SUMMARY MINUTES OF A SPECIAL MEETING OF THE GENERAL PLAN
COMMITTEE OF THE TOWN OF LOS GATOS ON MARCH 27, 2013, HELD IN THE LOS
GATOS TOWN COUNCIL CHAMBERS, AT 110 E. MAIN STREET, LOS GATOS,
CALIFORNIA.
The meeting was called to order at 5:00 p.m. by Vice Chair Marico Sayoc.
ATTENDANCE:

VERBAL COMMUNICATIONS
Anne Robinson spoke about traffic concerns at Oka Road and Lark Avenue, and Oka Road and
Arroyo Grande, and the difficulty to get onto Lark Avenue without traffic signals. Traffic
associated with the proposed Albright, North 40, and AHOZ projects, and the existing medical
buildings on Los Gatos Boulevard will impact Lark Avenue. Robinson questioned the AHOZ
vehicle trips per unit. Mitigation measures for non - signalized intersections on Lark Avenue need
to be addressed.

ITEM 2 REVIEW AFFORDABLE HOUSING OVERLAY ZONE (AHOZ)
Sandy Baily provided an overview of Town Council actions of January 22, 2013, and General
Plan Committee directions on February 27, 2013.
Eriidn Ordonez provided staff's final analysis of the building permit reports since the preparation
of the Housing Element in 2009. The Regional Housing Needs Allocation (RHNA) goal has
been reduced from 452 units to 346 units.

Erwin Ordohez gave an overview of the current updated matrix. He noted that Housing and
Community Development (IICD) stated that an AHOZ site needed to have a minimum density of
20 dwelling units per acre. As long as the Town has been actively pursuing the AHOZ sites and
sites are adopted by the end of 2013, the Town would meet HCD requirements.
Erwin Ordohez provided an overview of the sites recommended by staff, and the justification for
these sites. A letter from First Community Housing Developer was referenced that these sites
were doable for affordable housing.
Erwin Ordohez discussed an option site which could be used as a buffer site and was one of the
original five sites recommended. He discussed the other sites which could be considered for
inclusion if any of the recommended sites were not chosen. Ordohez went over HCD
requirements and referenced information the neighborhood group provided and rating criteria.
Marico Sayoc questioned who verified allowable HCD density. Ordohez responded that he
directly contacted the Town's HCD reviewer to obtain this information.
Barbara Spector asked what assumptions were made to arrive at the density. Ordohez noted that
the type of housing would most likely be built by affordable housing developers and that a
minimum of 20 dwelling units per acre would be required to have a sufficient critical mass /scale
of units to generate enough income to pay for the site acquisition, development, operations,
maintenance, and debt service financing for a viable affordable housing development.
Todd Jarvis asked what kind of diversity of income there was for housing. Ordonez responded
that it depends on how they constructed the financing.
Todd Jarvis asked if 20 dwelling units per acre would work to meet the RHNA ranges. Ordonez
responded that larger -sized parcels were needed to meet those levels of affordability.
Barbara Cardillo questioned the reason for the buffer. Ordon"ez said that the buffer is to make
up units if a development did not meet the full number of units.
Barbara Cardillo asked wiry Oka Road was picked. Ordohez responded that the existing zoning
is medium density residential, the environmental review was done, and development standards
are already done. It is the quickest way to move along.
Joe Pirzynski asked if the buffer would be needed to meet the remaining RHNA or is just an
option for insurance. Ordonez responded it would provide flexibility if the Town approved
fewer units (e.g., Southbay site).
Barbara Spector confirmed we were working for 2013, and asked why a buffer was needed in
this time frame. Ordohez said it is not required. Would help meeting numbers for next RHNA.

A group PowerPoint presentation was given by Ok a Road/Knowles neighborhood residents
Padraig Omathura, Pat Stafford, Iddo Hadao, Shawn Wood, Jeff Loughridge, and Chris Cowan.
Topics included:
• RHNA targets are inflated.
• Traffic impacts with cumulative development.
• No public transportation in neighborhood.
• Compared North 40 with AHOZ.
• School impacts.
• AHOZ student projections are too low.
• Creation of a methodology with objective scoring criteria to prioritize the sites.
• Guidelines need to be revisited.
• Need to be prepared for next cycle (i.e., partner with schools and other communities).
Need methodology from ABAG and VTA.
• Modify zoning in CBD to have residential above commercial.
• Task force needed for next element.
• Two - thirds of units were in the density of 30 dwelling units per acre. Questioned criteria
for eliminating sites, need to simplify format of guidelines and justify guidelines.
• Rejection of Oka Road Site C recommended.
• Rejection of Southbay Site reconunended to create balanced distribution and good quality
planning.
• Recommended these sites: Bentley Acura, Los Gatos Lodge, Higgins Park, reduced
combination of Oak Rim.
• Wanted methodology adopted.
Marico Sayoc questioned the reason to remove Oka Road and Southbay.
Chris Cowan responded that Oka Road is not a balanced distribution. It does not have good
public transportation. Southbay is directly adjacent to AHOZ and would be a major clustering of
housing, Crime is a concern with this type of intensification.
Barbara Spector requested clarification of using Aventine.
Chris Cowan responded that Aventino is third largest site in Los Gatos. It has low income
housing built at 20 percent.
Marico Sayoc questioned how they came up with the recommended sites.
Chris Cowan justified putting residential above commercial. McHugh site is compatible with the
Southbay site.
Marico Sayoc stated that documentation noted a density lower than 20 units per acre,

Shawn Wood responded that one site has 30 units per acre. It has to do with financial viability
and viability of the site. Jurisdictions can provide analysis as to why the 20 units per acre are not
compatible and numbers can be reached with a lower density and spread out.
Marico Sayoc suggested working with school districts to recalculate.
Pat Stafford stated he talked to the school districts and everyone needs to be pulled together
since this will be an impact.
Noa Sklar had school impact, traffic, and crime concerns. Expressed concern about
concentrating ghetto housing in one area.
Mario Blaum commented that he was disturbed by State forecasts. Los Gatos has character that
needs to be maintained.
Teresa Landom felt that Southbay density was too high. She felt like Los Gatos is pushing low
income housing in her Campbell neighborhood. With the hospital, traffic is an issue.
Butch Erbst stated he understands schools cannot be considered an issue, but it is an issue.
Questioned where a new school could go. Expressed concern that Los Gatos students might be
bussed up to Lexington School. Lark Avenue and Winchester are bogged down now. Oka Road
develonment will iust add to that. Traffic in this area is a mess at 5:00 p.m. Take the word
"affordable" out of this discussion. It's all about housing. Los Gatos is a town not a city.
Marico Sayoc closed the public comment and requested questions and comments from the
Committee.
Barbara Spector had several comments related to housing impacts on schools.
Erwin Ordonez stated that with SB 50, the Town cannot take into account school impacts, as
there are required school fees to mitigate those impacts.
Barbara Spector requested an explanation of the State's juxtaposition for the RHNA numbers.
Erwin Ordo&z discussed Priority Development Areas and methodology, and that the Town
disputed the formula. ABAG is using projections from 2009 which are aggressive numbers.
Matthew Hudes questioned if staff had adequate time to analyze the sites that the neighbors
recommended.
Ervin Ordonez stated staff did not have adequate time. However, many of the sites
recommended are not viable.

Joe Pirzynski felt that the neighbors' presentation was good; however, the sites suggested by the
neighbors diminished his view of their presentation, since the current uses of the sites suggested
are viable to the Town. He hopes to narrow down the site to move forward.
Barbara Cardillo did not think we could do a lot in this cycle. She hoped we can push back with
the State for the next cycle. Need to make something for this period. She felt that the
recommended buffer site on Oka Road is one of the worst sites and should be taken off the table.
Questioned if Southbay density could be reduced to 20 units per acre and another site could be
used to make up the number.
Charles Erekson stated in addition to criteria used, consider what other development might be
viable for the site. Take both Oka Road sites off, as there are concentration and access issues.
He felt that the Southbay site's density should be reduced to 20 dwelling units per acre. Sees an
industrial park more of a reasonable use of that property. Higgins site is desirable, but access
makes it undesirable. Oak Rim site is a hypothetical site and there are better options.
Courthouse site is a good site. Los Gatos Lodge is a very good site that could support many
units and ready access is good and traffic would be distributed. The Lodge site also has the
potential to have bicycle and pedestrian access at rear of property,
Acura/Bentley are both great commercial sites; however, one should be maintained as
commercial.
Barbara Cardillo objected to Courthouse site, since it will add a lot to residential neighborhood.
Southbay site is not a residential area; it is industrial so impacts would be less.
Charles Erekson said that the Los Gatos Courthouse site will probably be developed as housing,
whether or not it is affordable.
Adarico Sayoc asked if analysis can be done for the additional sites, and continued the matter to
the meeting of April 10, 2013, starting at 5:00 p.m.
