay Area and the methodology used to develop RHNA numbers. She stressed that any un- planned housing allocations from the current housing element cycle (2007 -2014) would be considered by the State as "umnet RHNA" units that would be carried over to the next housing Cycle (2014 - 2022). Public Comment: Ingrid Oakley- Givan, Oka Road, commented that one of the things she likes best about the Town is the balance of development. Segregating affordable housing is not consistent with the Town goals. Brokers should not be setting guidelines in the Town (referencing the North 40). Oka Road is not an appropriate location for low income housing that will add to already existing problems. The aver- sattuation needs to be addressed. She would like to see a balanced and blended approach with less density and sites spread out. Neff Loughridge, Oka Road, commented that it is important to get it right before the RHNA deadline. The distribution illustrations show the distribution of affordable housing is being concentrated in north Los Gatos. Marcia Wright, Shannon Road, commented that a good number of the sites recommended by the Planning Department are along Los Gatos Boulevard. She noted that many of the abutting areas are residential. Ms. Wright further noted that many of these residential areas are in the County and may eventually be annexed so that should be taken into consideration by the Town. She did not like the fact that car dealerships are now suddenly being considered for high density housing by the Town. Mark Tersini, KT Properties, commented that KT Properties is under contract to purchase part of the Courthouse site. He has filed a residential development proposal that includes affordable housing as required by the Town Code not based on the proposed AHOZ designation. He noted that he met with neighbors early in the process and they expressed concern about development of the site as an AHOZ project. John Bourgeois asked Mr. Tersini how passing of the AHOZ for the Courthouse site would change his development proposal. Mr. Tersini responded that a portion of the site would be used for senior /affordable housing rather than small lot single- family plans he submitted. Marico Sayoc asked if the application includes a General Plan Amendment. Mr. Tersini confirmed that it does. Beverley Bryant, commented that the Courthouse property has public transportation. If it is built out as currently proposed, it will have affordable housing as required by the Town. Los Gatos will be proud of the quality of construction and the neighborhood that will be created. General Plan Committee Minutes April 10, 2013 Page 3 of 7 Iddo Hadar, commented on the implications of development on the Courthouse site. The issue is to look at this in the context of the significant traffic that would be generated by the South Bay site and the impact it will have on the neighborhood. Committee Discussion: Barbara Cardillo asked if the design guidelines would exceed the height requirements in the Town Code. Erwin Ordonez said that the draft guidelines developed and recommended by the General Plan Committee in 2012 do not include increased building heights above what is allowed by zoning, but noted that Town Council as part of the recommended Architecture and Site process has the authority to approve additional height if it felt it was warranted for the architectural design proposed. Barbara Cardillo asked where the Town is with affordable housing within the North 40. Sandy Baily responded that the General Plan states that projects may not be approved within the Specific Plan Area until a specific plan has been adopted. Current plans for the North 40 include housing which could result in approximately 60 affordable units. Barbara Spector asked what the height requirement is in the AHOZ Design Guidelines. Sandy Baily said it is a maximum of 35 feet. Matthew Hudes asked if the North 40 site could be considered as part of the next housing cycle. Sandy Baily commented that the North 40 Advisory Committee (N40AC) direction has been toward alternative housing types such as empty nesters and senior housing. Marico Sayoc asked for clarification on the environmental analysis and what types of housing will be evaluated. Sandy Baily said that housing types are being developed and will be reviewed by the N40AC at its next meeting. Marico Sayoc clarified that the North 40 is not off the table for meeting the RHNA of the next housing cycle. Barbara Cardillo asked if a site must be designated as an AHOZ in order for the developed units to be counted or if any below market units can be counted. Erwin Ordonez said that affordable units developed before December 31, 2012, will be counted in this Housing Element cycle, He further noted that after that cut -off date, units will be counted toward the next housing cycle which will begin in January 2014. John Bourgeois asked for Committee connnents on the staff designated green color sites from the matrix, starting with the Courthouse site. Marico Sayoc commented that Courthouse and South Bay sites provide the needed numbers to meet the RHNA. If it comes down to one or the other of the two, she prefers the south Bay site. Its proximity to the future light rail, access to the trail, and proximity to Aventino are all positive aspects. Choosing between the two sites, South Bay has more benefits than the Courthouse site. General Plan Conunittee Minutes April 10, 2013 Page 4 of 7 Joe Pir zynski affirmed Marico Sayoc's continents. The Courthouse site can be a successful residential site. Given that there is a proposed project that will include an affordable component, the site could be removed. The South Bay site should remain on the list. It has greater potential for transit orientation and it is directly accessible to the retail across the street at the Aldo's shopping center. Barbara Spector commented that the Committee is dealing with competing interests. The Town is being asked by residents in the north not to concentrate affordable housing in the north end of Town, and is being required by the State to plan for an additional 362 housing units before the end of 2013. She noted that adding an overlay zone to a property does not mean that the site will automatically be developed under it. The Town is being encouraged to use transportation corridors. She would not choose two sites north of Lark Avenue. She prefers the South Bay site for the same reasons stated by Marico Sayoc and Joe Pirzynski. The Acura and Bentley sites could be combined with the South Bay site. Of the two sites at Los Gatos Lodge, the smaller site could be included. John Bourgeois commented that he does not know how realistic it would be to take the small site at the Los Gatos Lodge, although he otherwise agrees with the comments that have been made. Bob Beyer commented that he agrees with the South Bay site and a density of 20 units/acre. The Bentley site appears to be more appropriate for residential than the Acura site. Barbara Spector commented on her rationale for not going over the number needed and using that toward the numbers for 2014. Todd Jarvis asked if the State requires the minimum numbers even if there is not available land. Erwin Ordonez commented that the State determines the housing need and the local jurisdiction develops method(s) to achieve that. The Town made the decision to adopt overlay zones as part of the Housing Element update. Charles Erekson agreed with Marico Sayoc that it would be more desirable to have only one of the sites north of Lark Avenue. A number that is larger than the minimum is worth considering. To make it too close to the goal suggests a precision in the planning which, when the actual development occurs, is left to developers. It is too precise as there is not complete control over what a developer will propose. He agreed with Bob Beyer that the Bentley site is preferable to the Acura site. The Los Gatos Lodge site might be at the top of his list. He is concerned that if the Courthouse site is going to be developed with a residential project, there could be housing in both locations (South Bay and Courthouse). If the Los Gatos Lodge site is redeveloped, the hotel capacity will be reduced. Perhaps another site should be preserved for hotel to offset that loss. He believes the Courthouse site is more appropriate for residential than a hotel, whereas the South Bay site could accommodate a hotel. Iilalthew Hudes commented that with the goals that were discussed at previous meetings, the dilemma is between the South Bay and Courthouse sites. The South Bay site would create more General Plan Committee Minutes April 10, 2013 Page 5 of 7 of an impact as it is a larger site. It is neutral as a residential site. If the Courthouse site will be developed with residential, it might be more appropriate to designate that site. Barbara Cardillo commented that comparing the Courthouse and South Bay, the South Bay site is preferable for the reasons already stated, including the trail, public transit and existing residential at Aventino. Her concern is in increasing the density and adding to traffic and creating other impacts. John Bourgeois asked how many housing units would have to be made up to meet the remaining RHNA if the density on the South Bay site were lowered to 20 units /acre. Erwin Ordonez commented that 78 units would need to be made up elsewhere. Joe Pirzynski commented that the South Bay site is the only one with a density of 30 units /acre and asked what the rationale was for that. Sandy Baily commented that it would be consistent with the density at Aventino, and the proximity to light rail supports a higher density. Erwin Ordonez added that the South Bay site has been designated for high density residential since the 1980's when the Vasona Li ght Rail Element was adopted and prior to the construction of Highway 85. Bob Beyer asked about the Courthouse site resolution adopted by the Town Council that states that any residential project that is not an AHOZ project would not be an appropriate use. How does this tie into what we are talking about tonight? Sandy Baily commented that the resolution would be brought tip during the public hearing process for the submitted development application and the Council as part of its review could choose to rescind it. Joe Pirzynski commented that the resolution was adopted by Council as an urgency situation because the County was in the process of selling the sites as there was already a considerable amount of work by the Town to prepare the AHOZ proposal and draft guidelines. He noted that the Council could amend or rescind the resolution given the changes in the project and the final determinations on AHOZ sites. John Bourgeois commented that choosing either the Courthouse or South Bay site and combining it with the Bentley site would not be enough units. Barbara Cardillo asked if the Committee needs to decide between 20 or 30 units /acre, or can it set a number in between. Erwin Ordonez confirmed that as a suburban community, the minimum density acceptable to the State Housing Community Development Department is 20 units /acre. Bob Beyer made a motion to include the following sites in the AHOZ recommendation to the Planning Commission and Town Council: South Bay with a density of 20 units /acre ® Los Gatos Bentley ® Los Gatos Lodge (both sites) General Plan Committee Minutes April 10, 2013 Page 6 of 7 The motion was seconded by Charles Erekson, Joe Pirzynski commented that the neighbors that would be most affected by the addition of the Bentley and Los Gatos Lodge sites have not yet been notified. Barbara Spector commented that if new sites are added, additional outreach is needed. Sandy Baily stated that neighborhood outreach would most likely occur in May. Marico Sayoc commented that she is going back and forth on Acura. She is concerned about the Los Gatos Lodge area where one point of access could be problematic and how Highways 9 and 17 could be impacted. Sandy Baily commented that neighborhood outreach will be done and staff will then return to the Committee. Erwin Ordohez commented that additional methods are being considered to notify residents as required by the Council. Barbara Spector commented that she is also debating between Acura and Bentley. Initially she thought both sites should be included, then she realized that concentrating units in the area close to the Swanson site could be a problem. She has concerns about the Los Gatos Lodge given existing traffic problems in that area. Joe Pirzynski seconded Barbara Spector's comments on the Los Gatos Lodge site. There have been previous proposals for development of the property. The traffic impacts are a concern. Taking both the Acura and Bentley sites would create the same problem that occurred on Oka Road. The Corrunittee does need to come to closure on which sites to study. South Bay is sounding good, but the other sites have difficulties. John Bourgeois said that the motion is to include the South Bay, Bentley and both Los Gatos Lodge sites and called for the vote. The motion passed 5 -4 (Cardillo, Spector, Pirzynski and Jarvis dissenting). Joe Pirzynski commented that his vote was based on the lack of environmental analysis available, particularly on traffic. Barbara Spector commented that two sites are new and require additional public outreach. The Los Gatos Lodge was not encompassed in the original EIR and there are several Committee members with concerns about traffic. Joe Pirzynski commented that the Los Gatos Boulevard Plan calls for commercial at the north end with mixed use in the middle and residential at the south. He asked how development of the Acura site would fit into the mix. Erwin Ordonez commented that the information received from a non - profit housing developer is that both the Acura and Bentley sites are viable for residential use and could support affordable housing projects. The housing developer also noted that it was less viable as a mixed -used development with affordable residential units over retail project due General Plan Committee Minutes April 10, 2013 Page 7 of 7 to the retail asking rents /demand not supporting the development costs. The non - profit developer did note that vertical medical /dental office uses combined with residential above may be viable. Barbara Spector clarified why mixed use retail with affordable housing is a concern given the Swanson Ford development. Joe Pirzynski asked how the (remaining RHNA) number would Iook if the entire area north of Roberts Road, south of the Acura parcel was included. He would like to see that as an alternative. Marico Sayoc agreed. Asked if there were some way to generalize the overlay zone. She does not want to see more medical offices on that corridor. Is there a way to support the vertical mixed use or analyze the other sites for the viability of residential over commercial? Smaller infill sites should also be considered. The Town needs to be creative. Marico Sayoc asked if more sites could be added to the three sites that are being analyzed. Sandy Baily confirmed. Erwin Ordon"ez clarified that if the three sites that are now being considered are not included, additional sites will need to be added. Joe Pirzynski commented that he would like to see the analysis on Acura as an additional site Matthew Hudes commented that he would like to see an alternative to the three sites explored in case one does not work. Joe Pirzynski commented that the Acura site and commercial parcels south to Roberts Road should be considered for a mixed use site. John Bourgeois asked if this was acceptable to the maker of the original motion and second. Bob Beyer and Charles Erekson agreed on the additions. The Committee unanimously agreed on the change. Sandy Baily asked whether the North 40 should be considered as an AHOZ site so it can be communicated to the N40AC. Committee consensus was that the North 40 should be considered.
